At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1:00 P.M., Friday, June 11, 1999, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of GLORIA F. KUNZ, of 277 Main Street, #8, East Aurora, NY
14052, Board of Appeals File No. 049-99, the Board made the following
Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw §139-16C(1) to allow the siting of a new garage structure
within the setback areas by reducing the side and rear yard setback
distances from the required ten (10) feet to 7+ feet at its closest point
from the northerly side yard lot line and 6.6+ feet at its closest point
from the rear yard lot line.
The Premises is located at 7 NICKANOOSE WAY, Assessor's Map 55,
Parcel 557, Plan File 14-F, Lot 56. The property is zoned Residential-10.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the
hearing. The Planning Board recommended that if relief was granted that
relief only apply to the garage structure and not the property as a
whole. There were three (3) letters in favor of the Application on file.
3. Applicant represented that the Locus is situated within a
Residential-10 zoning district which requires a minimum side yard
setback of ten (10) feet. However, at the date of the plan approval by
the Planning Board on March 26, 1984 the 9,356+ square-foot Lot was
governed by Residential-1 zoning district requirements, i.e. 5,000
minimum lot size, 50 feet of frontage and a five-foot side and rear yard
setback. The 1,269+ square-foot single-family dwelling was constructed to
meet the Residential-1 requirements. The Locus is proximate a large
subdivision that has a much denser ground cover, with only a.five (5)
foot minimum side yard setback as the area was substantially built out
under the Residential-1 requirements. Applicant further stated that due
to the siting of the existing structure on the irregularly shaped Lot,
there is limited space in which to construct the 288+ square-foot garage_
The Locus has about 56.00+ feet of frontage on a cul de sac with the only
driveway access to the proposed garage having to run along the northerly
side yard lot line. The dwelling is sited 20.0+ feet at its closest point
from that lot line and the proposed garage would be sited about seven (7)
feet at its closest point from the northerly side yard lot line and 6.6±
feet at its closest point from the westerly rear yard lot line. Applicant
has received a Certificate of Appropriateness No.,3a,-5~s~} issued by the
Nantucket Historic Commission for the garage. WIth the construction of
the garage, the total ground cover ratio would be under the 20% maximum
allowed under the Zoning Bylaw.
4. Therefore, the Board finds that there is precedent within the
immediate neighborhood as the Board has granted similar relief to reduce
the setbacks to construct ancillary buildings. A grant of Special Permit
relief to reduce the side and rear yard setback requirements for the
garage from from ten (10) feet to no closer than seven (7) feet at its
closest point from the northerly side yard lot line and no closer than
6.6 feet at its closest point from the westerly rear yard lot line is
in harmony with the general purpose and intent of the Zoning Bylaw and
would be in keeping with the surrounding neighborhood density.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-16C(1) to
reduce the required ten-foot side and rear yard setbacks to no closer
than seven (7) feet at its closest point from the northerly side yard
lot line and no closer than 6.6 feet at its closest point from the
westerly rear yard lot line to allow construction of the proposed garage
on the following conditions:
a. Relief is granted to allow the siting of the garage structure
as proposed and there shall be no further construction within the
required ten-foot side and rear yard setback areas;
b. There shall be no alteration of the garage use without
further relief from this Board; and
C. The garage shall be constructed in substantial conformance
