ADDENDUM A
Statement of Relief Sought
1. Applicant appeals a decision of the Building Commissioner to deny her
application to amend Building Permit #13631-96. Attached as Addendum B is the
decision, consisting of a letter dated October 5, 1999 from John H. Dunn and received
by Brenda Noll, formerly Brenda Noll Lindsay, on October 18, 1999.
The grounds for the Building Commissioner's denial is the applicant's failure to
"proceed continuously to completion so far as is reasonably practicable", resulting in
the permit being considered abandoned pursuant to § 139-26E of the Code of the
Town of Nantucket. The language of § 139-26E is as follows:
Any permit issued shall be deemed abandoned and invalid unless the work
authorized by it shall have been commenced within six (b) months after its
issuance; however, for cause, one (1) or more extensions of time, for periods
not exceeding six (6) months each, may be granted in writing by the Inspector
of Buildings. Work under such permit, in the opinion of the Inspector of
Buildings, must proceed in good faith continuously to completion so far as is
reasonably practicable under the circumstances.
Building Permit #13631-96 was originally issued September 23, 1996. The work
authorized by that permit was to build a garage apartment as a second dwelling. The
work of the project did commence within six months of its issuance. In fact, work
commenced on the project on February 12, 1997 with the start of the installation of
the batterboards. That work continued on February 14, 1997 followed shortly by the
required excavation, footings and foundation. The footings were inspected by the
Building Department on March 27, 1997. The requirement of § 139-26E to seek an
extension in writing applies only to the commencement of the work. No extension of
time was required in this instance as the work did commence within six (6) months of
the permit's issuance.
Furthermore, work of the project proceeded as was "reasonably practicable under the
circumstances." At the time the permit was first issued, Brenda Noll was married to
Stephen A. Lindsay, a builder. Mr. Lindsay was the builder of the dwelling which is
the work authorized under this permit. Shortly after commencing the project, the
Lindsays began experiencing marital difficulties which put a tremendous strain on
their relationship, and they were unable to continue the work of the project as
continuously as it had been proceeding. The Lindsays resolved their difficulties and
ended their marriage this past August. Ms. Noll then made application to amend the
permit, as she had redesigned the building to better suit her and her children's needs.

She filed that amended application on September 14, 1999. See Addendum C
attached hereto.
Since the work under Building Permit #13631-96 did and will, in fact, "proceed in
good faith continuously to completion so far as is reasonably practicable under the
circumstances", Ms. Noll should have been granted an amended permit based on her
revisions.
2. By denying Ms. Noll the issuance of her amended application, the Building
Inspector is claiming that she must make application for a new permit for a new
dwelling. As such, he contends that she must "get in line" as her permit is subject to
§ 139-24(3), the Interim Growth Rate section of the zoning by-law. 'The applicant
requests that this Board of Appeals determine that applicant is not subject to the
Interim Growth Rate section of the zoning by-law. The current provisions of the 139-
24(3) were not in effect or operation at the time the1996 permit was issued.
3. Alternatively, if the Board of Appeals denies Ms. Noll's appeal and agrees with
the Building Commissioner that she is subject to the current Interim Growth Rate
section, then this Board must also determine where she is "in line" to receive a permit
for a second dwelling. Applicant requests that the Board direct the Building
Commissioner to act as though her application to amend permit #13631-96 filed on
September 14, 1999 was in fact an application for a new permit for a second dwelling
and the determinative date for the issuance of a new permit.
4. Alternatively, the applicant requests that the Board of Appeals grant her a special
permit on hardship grounds and allow the applicant to obtain a permit to finish the
construction of a second dwelling forthwith, and not be subject to the Interim Growth
Rate By-law, § 139-24(3).
Ms. Noll is ayear-round, long-time resident of Nantucket. Her two children both
attend the Nantucket schools. She is employed as a teacher's aide at the elementary
school. Her salary is such that she requires the summer rental income from her
primary dwelling in order to support herself and her children. She is finishing the
project of building the second dwelling so that she and her children can remain on
Nantucket. Because of her special circumstances, she should be granted a variance or
special permit based on hardship.

Nantucket and 780 CMR the Massachusetts State Building Code and is for the
following reasons denied.
The building permit 13631-96 issued September 23, 1996 has not "proceeded
continuously to completion so far as is reasonably practicable" and is therefor is
abandoned pursuant to §139-26E of the Code of Nantucket and 780 CMR 111.8
the Massachusetts State Building Code and is no longer valid.
Please be advised that you may appeal this decision of the Building
Commissioner to the Zoning Board of Appeals pursuant to §139-31 of the Code
of Nantucket and/or to the Board of Building Regulations and Standards pursuant
to 780 CMR 122. If you require any additional information please contact my
office.
