DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, May 14, 1999, at 1:00 P.M., in the
Selectmen's Meeting Room, in the Town and County Building, Broad
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of NEAP B. WHELDEN (Owner) and LESLIE
HEIDEN (Contract Purchaser), c/o Reade, Gullicksen, Hanley &
Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts
02584, File No. 042-99:
2. The Contract Purchaser, as Applicant, is seeking a
SPECIAL PERMIT under Nantucket Zoning By-law X139-33.A
(alteration or expansion of a pre-existing nonconforming
structure or use). The Applicant proposes to convert the use of
the existing structure upon the subject property (the "Locus")
from the presently nonconforming commercial garage and storage
use to a conforming use as a single-family dwelling. The Locus
is nonconforming as to lot size, having area of about 3.420
square feet in a district in which minimum area is 5,000 square
feet. The structure upon the Locus is nonconforming as to ground
cover ratio, having ground cover of about 1,330 square feet, for
a ground cover ratio of about 38.89% in a district in which
maximum ground cover ratio for undersized lots is 30%; as to side
and rear yard setback, having easterly side yard setback of about
1.9 feet at the closest point and northerly rear yard setback of
about 3.4 feet at the closest point, with minimum side and rear
yard setback in this district being 5 feet; and as to use, being
a commercial structure in a district in which commercial
activities are not permitted. The Applicant further seeks a
MODIFICATION of the VARIANCE issued in Board of Appeals File No.
008-76 to remove the requirement therein that the structure be
used for storage purposes and not contain plumbing. The Owner
and the Contract Purchaser further request that the Board of
Appeals determine that the Locus is to be considered as a
separate lot of record, or in the alternative to grant a VARIANCE
from the minimum lot area requirement of 5,000 square feet under
By-law §139-16.A, in order to ratify and confirm the status of
the Locus as a separate lot of record and to allow such
conversion of use. See also Board of Appeals Files Nos. 002-74,
008-76 and 031-94. The Locus is situated at 8 COPPER LANE,
Assessor's Map 42.3.3, Parcel 134, is shown as Lot 2 on plan
recorded with Nantucket Deeds in Plan Book 14, Page 44, and is
zoned as RESIDENTIAL-OLD HISTORIC.

3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was favorable, provided that the existing
structure be converted in use,: but not demolished. There was one
letter on file in support of the conversion, and three neighbors
spoke in favor of. the conversion, provided that the footprint of
the structure. not be altered.
4. The Locus contains a commercial garage structure which
pre-exists the Nantucket Zoning By-law's original adoption in
1972; the Applicant informed the Board that it was originally
used as a dairy ,garage, and later has been used for various.
Storage purposes, including storage of trucks and materials by
the present Owner in his plumbing business. zn Board of Appeals
Case No. 002-74, the then-owner of the Locus applied for a
variance to permit the expansion of the structure, and this
application was denied. In Case No. 008-76, the then-owner again
applied for a variance to permit expansion, and on that occasion
this relief was granted, for a Z2' x 26' addition, and with the
decision reciting that the structure would be used for storage
and would contain no plumbing facilities or services. Building
Permit Nv. 730-77 was issued for the construction of this
addition. This addition created the setback of about 3.4 feet
from the northerly, rear lot line; at that time, the required
setback was 3 feet, so the addition was lawful as to this setback
when it waa constructed and became nonconforming when the 5-foot
setback requirement was subsequently. adopted. In Board of
Appeals Case Na. 031-94, the present Owner obtained a Special
Permit for the partial alteration of the structure to contain an
apartment, while the pre-existing nonconforming garage use would
be continued in part; this Special Permit lapsed, however, not
having been exercised within two years following its granting. A
plot plan of the Locus, showing the structure and conditions upon
the Locus as they now exist, is attached hereto as Exhibit A.
5. The .Applicant's proposed change in use of the
nonconforming structure upon the Locus would eliminate the pre-
existing, nonconforming commercial use and replace it with a
conforming residential use. Notwithstanding the dimensional
nonconformities of the structure, this change of~ use would
provide a benefit to the neighborhood in which it is situated,
and further the public interest in the elimination of
nonconforming uses. The language in the decision in Case No.
008-76, indicating that the structure was to be used for storage
purposes and would not contain plumbing facilities, is inapt with
regard to the conversion to residential use.
6. The Locus has been a separate lot from the adjoining
land, now also owned by the Owner, since 1954, prior to the
acceptance of the Subdivision Control Law in Nantucket and also
prior to the adoption of the Nantucket Zoning Ay-law. In 1954,
the Locus and the Owner's adjoining land were. each conveyed to
separate owners. Both the Locus and the adjacent parcel then

