At a public hearing of the Nantucket Zoning Board of Appeals held at 1:00 p.m.,
Friday, May 14, 1999, in the Conference Room at the Town Building Annex, 37
Washington St., Nantucket, Massachusetts, the Board made the following decision on the
application for relief filed by RICHARD GALLAGHER APPEAL OF WAYNE AND
HARBAJAN SILTANEN BUILDING PERMIT, 721 Cedar Street, Walpole, MA 02081,
Zoning Board of Appeals file no. 037-99:
1 The applicant is APPEALING, under Nantucket Zoning Bylaw § 139-31, the
Building Commissioner's issuance of Building Permit No. 564-98, as amended 3/29/99,
to Wayne and Harbajan Siltanen, 7804 Manor House Drive, Fairfax Station, Virginia
22039. The applicant alleges that the Building Commissioner issued the amended permit
in error as the new single-family dwelling under construction on the locus violates
Nantucket Zoning Bylaw §§ 139-16A (intensity regulations -frontage and front yard
setback), 139-18 (parking requirements), and 139-20.1B(2)(e) (curb cut requirements).
Applicant further alleges that while the owners of the property have maintained in their
permit applications that Douglas Way is the legal frontage, Douglas Way provides less
than the minimum legally required frontage with no access or parking shown upon the
plan submitted to the Building Department on which the structure was based. In addition,
the permitted structure arguable would be sited within the required 35-foot front yard
setback. Applicant further requests that this Board make a finding that the front yard
setback is to be measured from the frontage from which access must also be made,
without variance relief having first been issued by this Board, as stated in § 139-
20.1 B(2)(e).
The premises is located at 5 Douglas Way (AKA Renown Road), Assessor's Map
39, Parcel 54, Plan File 48-0, Lot 3. The property is zoned Limited-Use-General-2.
2. The Board's decision is based upon the application and accompanying materials,
and representations and testimony received at the above referenced public hearing. The
Planning Board voted to withhold any recommendation to the Zoning Board of Appeals.
3. The applicant/appellant's position before the Board is that the Siltanens and the
Building Commissioner are interpreting the bylaw in a manner that circumvents the
frontage requirement. The lot in question was part of a subdivision approved by the
nantucket Planning Board as an ANR subdivision on March 25, 1996, that utilized
frontage averaging to create a buildable lot with 88.20 feet of frontage on Eel Point Road,
and specified Eel Point Road as the frontage for such purposes. Thus, under the
subdivision control law, the frontage chosen by the party originally subdividing the lot
was Eel Point Road. The Siltanens began construction of a dwelling on the lot, pursuant
to a permit (number 564-98) issued by the Building Commissioner, which uses Renown
Road as the address of the subject property but claims legal frontage from Eel Point Road
for the setback requirements imposed by the zoning bylaw in section 139-16A. This
section requires a 35-foot front yard setback as well as 15-foot side and rear yard
setbacks. From the plans they submitted to the Building Department, the Siltanen's
dwelling appears to be situated several hundred feet from Eel Point Road, the front lot
line for setback purposes, and 17.7 feet from Douglas Way, which would be the rear lot
line. Thus, by designating Eel Point Road as the frontage, the building complies with
setback requirements. In March of 1999, the Siltanens submitted a request to amend the
building permit in which they specified 5 Douglas Way as their address, showing no
access to the property at all, as would be required by the bylaw. But, if Douglas Way
were considered the frontage, as the Siltantens now propose for purposes of their
driveway and curb cut, the dwelling would illegally lie inside the 35-foot front yard
setback off of Douglas Way. The applicant/appellant argues that what the Siltanen's
essentially have done, is designate two different frontages (or three), one from Eel Pont
Road and one from Douglas Way, permitting them to ignore the overall intent of the
bylaw and build a dwelling that violates either the intensity/setback elements of the
bylaw contained in § 139-16A, or the curb cut element of the bylaw contained within
§ 139-20.1B(2)(e). The applicant notes that the Siltanens have never amended their
subdivision plan to allow frontage to be considered from Douglas Way. Thus their legal
frontage remains Eel Point Road. The curb cut bylaw, §139-20.1B(e) requires that
driveways shall derive legal access solely from the legal street frontage of the lot, unless
otherwise permitted herein.
Beyond that, the applicants raise safety and traffic concerns about bringing the
driveway off of the private Douglas Way. They note that the road serves a limited
number of homes and that adding another, the Siltanens, who have the means of
accessing the more trafficked Eel Point Road, places an unnecessary burden on the lesser
developed, private, Douglas Way, as well as the adjoining neighborhood. They further
note that as an unimproved way, under the definitions of both frontage and street,
contained within the definitions section of the bylaw, Douglas Road may not provide
legal frontage for the Siltanen's lot.
4. The position advanced by the Siltanen's in defense of their permit, is that the
bylaw regulating curb cuts explicitly provides: "Driveways servicing a building or use
shall derive legal access based on the owner-designated frontage on the street." §139-
20.1B(2)(e). The Siltanen's maintain that this clearly permits them to choose the street
from which their driveway enters their property. If the bylaw required that the driveway
come from some frontage already established, either by the zoning bylaw in general, or
the Planning Board in the course of endorsing an ANR subdivision, it would not specify
that the owner may designate the frontage.
5. Upon consideration of the testimony and exhibits presented in the application and
at the hearing, the Board concluded that although the bylaw permits an owner to
designate the frontage for a curb cut and driveway, the Siltanen's already made this
designation when they chose Eel Point Road for purposes of front yard and rear yard
setbacks. Having built their house within what would have been the front yard setback
from Douglas Way, had Douglas Way been the frontage, the Siltanen's may not now
change their designation and choose Douglas Way as their frontage for purposes of the
curb cut law. Although the bylaw permits them to pick their frontage, it does not permit
them to keep switching it back and forth for whatever advantage doing so serves at the
moment. The Board has consistently held that front yard setback must be maintained
from the stated frontage.
Any amendments to the building permit must maintain Eel Point Road as the
frontage, in conformity with the choice made earlier by the Siltanens in siting their
dwelling. And according to the Zoning Bylaw, §139-20.1B(2)(e), driveway access must
be from the legal frontage, Eel Point Road absent any relief from this Board or the
Planning Board. The amended Building Permit thus was issued in error, and no driveway
access or parking was shown as required by the bylaw. Accordingly, upon a motion
made by Mr. Murphy to overturn the Building Inspectors amendment to the building
permit designating Douglas Way as the frontage, a motion seconded by Mr. Toole, the
Board voted unanimously to approve the motion. The APPEAL is GRANTED and the
amended building permit designating Douglas Way as the frontage is hereby void.
