DECISION
1. At a public hearing of the Nantucket Zoning Board of
ltppeals, on Friday, Juiy 9, 1999, at 1:00 I'.M., in the Conference
Room, Town Annex Building, 37 Washington Street, Nantucket,
Massachusetts, the Board made the following dPClsion ot1 ttre

2. The Applicants are seeking relief by SPECIAL PERMIT
under Nantucket. Zoning By-law § 139-33.A.(8} to alter and extend
a said to be pre-existing, rronc:arrforming lot. The Applicants
propose t-o merge the Locus, shown as Farrel B on Plan File 42-F
and Parcel 2 orr Plan File 42-G, with the land shown as LoC 2A vri
Plan file 42-C. The Locus is said to r_onfnrm ro x11 c3imPnGion:~i
requirements of the Nantucket Zoning By-law (Che "By-law"}, with
the exception of frontage, having about 162.62 €eet of frontage
on Quidnet Rvad. The re$ultirrg lot, after the merger of tiro

and would, as a result, be less nonconforming as to frontage, hi~r.

The Applicants also propose tv convey to their westerly
abutter a strip of land containing about 2,450 square feet of
land area, which the abutter is said to need to cure a possible

The Premises are located at 15 and 17 Quidnet Raad;
Assessor's Map 21, Parcels 117.3, 117.4, and 117.6; shown ~~s
Parcel B on Plan File 42-F and Parcels 2 and 2A on Plari File 42-
~; and zoned Limited Use General - 3.
3. Our decision is based upon t21e application and
accompanying materials and representations and testimony received
at our public hearing. The Planning Board made rto recommendation
on this application, because the matter is not of planning
concern. There was no support or opposition presented in person
or by correspondence at the public hearing. One abutter was
present at the public hearing and asked questions that were
satisfactorily answered by the Applicants.
4. The Locus, which is now owned by the nppicants, is
shown as Parcel B on Plan File 47.-F and Parcel 2 on Plan Fite 42-
G. The LOCUS Conforms tv all dimensional regiiirPmenti-s of the By-
law, with the exception of frontage, having about 162.62 feet of
trontage on Ouidnet Road. Under the 1996 Decision, the Locus was
merged into one lot, which retained its status as valid prF-
existing, nonconforming lot as to Lrontage.
5. The Applicants propose to merge the vacant land shown
as Lot 2A on Plan File 42-G ("Lot 2A") with the Locus. Lot 2A
contains about 10,506 square feet of land area and has frontage
on Quidnet Road of about 13.33 feet. After the merger of the
Locus and Lot 2A, the resulting lot would have r-~t.al frontage of
about 178.95 feet and would, as a result, be less nonconf_~rming
as to frontage, but would rsot conform to the minimum frontage
requirement of 200 feet in this zoning list-rict.
5. The Applxrallts also propose to convey to ttleir westerly
abutter a strip of land containing about 2,450 square feet of
land area, which land the abutter is said to need to cure a
possible ground cover problem. The conveyance of this strip
would not affect the nancanforming nature of said resulting lat.
7. The elimination of zoning nonconformities should be
encouraged. In this case, a nonconforming lot will be made less
nonconforming, and an abutter's possible zoning nonconformity may
be cured. The Applicants are eliminating as many- nc~n<~c~nPc~rmit.i?a
as they possibly can, and they will nit rrPar.r any new
nonconformities or increase any existing ones. Upon these facts,
the Board of Appeals finds that the grant of the rPgtlesrPCi
Special Permit relief is in harmony with the general purpose and
intent of the By-law. The Board further finci4 that the
alteration will not be Substantially more detrimental to trle
neighborhood than the existing nonconformities.
s. Accordingly, by UNANIMOUS vote, the Board of Appeals
grants relief by SPECIAL PERMIT, under Nantucket Zoning By-law
§139-33.A(8), to allow the alteration and extension of a pre-
existing, nonconforming lot by (a) merging r_he Locus (Parcel B
and Lot 2) with Lot 2A, and (b) conveying a str.i~~ of land
containing about 2,450 square feet to an abutter, with t.}~P
resulting lot, after both the merger and the conveyance, r_o

retain its status as a pre-existing nonconforming lot of record
for all purposes shown on a "proposed subdivision" plan dated
4/19/99, marked as Exhibit A and attache ereto.

Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw §139-33A(8) (alteration/expansion of a.pre-existing
nonconforming structure/use). Applicant proposes to acquire, and merge
with the Locus, shown as Parcel B on Plan File 42-F and Parcel 2 on Plan
File 42-G, the land shown as Lot 2A on Plan File 42-G. The Locus is said
to conform to all dimensional requirements of the Bylaw with the
exception of frontage, having about 162.62. of frontage along Quidnet
Road. After the acquisition and merger of Lot 2A, the Locus would have
a total frontage of about 178.95 feet and would, as a result, be less
nonconforming as to frontage but would not meet the minimum frontage
requirement in this district of 200 feet.
Applicant also proposes to convey to the westerly abutter a strip

ADDENDUM TO BOARD OF APPEALS APPLICATION

The Applicants are seeking a Special Permit under §139-

42-G (the "Locus") The Locus conforms to all dimensional

Minimum required frontage in this Limited Use General 3 zoning
