Applicants are seeking a MODIFICATION of a VARIANCE that was issued in Board of Appeals File No. 002-87 which allowed a northerly side yard setback for the single-family dwelling of 9+ feet. Upon a subsequent survey of the property, i.e., after the grant of the Variance relief, the actual setback distance was computed to be 8.5+ feet from the northerly side yard lot line. No alteration of footprint of the structure was done within the required 10-foot side yard setback area. Applicants now ask that the Board modify the Variance granted in BOA File No. 002-87 to reflect that the correct setback is 8.5+ feet at its closest point from the northerly side yard lot line. The Premises is located at 14 DEVON STREET, TOM NEVERS, Assessor's Map 71.3.2, Parcel 212, Land Court Plan 5004-6, Lots 29 - 32, inclusive, Block 24. The property is zoned Limited-Use-General-3. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters from abutters on file and no opposition expressed at the Hearing. 3. Applicants, through counsel, represent that a predecessor in title obtained a Variance from this Board on February 6, 1987 pursuant to Nantucket Zoning Bylaw §139-16 allowing a sideline setback of nine (9) feet due to the owner's unintentional mis-siting of the single-family dwelling. The mistake did not become apparent until after completion of the structure, which construction commenced in 1984 prior to the time when adequate site plans were required to obtain a Certificate of Occupancy which was issued in 1984. The error was picked up upon the sale of the property in 1987. Since the Board found in 1987 that the Locus was a "lot of record" pursuant to Zoning Bylaw §139-16, the Bylaw required a ten (10) foot sideline setback rather than 20 feet as required in this district. It now appears that there was a mis'~ake in`~,'Y the request-fo.r relief. Based upon a plot plan dated April 13, 1999, it appears that the setback is actually 8.5+ feet at its closest point from the northeasterly side yard lot line. There has been no alteration to the property since 1987. Applicants are requesting that the Board modify the Decision issued in Board of Appeals File No. 002-87 to reflect the correct setback figure of 8.5+ feet. Applicants further represent that there is no cure for the setback intrusion short of moving the structure. No further construction within the ten (10) foot side yard setback area is proposed. 4. Therefore, the Board finds that the Modification of the Variance granted in the Decision in Board of Appeals File No. 002-87 to reflect an actual northeasterly side yard setback distance of 8.5+ feet at its closest point rather than the previously permitted nine (9) feet, would not be detrimental to the public good or nullify or substantially derogate from the general purpose and intent of the Zoning Bylaw. The relief sought is minimal and would have no impact upon the neighborhood as the facts have existed as shown today since 1984. Requiring the Applicants to move the structure out of the setback area would involve substantial financial hardship to the owners. Furthermore, the grant of a modification will not create any new non-conformity but will simply permit the status quo to continue. 5. Accordingly, by a unanimous vote, the Board GRANTS to the Applicants the requested MODIFICATION of the .VARIANCE granted in the Decision in Board of Appeals File No. 002-87 to reflect the correct northerly side yard setback distance of 8.5+ feet at its closest point without any further construction within the required ten (10) foot setback area allowed. ADDENDUM Deborah and Kenneth Withrow 14 Devon Street Map 71.3.2, Parcel 212 The Applicants seek a Modification to the Variance that was issued by the Nantucket Zoning Board of Appeals (the "Board") dated February 6, 1987 (File No. 002-87) with respect to the property located at 14 Devon Street (the "Property"). The Modification would allow a sideline setback of 8.5 feet. On February 6, 1987, the Applicants' predecessor in title, Milton Rowland, obtained a Variance (the "Original Variance") pursuant to the Nantucket Zoning By-Law (the "By-Law") § 139-32 allowing a sideline setback of nine (9) feet. (A copy of the Original Variance is attached as Exhibit "A".) Since the Board found, on the record, that the Property was a "lot of record" pursuant to §139-16, the By-Law required a ten foot sideline setback. Mr. Rowland requested and the Board granted a nine (9) foot setback. It appears that there was a mistake in the request for relief. Based on a plot plan dated September 22, 1987 (attached as Exhibit "B") and a plot plan dated April 13, 1999 (attached as Exhibit "C"), it appears that the setback is actually 8.5 feet. There has been no alteration to the Property since 1987. The Applicants request that the Variance be modified to provide that the sideline setback should be allowed as shown on the attached plot plans and should be noted to be +/- 8.5 feet. The requested relief is in harmony with the purpose of the By-Law and is modest in nature. The Board found in the Original Variance that a literal enforcement of the By-Law would involve substantial hardship to the owner and the desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of purpose of the By-Law. Furthermore, the grant of a modification will not create any new non-conformity or increase any existing non-conformity; it will simply permit the status quo to continue. As stated above, nothing with respect to the Property has changed since the Original Variance. The Applicants request that the Board vote in favor of the requested modification to Variance with respect to the sideline setback. Applicant seeks a VARIANCE from the side-line setback requirements of ?.oning By-Law SECTION 139-16C. If granted, Applicant would be allowed to .i i I r i i have his existing single-family dwelling remain as presently sited with its northeastern corner approximately 9 feet fromthe northerly side lot line, where 10 feet is said to be required. The premises are at DEVON STREET, Tom Nevers, Assessor's Pa;eels 71.3.2-212, 213, 214 and 215, Land Court Plan 5004-G, Lots 29, 30, 31 and. 32 in the zoning district LIMITED USE ' GENERAL-3. 2. Our findings are based upon the Application papers and testimony, representations and plans received at our hearings of January 16 and February 6, 1987. From these, ue find that Applicant's duelling is only 9 Eeet Erom [he northerly side lot line. Applicant's position, uncontested on this record, is that his is a "lot of record" per Section 139-16, speci- fically, Subsection C, hence, required to have only a 10-foot side lot line setback, not 20 feet as otherwise required in the LUC-3 district. His representation is that the lot was of record in the Registry of Deeds since mid-1972 zoning and , since .then, has never been in contiguous owner- ship with other land. That position was not challenged.'Accordingly, ue further find that Applicant's intrusion into the required setback is one foot, not 11 feet. Moreover, this lot of record, though only 0.25 acre, was properly buildable With subminimum frontage. 3. In any event, the mortgage plot plan made of record showed the required 10-foot setback and its certification by a licensed surveyor. This, dated 7/19/8», is said to have followed construction of the foundation. After completing the house, the required as-built survey was made exposing the shift and rotation of the house relative to the originally-planned siting. Short-fall os to setbsck, not labeled on tnis plan, apparently was not noted by the Building Dept. in granting a Cert. of Occupancy. The non-conformity came to light with a Further survey linkdd to a pending sale of the premises. 4. IE no relief were granted, Applicant might face a cost of $4-5000 or more to remove the instruding easterly corner and relocate heating equip- ment to another interior location. Such cure Eor•the zoning non-conformity would likely be unacceptable to the HDC as not permissible within a Certificate of Appropriateness. 5. Given that the intrusion is no more than one foot, that the house was completed in good faith reliance upon a licensed survey and that no certain cure. is available short of moving the house, the equities are found to lie with Applicant. ({ardship running with the land is evident. Relief would not be detrimental to the pub11 good nor would it be in derogation of the purpose and intent of the zoning chapter. 6. Conditioning relief upon Applicant obtaining an easement Erom his easterly abutter, i.e., to provide a compensating increase in the abutter's setback, is inappropriate here with the Town as the abutter.and unlikely to _' ~~ sell oc build.
