1. The plaintiffs are residents and property owners in the Town of Nantucket
whose homes and other real property are located in close proximity to the proposed site
of the Nantucket Lightship Basket Museum (hereinafter "the museum")
2. The defendants are the members of the Board of Appeal of the Town of
Nantucket.
3. On or about January 4, 1999, the Nantucket Lightship Basket Museum, Inc., a
Massachusetts charitable corporation (hereinafter "the corporation"), applied to the
Building Inspector of the Town of Nantucket for a building permit to enlarge and convert
a one-family house located at 49 Union Street in the Town of Nantucket (hereinafter "the
premises") for use as a museum for the display of Nantucket Lightship baskets, together
with an ancillary shop, storage and lecture rooms. The premises are located within a
Residential Old Historic Zone.
4. On or about January 29, 1999, the Building Inspector issued a building permit
to the corporation for the enlargement and conversion of the premises for use as a
museum, together with the ancillary uses recited above.
5. The issuance of the building permit to the corporation by the Building
Inspector was improper and unlawful under the zoning by-law of the Town of Nantucket
and under Chapter 40A of the General Laws for the following reasons:
a. The museum, as intended and designed by the corporation, is not an
educational use within the meaning of §3 of said Chapter 40A. It is a
commercial use which is not permitted in the Residential Old Historic Zone.
b. The plan for the premises calls for five parking spaces. This is wholly
inadequate under the standards set forth in the zoning by-law of the Town of
Nantucket.
c. The proposed enlargement and conversion contains no provision for
off-street loading as required by the zoning by-law.
d. The proposed enlargement and conversion has not been subjected to
site plan review as required by the zoning by-law.

6. On or about February 24, 1999, the plaintiffs filed an appeal with the
defendant Boazd of Appeal of the Town of Nantucket from the action of the Building
Inspector in granting the building permit.
7. A public hearing was held before the Boazd of Appeal on the plaintiffs' appeal
on Apri19, 1999. On June 9, 1999, the defendant Board of Appeal rendered a decision in
the plaintiffs' appeal. A copy of that decision is attached hereto and mazked "Exhibit A."
8. Three members of the five-member Boazd of Appeal voted in favor of the
plaintiffs' appeal and to reverse the grant of the building permit. Two members voted
against. Under the provisions of § 15 of Chapter 40A, four votes on afive-member boazd
aze required to reverse the action of the Building Inspector. The plaintiffs' appeal was
therefore denied.
9. The decision of the defendant members of the Board of Appeal denying the
plaintiffs' appeal exceeds the authority of the Board, is azbitrary and capricious and in
violation of the zoning by-law of the Town of Nantucket and of the state-wide zoning
enabling act, Chapter 40A of the General Laws.
WHERFORE, the plaintiffs pray:
That the decision of the defendant Boazd of Appeal of the Town of Nantucket
be annulled, and that the plaintiffs' original appeal be granted.
2. That the action of the Building Inspector granting a building permit for the
premises located at 49 Union Street in the Town of Nantucket to the Nantucket Lightship
Basket Museum, Inc., be annulled and the said building permit be canceled.
3. That plaintiffs be awazded their costs of suit.

4. For such other and further relief as to the Court seems meet and just.

1. The applicants are APPEALING under Nantucket Zoning Bylaw §139-31, the
Building Commissioner's issuance of Building Permit No. 75-99 to the Nantucket
Lightship Basket Museum, Inc. (henceforth, the "Museum"), P.O. Box 308, Nantucket,
Massachusetts, 02554, permitting it to construct an addition onto asingle-family dwelling
located at 49 Union Street, Nantucket, Massachusetts 02554, and to change the use of the
structure to a basket museum with ancillary commercial shop space, storage, aad a five-
space parking Iat, The locus is zoned Residential Old Historic. The applicarns allege
that, aRer conversion, the property will not comply with parking and loading lone
requirements and that the use is not allowed under the Nantucket Zoning Bylaw in a
residential district.
2. The Board's decision is based upon the application and accompanying materials,
and representations and testimony received at the above referenced public hearing. The
Planning Board recommended that the Zoning Board of Appeals overturn the issuance of
the building permit and require the Museum to apply for parking relief and go through
the site plan review process, including a change in the direction of the one-way Handovet
Street in the process.

