Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A (alteration/expansion of a pre-existing nonconforming use/structure). Applicants propose to demolish the rear portions of the second and third floors of a said to be pre-existing commercial structure that was damaged by a fire on April 28, 1999, and reconstruct those portions without any change in the footprint or expansion or change in the restaurant use or eight (8) staff rooms and second-floor kitchen contained within the structure. There will be no increase in the nonconforming height or easterly side yard setback distance as a result of the reconstruction as only those portions of the original structure that were damaged will be replaced in an upwardly direction. Applicants are also seeking relief, to the extent necessary, by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-18 (Parking Requirements). The Locus is nonconforming as to side yard setback with the structure being sited at zero feet at its closest point from the easterly side yard lot line in a district that requires a minimum side yard setback of five (5) feet; as to height with the structure having a height in excess of the maximum allowed of 30 feet; as to parking with the Locus containing less than the required spaces on site; and as to loading zone with there being no designated space. The Premises is located at 23 BROAD STREET, Assessor's Map 42.4.2, parcel 77, Plan Book 21, Page 43, Lot 1. The property is zoned Residential-Commercial. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made a favorable recommendation. There were no letters on file and no opposition expressed at the hearing. 3. Applicants propose to demolish and reconstruct a portion of an (062-99) existing structure in order to correct damage done by a fire on April 28, 1999. As the work will take place within the existing footprint of the structure, there will be no increase in the nonconforming setback on the easterly side of the structure which has a zero side yard setback, nor increase in the pre-existing nonconforming height once the project is completed. There will be no removal of any portion of the first floor with the majority of the exterior work taking place over the rear portion of the structure on the second and third floors. There will be no increase in the number of staff rooms (8), restaurant capacity or ancillary storage areas. Applicants received a "Temporary Permit" from this Board on July 9, 1999, under Nantucket Zoning Bylaw §19-26H to proceed with the necessary repairs as noted above until a duly noticed and held public hearing could take place on July 23, 1999 at which this Decision was made. Applicants agreed that any work that was performed under said Temporary Permit was done at the owner's own risk and should there be an appeal taken from this Decision under Mass. General Laws Chapter 40A, Section 17, all work that was/is allowed under the Temporary Permit or this Permit, specifically to those portions of the structure that lie within the required five-foot easterly side yard setback area and/or over the maximum 30-foot height limitation, would stop immediately. 4. Therefore, the Board, finds a grant of Special Permit relief to allow demolition and reconstruction of portions of the structure within the easterly required five-foot side yard setback area and of portions of the structure over 30 feet would not create an increase in the nonconformng nature of the structure as there will be no change in the structure, but a recreation of the historic structure as it previously existed. The Board further finds that said demolition and reconstruction would not be substantially more detrimental to the neighborhood than the existing structure. The proposed work would have little impact upon the neighborhood as there would be no discernible change in the structure and increase in the intensity of use of the structure. The Board further finds that no relief under Nantucket Zoning Bylaw §139-18 is necessary for parking as there is no increase in the intensity of use or square-footage of the structure as a result of the demolition and reconstruction project. 5. The Temporary Permit would allow Applicants to commence work on the structure at their own risk immediately without having to be delayed waiting for a duly noticed public hearing of this Board, filing of a decision and waiting for the required 20-day appeal period to expire. A Temporary Permit may be granted by this Board without public notice and without requiring Applicants to wait the 20-day appeal period. The Board voted unanimously to grant the requested Temporary Permit under Nantucket Zoning Bylaw §139-26H to allow the immediate commencement of work on the condition that the Applicants file an Application for Special Permit relief with this Board forthwith, which Applicants have done and will be heard at a duly noticed Public Hearing on July 23, 1999 at 10:00 A.M. in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts. Applicants also acknowledge in their written request for said Permit that they are operating at their own risk until relief is granted as a result of a regular Application to this Board for Special Permit relief. Should an appeal be taken from a decision of this Board under Mass..
