The Applicant (Bell Atlantic) seeks a modification of Special Permits issued in ZBA decisions in file nos. 071-90, 044-91, 054-98, and 107-98 and a Special Permit under Nantucket Zoning Bylaw §139-33A (alteration/expansion of apre-existing nonconforming structure/use). The Applicant proposes to replace an existing metal equipment building with a new one-story multi-tenant building that will house equipment used by tenants at the site for providing wireless communications. The applicant also proposes replacing its omnidirectional antennas on the tower with directional panel antennas. Additionally, antennas are proposed by Sprint, Telecorp, and Metrocall, along with previously approved antennas for Nextel and WGBH, and antennas to be installed for use by the Federal Bureau of Investigation. The applicant undertaking structural improvements to the tower including increasing the existing base foundation from 6' x 6' to 9' x 9'. The locus is nonconforming as to height limitations with the existing 220E-foot tower exceeding the 30-foot maximum height allowed; and as to use. The premises is located at 14 Eel Point Road, Assessor's Map 40, Parcel 64, Limited- Use-General-2. 2. This decision is based on the application and materials submitted with it and the testimony and evidence presented at the public hearing. The Planning Board made a favorable recommendation. There were no letters on file in support or opposition. 3. The Applicants represent that the existing 220 foot communications tower was constructed in 1966 prior to the 1972 enactment of the Zoning Bylaw. The tower also exceeds the maximum allowable height in the LUG-2 zoning district and communications towers are not a permitted use in said zoning district. Therefore, both the structure and use are validly grandfathered, pre-existing and nonconforming. The proposed antenna installations will not increase the nonconforming height of the existing tower nor have a visual impact upon the character of the surrounding neighborhood being placed at elevations at or above130 feet from the base of the tower. The Applicants represents that the low frequency radio emissions from the installation will be safe and submitted, as part of their application, a radio frequency report prepared by Donald L. Haes, Jr. MS, CHP, to that effect. All mechanical support and ancillary radio equipment will be housed in the newly constructed equipment structure which will be built in accordance with a valid permit issued by the Nantucket Historic District Commission. The tower and the new structure, located in the center of the 11.7 acre parcel, are surrounded by a 250 foot buffer of existing mature vegetation and the existing 12 foot wide unpaved road will continue to be used for access to the site. 4. Therefore the Zoning Board of Appeals finds that Bell Atlantic's proposed antenna installations for itself and its tenants are similar to recently approved licensed wire carrier installations in the area. Because the proposal consists of utilizing an existing tower with no discernible public health impact, the Board further finds that the proposed installations would not be substantially more detrimental to the surrounding neighborhood than the existing structure and use. There would be no additional noise or traffic generated at the site and the modification of the decisions issued in ZBA file nos. 071-90, 044-91, 054-98, and 107-98 would be in harmony with the general purpose and intent of the Bylaw. 5. Accordingly, by a unanimous vote, the Board grants the requested modification of the Special Permits issued in the decisions in ZBA file nos. 071-90, 044-91, 054-98, 107-98 and a Special Permit under Nantucket Zoning Bylaw §139-33A to mount telecommunications antennas between the 130 and 200 foot mark on the existing 220 foot telecommunications tower, and construct a new shingled one-story multi-tenant building that will house equipment used by the tenants at the site to replace the existing metal building, based on the following condition: The structure shall be constructed in substantial conformance with the Certificate of Appropriateness No. 3~ issued by the Historic District Commission. The premises include approximately 11.7 acres and comply with the intensity requirements of the current zoning code. Specifically, the applicants propose to replace an existing metal equipment building with a new shingled one-story multi-tenant building that will house equipment used by the tenants at the site to provide wireless communications services. Applicant Bell Atlantic Mobile proposes to replace its omnidirectional antennas on the tower with directional panel antennas that will allow it to provide better, more reliable analog and digital wireless services to its customers on Nantucket. Additional antennas are proposed by Sprint, Telecorp and Metrocall to serve their customers on Nantucket, along with previously approved antennas for Nextel and WGBH and antennas to be installed for use by the Federal Bureau of Investigation. Structural improvements will be undertaken on the tower to allow it to accommodate these antennas; the applicants will increase the existing base foundation of the tower from 6' x 6' to 9' by 9', add a new guy wire and a