3. Through counsel, the applicants allege that the proposod museum will be a
museum in name and corporate purpose only, that the sales of modem lightship baskets,
the exhibition of newly made baskets by select local basket makers, and the conducting

of lightship basket making classes and lccntres itt fact cottstitalte a commercial use rather
tfian an educational use as contemplated by state statute. 'Therefore, the applicants argue.
the Museum is not exempt through MGL, chapter 40A, section 3 (known as the Dover
amendment, the statute prohibits local zoning bylaws from regulating or restricting "the
use of land or structwes .. _ for educational purposes on laad owned or lea9ed by ... a
nonprofit educational corporation ...."), from Nantucket Zoning Bylaw §§139-6 through
139-8, which prohibits, inter altq commercial uses within the ROH zoning district.
Furthermore, the applicants maintain, nven were the use exempt from zoning regulations
by way of the Dover amendment. the amendment specifically does nvt exempt land or
strucxures from "reasonable regulations concerning the bulk and height of structures and
determining yard sizes, lot area, setbacks, open space, parking and building coverage
requirements." The applicants argue that the five parking spaces proposed by the
museum will be woefully inadequate for the proposed use. They further allege that, due
to the intensity of the traffic at the Frances Street-Orange Street and Fast Dover Street-
Handover Stteat corners, the planned curb an fns tote parking arcs is contrary to sound
traffic sad safety considerations. The applicants contend that, pursuant to Nantucket
Zoning Bylaw § 139-23, the Museum is subject to Site Plan Review, including the review
of parking, driveways, sidewalks, screening, fences and buffers, outdoor Lighting, at:d
landscaping, etc. required by §§139-23F(q) and {r).
4. Through counsel, the Museum submitted documentary evidence that it was a
nonprofit educational institution, including an affidavit by Valerie D'Ambrosio, the
treasurer of the Nantucket Lighuhip Basket Museum, Inc., the articles of incorporation,
and an advance ruling Letter from the IRS provisionally recognizing the Museum as a
501(c~3) tax exempt organization. The Museutu contends that because it is a nonprofit
educational institution proposing an educational use at the site, the proposed addition and
Change in use is exempt from any regulation under the local zoning bylaw. Through the
above referenced al~idavit, and argument by counsel, the Musaam maintains that it will
exhibit both antique and contemporary baskets as well as displays related to "the
evolution of the great folk art crag of lightship basket making-" Affidavit, ¶4. The
museum will contain "a fully operations! basket maker's workshop and an ongoing
demonstration of the assembly of a basket," and "will sponsor lectures on basket making
and will provide books and literature on this American craft." Affidavit, ¶5. According
to the Museum, this constitutes an educational use as contemplated by the Dover
Amendment. The Museum contends that the basket exhibits will not be for sale, and that
the proposed retail shop will be incidental to the proposed educational purpose,
constituting approximately 50 square feet and selling items such as books and note cards,
rather than baskeu. Despite the faze that both the affidavit and an advertisement which
the Museum ran in the Nantucket Inquirer & Mirror newspaper (submitted at the hearing
by an opponent of the Museum) state that it will sponsor or feature lectures, the Museum
maintains, through counsel, that it will conduct no lectures 8< the site. The Museum
further contends that the fivt proposed parking spaces arc adequate because thry
anticipate patrons of the Museum will walk to the site or use public transportation.
S. The Board heard from a number of abutters w the ptvposed museum who
tbcussed their comments primarily on the traffic an4 safety concerns created by the

insertion of a popular tourist destination into an extremely busy intersection. Several
abutters commented on the traffic presently coming out of Bast Do•~er Street, and how
that trafl:ic rarely stops at the stop sign located at the intersection with Haadovet Street.
Due to the present one-way configuraLiOt1 of the surrounding streets, if the parking lot at
the Museum artre full, a car would [se required to drive alI the way up Weymouth Street
to Orange Street, and then al I the way back down East Dover 5trcet to come around again
to Look for parking. The Board heard that the shortage of any packing in the
neighborhood may lead Museum Patrons to park illegally on the surrounding streets, or in
the parking area presently owned by Cranberry Cove restaurant. The Board also heard
concerns that pedestrian traffic will be forced m cxoss the Frances Street-Orange Sued
intersoctioq presenting a hazard to the pedestrians, as well as to the mopeds, cars and
bicycles already trying to negotiate the busy comer.
6. Upon consideration of the testimony and exhibits presented in the applicat"wn and
at the hearing, three Boardinembers (WAITTE; ~VILL.IAMS, and TOOLS) concluded that
the use did not qualify as an educational use under the terms of the Dover amendment,
and that accordingly the proposed I~iuseum was subject to the Nantucket Zoning Bylaw
which prohibits, among other things, commercial uses in the ROH zoning district. Two
Board members (PARENT and MURPHI~ concluded that the proposed rise did
constitute an cducatior~al use and was thereby exempt 5rom any regulation by the local
Zoning bylaw.
7. Upon a motion made and duly seconded to grant the appeal and overturn the
issuance of the building permit to the Lightship Basket Museum, three Board members
voted in favor (WAIl~IE, WILLLAMS, and TOOLS) and two voted against (PARENT and
MLTRPH~. Accordingly, requiring fow vote: in favor to grant the appeal, the mottos
fails, and the appeal is DENl£D.

