FERRARE, JR., of P.O. Box 2889, Nantucket, MA 02584, Board of Appeals No. 054-99, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-16C(2) (Intensity Regulations - setbacks) or in the alternative a VARIANCE under Bylaw §139-16A, to validate the siting of a set of steps and deck that provide access to a side entrance on the northerly side of a single-family dwelling. The steps/deck are sited 4.0+ feet at their closest point from the northerly side yard lot line in a district that requires a minimum side yard setback of five (5) feet. The structure itself is sited outside of the required setback area and the Locus meets all other dimensional zoning requirements. The Premises is located at 12 ESSEX ROAD, Assessor's Map 67, ~ Parcel 638, Plan File 51-G, Lot 39. The property is zoned Residential-Commercial-2. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made a negative recommendation on relief granted by Variance and made no comment about relief granted by Special Permit. There were no letters on file in favor or in opposition. One (1) abutter was present to express concern about precedent in the neighborhood but stated that he had no objection to this Application. There was a letter on file from Jeffrey Blackwell, P.L.S., of Blackwell and Associates, Inc., a professional land surveying firm, stating that he had been hired by the Applicants to site the structure on the property and subsequently provided the construction stake out for the foundation placement. 3. Applicants represented that the Locus was part of a large subdivision which was comprised of very narrow lots with theirs being about 45 feet in width and averaging about 190 feet in depth. They had contracted with a licensed surveyor to site the stakes that the excavator used to dig the foundation hole and then-had the surveyor site the foundation stakes which were then used to construct the 892+ single-family dwelling in order to avoid having a setback problem. However, during the process the northerly side door entryway steps, which showed on the plans that were being used to site the house, were not included by the surveyor in the calculation for setback from the northerly side yard lot line. The house is sited outside of the five (5) foot required setback area but the steps/deck are sited 4.0+ feet at their closest points from said lot line. Applicants are asking the Board to validate the steps as currently located. Applicants further represented that due to the layout of the interior floor plan, removal of the steps and deck and corresponding removal of that side door would not be practical and the steps had already been cut back with the removal of that portion of the deck that made the steps extend farther into the setback area, leaving three steps to the threshold to meet Building Code requirements, and a small deck area on each side of the door. Applicants stated that they had talked with the neighbor to the north and represented that she had no concern with the relief requested and offered to alter the driveway easement between theirs respective lots at some point in the future in order to maintain the subdivision requirement that there be a ten-foot driveway easement with no impediments. 4. Therefore, the Board finds that the relief requested by Special Permit meets the requirements of Nantucket Zoning Bylaw §139-16C(2) as the unintentional setback intrusion is not greater than five (5) feet into a the required five (5) foot side yard setback area and is no closer than four (4) feet from the northerly side yard lot line. The Board further finds that due to the interior layout of the house and placement on the Locus as well as the fact that the steps have been cut back to the minimum point required to meet the Building Code, the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion, and as the structure was so sited after 1990, the Board finds that the siting was reasonably based upon a licensed survey. Said grant of relief would also be in harmony with the general purpose and intent of the Zoning Bylaw. 5. Accordingly, by a vote of four (4) in favor (Waine, O'Mara, Parent, Sevrens) and one (1) opposed (Toole), the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-16C(2) to validate the northerly side steps and deck as currently constructed and sited upon the following conditions: a. The setback intrusion on the northerly side yard setback area shall be no closer than four (4) feet as shown on the plan dated Sept. 9, 1998 and revised June 2, 1999, done by Jeffrey Blackwell, licensed surveyor, of Blackwell & Associates, Inc. for the Applicants, marked as Exhibit A and attached hereto; and b. There shall be no further building within the required five (5) foot side yard setback area.