new anchor in each of the three sectors of the existing guy wires, and replace two existing guy wires in each sector. The purpose of these alterations is to consolidate existing and new equipment in one modern structure and to strengthen the tower in order to better accommodate the use of the tower by the existing and proposed carriers, all with the goal of improving the availability and reliability of communications on Nantucket. The facility is lawfully pre-existing as to use and structure height, and various alterations have been approved over the years by the Zoning Board of Appeals. The facility consists of a guyed tower rising approximately 213 feet above ground level and two equipment shelters. Cabling connects the antennas to the switching and power equipment in the shelter. The facility is enclosed within an eight foot high chain link fence which will BOST1-66R085-2 be extended as part of this application to encompass the proposed ne~v building. Standard electric and telephone utilities run to the project site from Eel Point Road. The plans included with this application show the intended location of the various carriers on the tower and the proposed new multi-carrier building. The impact and characteristics of the proposed upgrades and alterations are consistent with public health, safety, convenience and welfare and are not detrimental or offensive. The proposed alterations will generate no traffic or other negative impacts on surrounding properties or the Town of Nantucket. The facility requires no water or sewer services. The proposed facility will be unoccupied, with no employees or customers. The proposed alterations will not alter these conditions and will not be substantially more detrimental to the site or the surrounding neighborhood than the existing use. The alterations and upgrades will promote the welfare and safety of the people of Nantucket by allowing the carriers located at the site to provide better wireless communications services. For the foregoing reasons, and with full reservation of its rights under the existing special permits and otherwise, the applicants respectfully request the Zoning Board of Appeals to grant them a Special Permit in the names of all the applicants listed above and such additional relief, if any, as may be necessary to permit the alterations described in this application. The premises include approximately 11.7 acres and comply with the intensity requirements of the current zoning code. Specifically, the applicants propose to replace an existing metal equipment building with a new shingled one-story multi-tenant building that will house equipment used by the tenants at the site to provide wireless communications services. Applicant Bell Atlantic Mobile proposes to replace its omnidirectional antennas on the tower with directional panel antennas that will allow it to provide better, more reliable analog and digital wireless services to its customers on Nantucket. Additional antennas are proposed by Sprint, 'T'elecorp and Metrocall to serve their customers on Nantucket, along with previously approved antennas for Nextel and WGBH and antennas to be installed for use by the Federal Bureau of Investigation. Structural improvements will. be undertaken on the tower to allow it to accommodate these antennas; the applicants will increase the existing base foundation of the tower from 6' x 6' to ~' by 9', add a new guy wire and a new anchor in each of the three sectors of the existing guy wires, and replace two existing guy wires in each sector. The purpose of these alterations is to consolidate existing and new equipment in one modern structure and to strengthen the tower in order to better accommodate the use of the tower by the existing and proposed carriers, all with the goal of improving the availability and reliability of communications on Nantucket. "I'he facility is lawfully pre-existing as to use and structure height, and various alterations have been approved over the years by the Zoning Board of Appeals. The fzcility consists of a guyed tower rising approximately 213 feet above ground level and two equipment shelters. Cabling connects the antennas to the switching and power equipment in the shelter. The facility is enclosed within an eight foot high chain link fence which will l3C)ti'1'1-GGR085-2 be e~ctended as part of this application to encompass the proposed new building. Standard electric and telephone utilities run to the project site from Eel Point Road. The plans included with this application show the intended location of the various carriers on the tower and the proposed new multi-carrier building. The impact and characteristics of the proposed upgrades and alterations arc consistent with public health, safety, convenience and welfare and are not detrimental or offensive. "1'he proposed alterations will generate no traffic or other negative impacts on surrounding properties or the Town of Nantucket. The facility requires no water or sewer services. "I'he proposed facility will be unoccupied, with no employees or customers. "I'he proposed alterations will not alter these conditions and will not be substantially more detrimental to the site or the surrounding neighborhood than the existing use.