1 write sEparately in order to address several matters excluded from the decision
of the Board. First, I feel the evidence supports a conclusion that the use of this property
proposed by the 1~4useum will be more akin to a basket showroom than to a ba9kct
museum. Under MGL, chapter 40A, section 3, cuing a use a "museum" does not entitle
a use to the educational exemption, unless the use itself is principally educational. Y do
not think this "museum" reaches this threshold. Having an exhibit, or evert teaching
classes in what is otherwise commercial space does not convert the use from commercial
to educational. Given that the Museum proposes ro exhibit contemporary baskets made
by cornemporary basket makers in amongst a sekdion of older baskets, it appears that
the real purpose will be to steer prospective purchasers of baskets toward those
contemporary basketmakers wfio exhibit in the museum. irf'we consider the same
arrangement in terms of automobiles rather than baskets, then I envision an automobile
showroom containing automobiles, both eortumpoeary and antique, where neither the
antique automobiles race the ~ntcsmta~ ones actually in the display area are for sale,
but where any interested party may purchase an identical contemporary automobile at the
sales office down the street. Evora if such an automobile shwvroom were labeled a
museum, and even if people were in fact inerested in looking at the antique automobiles,
the use still would be primarily commercial rather than educational, I believe the
evidence supports the same conclusion with regard to this basket musurm.
t note further that the Board never reached .the issue of whether the Museum was
subject to Site Ptah Review under Nantucket Zoning Bylaw X139-23, or other reasonable
parking, driveway, and loading zone restrictions. MGI.., chapter 40A, section 3 e~cplicitly
recogni2es that land or swdures exempt from use restrictions still must comply with
"reasonable regulations concerning ... parking ... requirements." Case law supports
application of parking restrictions and loading zone requirctncnts to educational uses.
See, for example, Trustees of Tufts College v. City of Medford, 616 N.E.2d 433.415
Mass_ 753 (Mass. 1993). I believe the evidence supports a conclusion that however one
characterises this use, educational or commercial, the intensity of the traffic will increase
requiring the careful attention to parking, driveway, and loading none restrictions and
Site Plan Review, as provided for by the bylaw, as well as due consideration to the
Planning Board's concern about the one way street layout in the neighborhood. I
disagree with the outcome of this case and the votes cast by the two Board members
against the appeal.

I write separately in order to address several matters excluded from the decision
of the Board. First, I feel the evidence supports a conclusion that the use of this property
proposed by the Museum will be more akin to a basket showroom than to a basket
museum. Under MGL, chapter 40A, section 3, calling a use a "museum" does not entitle
a use to the educational exemption, unless the use itself is principally educational. I do
not think this "museum" reaches this threshold. Having an exhibit, or even teaching
classes in what is otherwise commercial space does not convert the use from commercial
to educational. Given that the Museum proposes to exhibit contemporary baskets made
by contemporary basket makers in amongst a selection of older baskets, it appears that
the real purpose will be to steer prospective purchasers of baskets toward those
contemporary basketmakers who exhibit in the museum. If we consider the same
arrangement in terms of automobiles rather than baskets, then I envision an automobile
showroom containing automobiles, both contemporary and antique, where neither the
antique automobiles nor the contemporary ones actually in the displace are for sale,
but where any interested party may purchase an identical contemporary automobile at the
sales office down the street. Even if such an automobile showroom were labeled a
museum, and even if people were in fact interested in looking at the antique automobiles,
the use still would be primarily commercial rather than educational. I believe the
evidence supports the same conclusion with regard to this basket museum.
I note further that the Board never reached the issue of whether the Museum was
subject to Site Plan Review under Nantucket Zoning Bylaw § 139-23, or other reasonable
parking, driveway, and loading zone restrictions. MGL, chapter 40A, section 3 explicitly
recognizes that land or structures exempt from use restrictions still must comply with
"reasonable regulations concerning ... parking ... requirements." Case law supports
application of parking restrictions and loading zone requirements to educational uses.
See, for example, Trustees of Tufts College v. City of Medford, 616 N.E.2d 433, 415
Mass. 753 (Mass. 1993). I believe the evidence supports a conclusion that however one
characterizes this use, educational or commercial, the intensity of the traffic will increase
requiring the careful attention to parking, driveway, and loading zone restrictions and
Site Plan Review, as provided for by the bylaw, as well as due consideration to the
Planning Board's concern about the one way street layout in the neighborhood. I
disagree with the outcome of this case and the votes cast by the two Board members
against the appeal.

