At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 12:00 P.M., Friday, May 14, 1999, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of JEAN YOLISH, of 20 Mount Estate Drive, Avon, CT 06001,
Board of Appeals File No. 038-99, the Board made the following Decision:
1. Applicant is seeking a MODIFICATION of a SPECIAL PERMIT issued in
the Decision in BOA File No. 030-98 which allowed the vertical expansion
of a nonconforming single-family dwelling within the front yard setback
withoiut coming any closer to that lot line. Applicant seeks to modify
condition "b" as stated in paragraph "5" of said Decision as the plans
for the structure have changed and a different Certificate of
Appropriateness has been issued by the Historic District Commission that
would allow an increase in height of the proposed addition beyond the
permitted maximum allowed by this Board of 23+ feet within the front
yard setback area without coming any closer to that lot line. The Locus
is nonconforming as to lot size, with the Lot containing 19,945+ square
feet of area in a district that requires a minimum lot size of 20,000
square feet; and as to front yard setback, with the house sited 20.6+
feet at its closest point from the northerly lot line in a district that
requires a minimum front yard setback of 30 feet.
The Premises is located at 12 OSPREY WAY, Assessor's Map 82,
Parcel 44, Land Court Plan 37073-B, Lot 3. The property is zoned
Residential-2.
2. The Decision is based upon the Application and material submitted
with it and the testimony and evidence presented at the hearing. The
Planning Board made no recommendation as the matter was not of planning
concern. There were no letters on file and no opposition was expressed
at the hearing.
3. Applicant represented that the design of the proposed alteration
for her pre-existing nonconforming single-family dwelling was altered
substantially since the Special Permit was issued in the Decision in BOA
File No. 030-98, which limited the upward extension within the required
30-foot front yard setback area to 23+ feet. As in the previous
Application, the new design would not entail any further encroachment of
the footprint within that setback area but would require raising a small
portion of the roof height to 26+ feet at the highest .point within said
setback area to add a second floor addition as part of an overall
renovation of the structure. The house is sited at 24.7+ feet at its
closest point at its easternmost corner, and the stoop, leading to the
front door of the structure, is sited at 20.6+ feet at its closest point
from the front yard lot line. The structure is also sited at 33.3+ feet
at its closest point from the same lot line at its westernmost corner,
outside of the setback area.
4. Therefore, the Board finds that the upward expansion of the new
second floor would be an increase in the nonconforming nature of the
structure. However, said upward expansion to a maximum of 26+ feet
within the front yard setback area would not be substantially more
detrimental to the neighborhood than the existing nonconforming
structure and further finds that the expansion within said setback
would be de minimus in scope and have little impact upon the area as it
would not come any closer to the front yard lot line than the existing
structure. The Board also notes that condition "a" in paragraph 5 may
also be affected by any change in design of the house outside of the
front yard setback area and finds that said condition relates only to
that portion of the structure that lies within said front yard setback
area and not to that portion of the structure that lies outside of the
30-foot front yard setback area.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
MODIFICATION of the SPECIAL PERMIT issued in BOA File No. 030-98, to
allow a maximum roof height within the required 30-foot front yard
setback area of 26+ feet at its highest point upon the following
condition:
- There shall be no further encroachment into the 30-foot
required front yard setback area.

ADDENDUM
Applicant is seeking a modification to Special Permit #030-98 which was ganted under 139-33A to
alllow the vertical expansion of nonconforming single family residential structure. Said addition will add a
second story to a portion of the structure, a small portion of which addition will be located within the
required front yard setback.. The property is nonconforming as to lot size, containing 19,945 SF in a
district requiring 20,000 SF and as to front yard setback, with the house located at its closest point 24.7 feet
from the front lot line.
The Applicant seeks to modify paragaph 3, so as to permit a maximum height of 25' as reflected in ~IDC
Plans attached with this application.
