Applicant is seeking a MODIFICATION of the SPECIAL PERMIT issued in the Decision in BOA File No. 049-92, which allowed conversion of a second floor apartment in a structure, that also contained at the time the business known as the "Nobby Shop", into a separate retail-gallery space. Applicant now wishes to be able to rent the 1120+ square-foot space for office use or general retail use. Applicant is also seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-18 to waive two (2) parking spaces. Due to an error in the calculations for relief granted under said Decision, only four (4) additional spaces were waived when six (6) were necessary to be waived for the conversion to retail-gallery space. See also BOA File Nos. 087-86, 109-87 and 024-90. The Premises is located at 17 MAIN STREET, Assessor's Map 42.3.1, Parcels 177 and 178, Deed Ref. 146/228. The property is zoned Residential-Commercial. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters on file and no opposition presented at the hearing. 3. Applicant wishes to be able to rent 1120+ square feet of second floor commercial space, in a primarily commercial building, as office use with the flexibility to convert the use to general retail without coming back to the Board of Appeals. Due to an error in calculating the number of parking spaces necessary to be waived in said Decision by Special Permit, parking relief is also sought to rectify the matter by now waiving the required six (6) spaces. The change in use, which was previously limited to "retail-gallery" use, to general retail or office would not in itself require additional parking relief above the six (6) that should have been previously waived with the conversion to said a retail-gallery space. The grant of Special Permit relief in BOA File No. 049-92 was conditioned on there being a maximum of two (2) retail units in the structure, with one (1) third floor apartment, with a limitation that the retail use on the second floor be that of a "retail-gallery". Applicant is asking the Board to modify the Decision and eliminate the restriction of "gallery" use. There would continue to be a maximum of two (2) separate commercial uses in the structure, with a third floor apartment. No parking has traditionally been provided on site and none is planned under this Application as parking spaces would be physically impossible to provide. 4. Therefore, the Board finds that the Modification as requested would be in harmony with the general purpose and intent of the Zoning Bylaw and would not be substantially more detrimental to the neighborhood than the pre-existing nonconformities as there will continued to be two (2) separate commercial uses and one (1) apartment on the Locus. In addition, the Board finds that the waiver of six (6) parking spaces, in essence, reaffirming and correcting the Special Permit already granted in the Decision in BOA File No. 049-92, would also be in harmony with the general purpose and intent of the Zoning Bylaw and would not be contrary to sound traffic and safety concerns. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested MODIFICATION of the Decision in BOA File No. 049-92, to allow the use of the 1120+ square feet of second floor commercial space as general retail or office, and to allow the flexibility of converting the use between retail and office without further relief from this Board. Moretti, Attorney-at-Law, 13 Goldfinch Drive, N.P.P. Suite 64, Nantucket, Massachusetts 02554. 1. Applicant seeks relief by Special Permit pursuant to Section 139-30A and 139-18 to allow the alteration and extension of a pre-existing use, non-conforming as to parking and loading, in a pre-existing non-conforming structure and lot, without providing off-street parking on-site. The permission. requested is to allow the second floor dwelling to be converted and used as retail- gallery space. The remainder of the building will continue to be used as permitted under previously obtained permits, without being effected, except as may be expressly decided hereby. Presently the first floor and part of the second floor are used as the "hobby Shop", a retail clothing store, the basement is storeage and there are dwelling units (restricted to year-round use) on the second and third floors. The Applicant requests such relief as is necessary to convert the apartment on the second floor to use as retail-gallery space for the Main Street Gallery. 2. The premises are located at 17 Main Street, and shown as Assessor's Map 42.3.1- Parcels 117 and 178. The district is zoned Residential-Commercial. 3. Our findings are based upon the application papers, plans, testimony and representations at the hearing. 4. The property historically has had some use of the second floor for commercial purposes for several years prior to the substantial renovations which commenced in 1986. Prior to that time, the second floor dwelling space was in fact used as storage for the Nobby Shop. The structure was renovated and the dwelling use restored under a Special Permit from this Board. 5. One condition or restriction placed upon the grant of relief may be modified or waived here, without derrogating from the spirit and intent of that original grant or the Zoning By-law itself. The original grant limited the commercial use of the structure to one year-round, retail clothing store, not to exceed 2495 SF (later modified to include an additional 1000 sf on the second floor 024-90). While that condition may have had merit at the time, we find no compelling reason to continue it so as to prohibit conversion of the second floor apartment on Main Street in the commercial core of the Town (between Pacific Bank and the Pacific Club) to retail-gallery space. 5. The extended use will bring with it additional parking requirements, reckoned as follows: gallery: 1 space / 200 sf floor area: 4 spaces employees (four or fewer) 1 space 5 spaces 6. Therefore, as the current use requires one (1) space, a waiver of four (4) parking spaces is required. Insofar. as compliance with Section 139-18 would be physically impossible (the building covering all or substantially all of the lot), the application is ripe for relief by Special Permit. Moreover, Applicant reminds us, by showing the several uses of second floor spaces in this downtown core area, many with benefit of relief from this Board, and we are convinced, that the specific relief in the instant case is in harmony with the general purposes and intent of the zoning by-law We also find that the change and/or extension of use proposed will not be substantially more detrimental to the neighborhood than that which presently exists.
