At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00 P.M.,
Friday, July 9, 1999, in the Conference Room, Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, on the Application of Andrew M. and Lynda A.
wliauer, of 880 Uport Hill Road, Easton, CT 06fi12, Board of Appeals File No. 061-
99, the Board made the following Decision: .
{1) Applicants are seeking telisf by SPECIAL PERMIT under Nantucket Zoning Bylaw
§139-33A (aiterationlexpansion of apre-existing nonconforming structure/use}.
Applicants propose to Change the use of a said to be pre-ewsting structure Nom
that of a restaurant, retail shop and three (3) bedroom apartment to use as solely
retail space, with ancillary storage, while msintalning the existing epettment,
tesuRing in the elimination of the restaurant uae. Applicants allege that the current
uses require a total of 24 spaces which are grandfathered. The new uses will
require up to 16 spaces. To the extent necessary, Applicants are also seeking a
SPECIAL PERMIT under Nantucket Zoning Bylaw §'139-20 waiving the o1~ street
loading zone requitement should the Board find that the space is .not
grandfathered. No expansion of the footprint is proposed under this Application.
The Premises is located at 2 INDIA STREET, Assessor's Map 42.3.1, Parcel 168.
The property is zoned Residential-Commercial.
(2) The decision is based upon tare Application and the materials submitted with it end
the testimony and evidence presented at the hearing. The Planning Board made
a favorable recommendation and there were no letters in the -fits-
(3} Applicants, through their attorney, repnrsented that they wished to abandon the
restaurant business they had conducted for some twenty (20) years at 2 India
Street. They intend to convert the area used for the restaurant into additional
retail and storage space for their ongoing antique business which has been
operating on one floor of the building. Appllicants adcnowtege that they are
voluntarily giving up their tights to restaurant use of the subject premises. The
three (3) bedroom apartment on the top floor of the building will not be altered in
any fashion. As a result of this change in use the parking requirements applicable
to the premises will be significantly reduced as follows:

(4) Therefore, the Board finds as follows:
{a) The proposed change in use wilt result in 8 lessening of the intensity of
the use of said building and is in keeping with the genera{ purpose and intent of
the Zoning Bylaw and will not ~ substantially store detrimental to the
neighbofiood than the existing non-conformity. And the Board notes that there
will be no expansion of the existing footprint of the structure.
(b) This change in use will reduce the parking tequirements ftom 22 spaces
to '! 3 spaces.
(5) Accordingly, by UNANIMO~ V~T~, the BOARD G E P IA
PER IT UNDER Nantucket Zoning Bylaw §139-33A, allowing the conversion from
restaurant to retail and storage space and establishing the parking requirements
for this use at 13 spapes. The Board further finds that no relief is necessary under
§139.24 as a loading zone is grandfathered and not effected by this change in
use.

Applicants' current grandfathered use is a 130-seat restaurant, retail shop and three
(3) bedroom apartment. Applicants wish to discontinue restaurant use and convert
restaurant space into additional storage and additional retail space. Such a change
constitutes an alteration of apre-existing non-conforming use requiring special permit
relief.
As to parking, the applicants are grandfathered for 24 spaces as well as a loading
zone. The parking computation is as follows:
Apartment 1 space
Retail (1200 sq. ft.) 6 spaces
Retail (3 employees) 1 space
Restaurant (130 seats) 16 spaces
Total spaces
The new use will require parking spaces, computed as follows:
Apartment 1 space
Retail (2400 sq. ft.) 12 spaces

There is a reduction of ten parking spaces and the loading zone requirement does
not change.
