Tn the 1999 Board of Appeals Decision No. 005-96, the BUARD unanimously granted to the npplieant a MUDIFTCA"fIUN TO VARTANC:L No. 065-86 which perrniued the Applicant to construct asecond-st~~ry addition to her dwrlting without any change in gre~und cover, subject to certain conditions. Since that time, the Applicant has failed to construct the second -story addition attd the rc~ning relief granted by this BOART) tv the Applicant in 199ti has lapsed pursuant to Section 139-32I of the By-law, which provides, in pertinent part, that a Variance "... not exercised within cme year of the date of the grant shall lapse." No significant change in circumstances has affected the Applicant's property since 1996 and there was n~ opposition to this Application. Otis-86, this Board made the necessary statut~~ry findings supporting a grant c)f Variance relief. Specifically, the Beard found that the shape of the lot anti the siting of the building nn the lot were unidue and variance relief cuulc3 be granted without substantial detriment to the puhlic good. Further, the Board found that separate ownership of the Property would result in ".. _ the more conforniing single eiwelluig unit per lert." At the initial hearing, the Aoard and one abutter raised concerns about the proposed maximum roc-f ridge height for the addition and the Applicant has modified and lowered the roof. The Applicant suggested revisions to dtc plan to accotnriiifdate the concerns of direct abutters. "ihe proposed addition will nc)t significantly increase the intensity of use cif the Property atul will provide necessary living space for the Applicants growing family. This Decision isibased upon the Application and materials submitted with it., prior BOARD decisions affecting the Property, and the testimony and evidence submitted at the hearing. There was no Planning Board recommendation. There were two (2) letters in favor an~ three (3) letter opposed on Pile. An abutter opposing the relief; was represented by counsel at the hearing. j 3. By way of backgYO}~nd, this Board granted the 1-pplicant's predecessor in title in VARIANC£ (No. 65-86) to cure a technical defect in the ra~rketability of the title to the Property (i.e., merger) which arose from the division of one (1) parcel into three (3) undersized lots after the enactiaent of the' Nantucket Zoning Sy Law in 972. Each of the three (3)lvts included a pre-existing cot age. The subject Property is one such Lot (Let 2). In its 1986 VARIANCE decision, this Hoard imposed a condition on the Property w~ich provided, in pertinent part, that: a... any expansion or extension ... of the existing •~ structures by an increase i~ height ar ground cover require (sic): relief from the Board of Ap eels." On April 10, 1990, this Board modified VARIANCE No. 65-86~with respect tv the Property by perJaitting a first floor ad itian. The Applicant seeks a further Modification of VARIANCE No 65-86 to construct a second story addition with two (2) bedro ms and a bathroom without any increase in ground cover. j ~. In its 1986 VARI~,NCE Decision No. 65-86, this BOARD iaade the necessary statutv~y findings supporting a grant of Variance relief. Accordingly, by a unanimous vote, the BOARD grants the Applicant tha requested MOQIFICATION TO VARIANCE NO. 65-86, subject to the following conditions: (1) The second story addition shall be constructed substantially in accordanCd with the Plans prepared by the Nantucket Architecture Grct]~ for Mr. and Mrs. Jaxtimer dated November 9, 1995, revised February 22, 1996, and on file at the Nantucket Board of Appeals. . JAXTIMER, TRUSTEE of TOM NEVERS REALTY TRUST (18-90) of 48 Rosary Lane, Hyannis, Massachusetts 02601. 1. Applicant seeks a modification of VARIANCE N0. 65-86 so as to allow him to increase the ground cover of the existing single-family cottage on the premises in accordance with the plan entitled "Proposed Addition for E.J. Jaxtimer" for Willard Street, Natucket, MA, dated March 15, 1990. The premises are located at 22 WILLARD STREET, ASSESSOR'S PARCEL 29-79, Lot 2, Plan Book 2, Page 23 at the Nantucket Registry of Deeds and zoned 1~ESIDENTIAL-l. 2. Our findings are based upon the Application papers, correspondence, plans, representations and testimony received at our hearings on March 9, 1990 and March 30, 1990. We find that the BOARD issued a Variance for the subject premises on July 21, 1986 (65-86) which included the express condition that any expansions or extension of the existing structure by an increase in height or ground cover require(s) relief from the Board of Appeals. The Applicant's lot contains approximately 2,182 Page One square feet and the cottage on the lot has existing ground cover of 510 square feet. Allowable ground cover for the Lot is 654 square feet. The Applicant has submitted a one (1) page plan dated March 15, 1990 which shows a proposed first-floor bedroom addition to the cottage of 140 square feet, together with a proposed first floor, 204 square foot deck and chimney with a base of 12.5 square feet. We note that "decks" are excluded from the definition of "Ground Cover" set forth in Section 139-2 of the By-Law. The proposed addition to the cottage includes an aggregate increase in ground cover of 152.5 square feet for a total ground cover of 662.5 square feet. An abutter to the premises expressed concern about construction of the addition during the summer season and the Applicant has agreed to limit any exterior construction to the period between September 15 and June 15. 3. We find further that the Applicant's proposed addition to the cottage will be in harmony with the intent and purpose of the By-Law and constitutes a reasonable modification of the terms of the prior Variancer,.(65-86) on the express conditions that the proposed~additi~ to the cottage be constructed in substantial accordance with the March 15, 1990 one (1) page Plan submitted by the Applicant and that all exterior construction of the proposed addition occur between September 15 and June 15 of any calendar year.
