Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A (alteration/expansion of a pre-existing nonconforming structure /use). Applicant proposes to construct an 8' x' 16' addition onto the northwesterly side of a said to be pre-existing garage structure. The new addition would be outside of the required five-foot side yard setback area and the Locus is conforming to all other dimensional zoning requirements. The Lot also contains a single-family dwelling. A trellis structure will be constructed on the northeasterly side of said garage. The garage is nonconforming as to side yard setback being sited 2.6+ feet at its closest point from the southeasterly side yard lot line. No change in use of the garage is proposed under this Application. The Premises is located at 10 LINCOLN CIRCLE, Assessor's Map 30, Parcel 184, Plan Book 15, Page 28. The property is zoned Residential-1. 2. The Decision is based upon the Application and the material submitted with it and the testimony and evidence presented at the hearing. There were no letters on file and the Planning Board made no recommendation as the matter was not of planning concern. 3. Applicant proposes to construct a one (1) story 8' x 16' shed addition onto the northwesterly side of the existing garage structure which would be entirely .outside of the required five-foot side yard setback area. No alteration of that portion of the garage structure that is situated within the setback area nor change in use is requested under this Application other than the addition of a trellis on the northeasterly side of the structure. The addition will also meet all other dimensional requirements. Applicant represented that the Historic District Commission had issued Certificate of Appropriateness No. 34,118 for the proposed project. 4: Therefore, the. Board finds that the construction of the addition as proposed would not be substantially more detrimental to the 4. Therefore, the Board finds that the construction of the addition as proposed would not be substantially more detrimental to the neighborhood than the existing nonconformity and would have little impact upon the surrounding area. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested relief to add a one (1) story 8' x 16' addition onto the northwesterly side of the garage as proposed, under Nantucket Zoning Bylaw §139-33A, upon the following conditions: a. The addition shall be constructed in substantial compliance with the Certificate of Appropriateness No. 34,118 issued by the Nantucket Historic District Commission; and b.