contained buildings, which are still standing. The Locus and the
adjacent parcel continued in separate ownership until December
21, 1990, when the present Owner, who had by then obtained the
adjacent property from members of his family, purchased the Locus
from another owner. As parcels lawfully improved prior to both
zoning and subdivision control requirements, they did not merge
when they later came into common ownership. Accordingly, as no
variance relief is necessary in order to validate the status of
the Locus as a separate lot for building and zoning purposes, the
Board of Appeals declined to grant a variance as requested in the
alternative by the Applicant.
7. Accordingly, by UNANIMOUS vote, the Board of Appeals
made the finding that the proposed change in use of the structure
to residential use would not be substantially more detrimental to
the neighborhood than the pre-existing commercial use, and
GRANTED the proposed SPECIAL PERMIT for that purpose. The Board
further voted UNANIMOUSLY to grant a MODIFICATION of the Variance
granted in Case No. 008-76, to remove the conditions that the
structure be used for storage and not contain plumbing
facilities.
8. The relief hereby granted is subject to the following
conditions:
(a) As requested in the Planning Board recommendation
and as agreed to by the Applicant, the present structure upon the
Locus shall not be demolished.

ADDENDUM TO APPLICATION

The Contract Purchaser desires to convert the existing
commercial structure upon the subject property (the "Locus") to
use as a single-family dwelling. The Locus is nonconforming as
to lot size, having area of about 3,420 square feet in a district
in which minimum area is 5,000 square feet. The structure upon
the Locus is nonconforming as to ground cover ratio, having
ground cover of about 1,330 square feet, for a ground cover ratio
of about 38.89% in a district where maximum ground cover ratio
for undersized lots is 30%; as to side and rear yard setback,
having easterly side yard setback of about 1.9 feet at the
closest point and northerly rear yard setback of about 3.4 feet
at the closest point, with minimum side and rear yard setback in
this district being 5 feet; and as to use, being a commercial
structure in a district in which commercial activities are not
permitted. This nonconforming structure pre-exists the Nantucket
Zoning By-law, as well as the effective date of subdivision
control in Nantucket, in its use.
The Locus was in common ownership with land to the west
containing a dwelling and garage until 1954, prior to the
acceptance of the Subdivision Control Law in Nantucket and prior
to the effective date of the Nantucket Zoning By-law. At that
time, the Locus was improved with a garage and storage structure
which comprises the southerly portion of the existing structure,
about 38 feet long and about 26 feet wide. In 1954, the Locus
was conveyed into separate ownership from all adjacent land, and
remained in separate ownership until 1990, when the present
owner, who had acquired the land to the west previously,
purchased the Locus. Meanwhile, the structure upon the Locus was
improved by the construction of an addition on its northerly
side, about 12 feet long and about 26 feet wide, pursuant to a
variance from ground cover requirements granted by the Board of
Appeals, issued on May 3, 1976, in Case No. 008-76, and Building
Permit No. 730-77, issued on or about June 14, 1977. (This
addition resulted in the structure having setback of about 3.4
feet from the northerly or rear lot line. At the time, the
required rear and side yard setback was three feet, so the
addition conformed as to setback when it was constructed, but
later became a pre-existing, nonconforming structure as to rear
yard setback when the present five-foot yard requirement took
effect.) Since both the Locus and the land to the west were
improved at the time of the imposition of the zoning requirements
with which the Locus is nonconforming, the Applicants contend
that the Locus is lawfully a separate lot of record, to be
considered as a valid, grandfathered building lot not merged with
the land to the west.

Accordingly, the Applicants request that a Special Permit be
issued under Nantucket Zoning By-law X139-33.A for the conversion
in use of the dimensionally nonconforming structure upon the
Locus from the presently nonconforming commercial garage and
storage use to a conforming use as a single-family dwelling,
based upon a finding that the proposed change in use wild not be
substantially more detrimental than the pre-existing
nonconformity, as well as a modification of the Variance issued
in File No. 008-76 to remove any requirement therein that the
structure be used for storage purposes and not to contain
plumbing. The Applicants further request that the Board of
Appeals determine that the Locus is to be considered as a
separate lot of record, or in the alternative to grant a Variance
from the minimum lot area requirement of 5,000 square feet under
By-law X139-16.A in order to ratify and confirm the status of the
Locus as a separate lot of record.
An application for a Variance for the expansion of the
structure was denied by the Board of Appeals on January 15, 1974,
in Case No. 002-74. The effect of the Variance issued in Case
No. 008-76 is discussed above.
Special Permit relief granted by the Board of Appeals in
Case No. 031-94 for the partial alteration in use of the
structure upon the Locus, the decision in which contained certain
inaccuracies and omissions, was never exercised and has now
lapsed.
