At a Public Hearing of the NANTUCKET ZONING BOARD OF
APPEALS held at 1:00 p. m. , FRIDAY, APRIL 9, 1999, in the Conference
Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts,
on the Application of JOSEPH M. FIELD, of 115 East Princeton Road, Bala
Cynwyd, Pennsylvania 19004, Board of Appeals No. 032-99, the Board made
the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning By-Law Section 139-33A(4)(a) and (b) (alteration/expansion of a pre-
existing, nonconforming structure/use). Applicant proposes to convert a garage
into agarage-studio without expanding the footprint. A shed dormer would be
added on the northerly roof plain with the easternmost end of the dormer
encroaching on the easterly side yard setback area by approximately 2 + /- feet
without coming any closer to that lot line than the existing structure. The Lot is
also improved with a two-story single-family dwelling. The Locus is
nonconforming as to lot area with the Lot containing a lot area of 4,023 +/-
square feet in a district that requires a minimum lot size of 5,000 square feet; as
to ground cover ration with the Lot containing a ground cover ratio of 37.8 +/-%
in a district that allows a maximum ground cover ratio of 30% for undersized
lots; and as to setbacks with the dwelling being sited 1.7 +/- feet at its closest
point from the westerly side yard lot line, and the garage being sited 0.6 +/- feet
at its closest point from the easterly side yard lot line and 1.0 +/- feet at its
closest point from the rear yard lot line in a district that requires a minimum side
and rear yard setback of five (5) feet.
The Premises is located at 28 MILK STREET, Assessor's Map 55.4.4,
Parcel 4, Plan Book 13, Page 3. The property is zoned Residential-Old-Historic.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the Hearing. The
Planning Board made no recommendation, however, did request a site plan from
the Applicant which was timely supplied. There was one letter on file from an
abutter citing no objection to the project as proposed.
3. Applicant, through counsel, represented that he is seeking relief to
convert apre-existing, nonconforming garage/storage structure located behind his
single-family dwelling at 28 Milk Street into agarage-studio, with no change in
ground cover. Applicant stated that the first floor of the studio will be used as
a sitting area with a bathroom and that the second floor will contain an upstairs
office and storage loft. All of these proposed uses are permissible ancillary uses
to the single-family dwelling on the Premises. Applicant represented that he
wished to construct a shed dormer in the northerly roof plain of the subject
structure. Applicant represented that, although the shed dormer is proposed to be
built within the required five (5) foot setback, it would be constructed in a manner
that brought it no closer to the sterly lot line than the roof of the pre-existing,
nonconforming garage. Applicant further represented that Certificate of
Appropriateness No. 30,763 had been issued for the alteration by the Nantucket
Historic District Commission.
4. THEREFORE, the Board finds that the conversion of the garage
into agarage-studio without expanding the footprint will not be substantially more
detrimental to the neighborhood than the pre-existing nonconforming garage.
Additionally, the Board finds that although the construction of the shed dormer
as proposed will increase the setback nonconformity by increasing the massing
within the side yard setback, this increase will not be substantially more
detrimental to the neighborhood than the existing setback nonconformity.
5. Accordingly, by an unanimous vote, the Board GRANTS the
requested SPECIAL PERMIT under Nantucket Zoning By-Law 139-33A(4)(a) and
(b) to convert the garage into agarage-studio and to add a shed dormer on the
northerly roof plain with the easternmost end of the dormer encroaching on the
easterly side yard setback area by approximately 2 +/- feet without coming any
closer to that lot line than the existing structure, upon the following conditions:
(a). The garage-studio shall not be used for human habitation;
(b). The alteration/expansion as proposed will come no closer
to the property lines than the pre-existing nonconforming structure; and
(c). The alteration/expansion shall be in substantial conformity
with Certificate of Appropriateness No. 30,763 issued by the Historic District
Commission

ADDENDUM
The Applicant, Joseph M. Fields, seeks a SPECIAL PERMIT pursuant to
Section 139-33(4)(a) and (b) of the Nantucket Zoning By-Law (the "By-Law") and
Massachusetts General Laws, Chapter 40A, Section 6. The Applicant is
requesting the SPECIAL PERMIT to convert a garage to agarage-studio. The
structure is located at 28 Milk Street (the "Premises"). The Premises is located
in the residential Old Historic District. The Premises consists of a lot of land
approximately 4,023 +/- square feet in size as improved by a two-story single
family dwelling and garage/storage structure. The lot of land is non-conforming
as to lot size being situated in a Zoning District with a minimum lot size of 5,000
square feet. The two-story single family dwelling is non-conforming as to side
yard setback, being 1.7+/- feet at its closest point from the western property line
in a Zoning District with a minimum side yard setback requirement of five (5)
feet. The garage is non-conforming as to side yard setback being 0.6+/- feet at
its closest point from the easternmost property line and non-conforming as to rear
setback being 1.0+/- feet from the ?property line in a Zoning District with a
minimum rear and side yard setback requirement of five (5) feet. The Premises
is non-conforming as to ground cover ratio having a ground cover of
approximately 37.8+/- % in a Zoning District that allows 30% ground cover for
lots containing less than 5,000 square feet. The Premises is conforming as to
parking, providing parking on premise for one car.
The Applicant proposes to convert the existing garage/storage structure to
agarage-studio, however without changing the ground cover of the structure.
Applicant proposes to add a shed dormer to the northern roof of the structure over
and in line with the garage doors. The easternmost end of the shed dormer would
encroach the eastern side yard setback by approximately 2+/- feet. The proposed
dormer does not increase the non-conformity of the setback encroachment as it is
less non-conforming as to setback requirements (see the plan attached as Exhibit
"A") than the existing structure.
The proposed conversion of the garage to agarage-studio does not increase
the non-conforming nature of the structure.
The proposed new dormer is a minor renovation to the structure, is
consistent with the historic nature of the structure and surrounding dwellings, and
as a result, is not more substantially detrimental to the neighborhood. The
proposed conversion from a garage to agarage-studio is not more substantially
detrimental than the existing use of anon-conforming structure and by granting
the SPECIAL PERMIT the Board would be acting in a manner consistent with the
spirit and intent of Section 139-33A of the By-Law.
The Applicant respectfully requests that the Board vote in favor of the
requested SPECIAL PERMIT.
