At a Public Hearing of the Nantucket Zoning Board of Appeals, held
at 1:00 P.M., Friday, April 9, 1999, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of THORNE C. DELANEY, FOR HIMSELF AS OWNER AND FOR BRIAN
DONOVAN, CONTRACT PURCHASER, of 5 Pearl Street, Summit, NJ 07901 and 18
Russell Park, Quincy MA 02169, respectively, Board of Appeals File No.
031-99, the Board made the following Decision:
1. Applicant (Donovan) is seeking relief by VARIANCE under Nantucket
Zoning Bylaw §139-16A (Intensity Regulations -ground cover, setbacks).
Applicant proposes to demolish an existing 466+ square-foot
single-family dwelling and replace it .with a new 466+ square-foot
single-family dwelling on approximately the same footprint. The Locus is
nonconforming as to lot size with the Lot having a lot area of 1,284+
square feet in a district that requires a minimum lot size of 5,000
square feet; as to frontage with the-Lot having 17+ feet of frontage
along Warren Street in a district that requires a minimum frontage of 50
feet; as to ground cover ratio with the Lot containing 36+% ground cover
ratio in a district that requires a maximum ground cover of 30% for
undersized lots in this district; and as to setbacks with the Lot being
sited 0.1+ feet at its closest point from the easterly side yard lot line
in a district that requires a minimum side yard setback of five (5) feet.

The Premises is located at 11 WARREN STREET, Assessor's Map
55.4.1, Parcel 40.1, .Plan Book 22, Page 72, Lot 2. The property is zoned
Residential-1.
2. The Decision is based upon the Application and materials submitted
with it and the testimony and evidence presented at the hearing. The
Planning Board made a favorable recommendation provided the new structure
be placed no closer to the easterly side yard lot line than three (3)
feet at its closest point. There were no letters on file. At the hearing
abutters present expressed concern regarding disturbance on their
property during construction.
3. Applicant proposes to demolish a dilapidated single-family
structure and construct a new home in substantially the same location on
the Lot. The new structure would meet current Building Code standards and
Nantucket Historic District Commission guidelines. Applicant, through
counsel, represented that the structure pre-dated the enactment of the
Zoning Bylaw in August of 1972, as the structure was constructed in its
present location in 1940 and is thus validly grandfathered. As the
structure will be demolished rather than renovated it is necessary to
receive relief by Variance as opposed to Special Permit relief in order
to reconstruct the dwelling within the setback and at its present ground
cover ratio which at the time exceeded the allowable ground cover ratio
of 30%. Applicant does not propose to incr-ease the ground cover ratio
beyond the present 36+% and will come no closer to the easterly side yard
lot line than the current 0.1+ feet at its closest point with the new
structure being sited no closer than three (3) feet from the easterly,
westerly and southwesterly side yard lot lines at its closest points and
no closer to the rear yard lot line than it is presently configured. The
ridge height will increase from 13+ feet to 16+ feet and remain a single
story structure. The required parking space will continue to be provided
on site. The Premises is benefited by a previously granted Variance in
the Decision in BOA File No. 075-85 which validated the separate
buildability and marketability of the subject Locus from an adjacent
parcel.
4. Therefore, the Board finds that the grant of relief by Variance
can be supported by the facts and would be beneficial to the neighborhood
with the demolition of the dilapidated structure and reconstruction of
the single-family dwelling with the new structure meeting current Building
Code requirements and increasing the easterly side yard setback distance.
The Board further finds that owing to circumstances relating to the
irregular shape of the Lot and the small size of the Lot, 1,284+ square
feet, and topography of the structure located on the site, and especially
affecting such land or structures but not affecting generally the zoning
district in which it is located, a literal enforcement of the provisions
of this Zoning Bylaw would involve substantial hardship, financial or
otherwise, to the Applicant, and the desirable relief may be granted
without substantial detriment to the public good and without nullifying
or substantially derogating from the intent or purpose of such Bylaw.
5. Accordingly, based upon the foregoing, the Board voted
unanimously, to GRANT the requested relief by VARIANCE under Nantucket
Zoning Bylaw §139-16A to allow the demolition of the existing
single-family dwelling and reconstruction of a new single-family dwelling
upon the following conditions:
a. The new structure shall be sited no closer to the easterly,
westerly or southwesterly side yard lot lines than three (3) feet; and
b. The new structure shall have a maximum ground cover of 466±
square feet.

Addendum to the Application of Brian Donovan
The Applicant is the contract purchaser of a 1,284
square foot lot located at 11 Warren Street on which is
situated a single-family residence with ground cover of
approximately 466 square feet (for existing conditions, see
Building Location Plan dated March 2, 1999, prepared by
Charles W. Hart & Assoc., Inc., enclosed herewith). The
structure pre-dates zoning and is non-conforming as to
setback on the easterly side of the property.
The Applicant requests permission to demolish the
existing structure and to construct a new 466 square foot
single-family dwelling on the premises. Applicant requests
a Variance be issued to allow the new structure to intrude
into the setback along both sides of the property. The
size of the lot and the condition of the existing structure
are evidence that variance relief is appropriate.

Addendum to the Application of Brian Donovan
The Applicant is the contract purchaser of a 1,284
square foot lot located at 11 Warren Street on which is
situated a single-family residence with ground cover of
approximately 466 square feet (for existing conditions, see
Building Location Plan dated March 2, 1999, prepared by
Charles W. Hart & Assoc., Inc., enclosed herewith). The
structure pre-dates zoning and is non-conforming as to
setback on the easterly side of the property.
The Applicant requests permission to demolish the
existing structure and to construct a new 466 square foot
single-family dwelling on the premises. Applicant requests
a Variance be issued to allow the new structure to intrude
into the setback along both sides of the property. The
size of the lot and the condition of the existing structure
are evidence that variance relief is appropriate.
