The Decision is based upon the application and materials submitted with it and the testimony atid evidence at the hcar'-ng. The Planning Board made a positive recommendation as to allowing the change of use of the coal shed tv habitable spate. However, the Planning Board made a negative recommendation with regard to the waiver of parking spaces. There were no letters in the file. Applicants, through uwnsel, represented that the use cif the premises as a Youth Hostel was apre-existing, non-c~~nforming use, predating the 1972 enactment of the zoning by-law. In support of this representation, the Applicant pr~xiuccd a Hostel Guide and Hancibvok from 1962-63 listing the Star of the Sca as available accommodations on Nantucket. Furthermore, to the best of the Applicant's knowledge, the oval shed, the subject. of this applicatii~n, has also been used for residential purposes sitx.e prior co the enactment of the 7~czning By-law. Although the Applicant cannot establish the use cif the coil shed definitely, ail the guest records for the 1971-72 years indicate that all available beds in the two main buildings were used for guests, theret'orc, the coal shed had to have been used for employers. Applicant further represented that a Certificate of Appropriateness No. 34,35(? has been issued fur the: alterative of [he coal shed by the Historic District Commission. 3. "The Applicant had requested the increase in height of the coal shed in circler to bring the building into compliance with the applicable h~ilding ' codes. T'he requested relief is an increase in the height of the building by 3 ± feet . 'the Applicant had requested the relief' to allow the use of the shed for residential purposes in order to regularize the existing use of the pmperty. As discussed previcxisly, the coal shed has been used for two employees for many years. '1'hereforc, the relief requested by the Applicant would nat cause any additional burden to the neigltborhvud.The Board finds that the change of use of the shed to a residential use would be de minimis and would be nv more detrimental tv the neighborhood than the existing nozz-conforming use. 5. 'the Applicant had initially requested a waiver of the parking that would be necessary as a result of adding the two residential spaces. The Board discussed the fact that the property is grandfathercd for fifty (5(}) spaces since the property had, prior to 1972, provided 48 rental hods. However, after discussing the use, the Applicant determined that it could provide two (2) spaces conforming tc~ the By-law. The Applicant then withdrew its request for a waiver of the additional two (2) parking spaces that would hc. required by the change of use of the coal shed for two residential spaces. b.