insertion of a popular tourist destination into an extremely busy intersection. Several
abutters commented on the traffic presently coming out of East Dover Street, and how
that traffic rarely stops at the stop sign located at the intersection with Handover Street.
Due to the present one-way configuration of the surrounding streets, if the parking lot at
the Museum were full, a car would be required to drive all the way up Weymouth Street
to Orange Street, and then all the way back down East Dover Street to come around again
to look for parking. The Board heard that the shortage of any parking in the

neighborhood may lead Museum patrons to park illegally on the surrounding streets, or in
the parking area presently owned by Cranberry Cove restaurant. The Board also heard
concerns that pedestrian traffic will be forced to cross the Frances Street-Orange Street
intersection, presenting a hazard to the pedestrians, as well as to the mopeds, cars and
bicycles already trying to negotiate the busy corner.
6. Upon consideration of the testimony and exhibits presented in the application and
at the hearing, three Board members (W~LIAMS, and TOOLS) concluded that
the use did not qualify as an educational use under the terms of the Dover amendment,
and that accordingly the proposed Museum was subject to the Nantucket Zoning Bylaw
which prohibits, among other things, commercial uses in the ROH zoning district. Two
Board members (PARENT and MURPHY concluded that the proposed use did
constitute an educational use and was thereby exempt from any regulation by the local
zoning bylaw.
7. Upon a motion made and duly seconded to grant the appeal and overturn the
issuance of the building permit to the Lightship Basket Museum, three Board members
voted in favor (WAIVE, WILLIAMS, and TOOLS) and two voted against (PARENT and
MURPHY. Accordingly, requiring four votes in favor to grant the appeal, the motion
fails, and the appeal is DENIED.

ADDENDUM
The Applicants are abutters to property located at 49 Union Street,
Nantucket, (Map 55.1.4, Parce131) owned by the Nantucket Lightship Basket
Museum, Inc. The Applicants appeal from the decision of the Nantucket
Building Inspector to grant Building Permit No. 75-99 to the Nantucket Lightship
Basket Museum, Inc., to construct an addition and change the of use of the
dwelling on the property from single family residential to a basket museum,
including a shop for commercial sales, storage, and a parking lot with five
spaces. The property is located in the ROH zoning district.
The proposed museum is not an educational use within the meaning of
G.L. c. 40A, section 3 (the so-called "Dover Amendment") and is not permitted
within the ROH zone.
Even if a museum, generically, were considered an educational use, this
"museum' is not. It is in fact a commercial enterprise, intended for the
promotion of the sale of contemporary baskets currently manufactured on
Nantucket by persons interested in the "museum". A commercial use is not
permitted in the ROH zone.
The application reveals that a portion of the premises are set aside for a
"shop" which is a commercial use not permitted within the ROH zone.
Even if the museum were considered an educational use within the
meaning of the Dover Amendment, it must still comply with reasonable
dimensional and parking requirements. It fails to meet these requirements in the
following respects:
1. Only five spaces are provided. This is patently inadequate in this
congested area. Since the zoning by-law does not contain express parking
provision for educational uses, under Section 139-18(E) the appropriate standard
is "comparably adequate off-street parking...." To determine what is
appropriate, one may examine the parking requirement for other uses most
closely analogous to a museum. Those which suggest themselves are
recreational facilities or places of public assembly.
The standard for recreational facilities is one space for each three persons
of total certified building occupancy. With five spaces, the museum would be
limited to a total occupancy of fifteen persons, including the staff. While the
application does not reveal the proposed occupancy, it is plainly intended to be
far greater than fifteen. In addition, the standard requires an additional space for
each three employees.
The standard for places of public assembly is one space for each four seats.
A museum does not ordinarily have seats like a theater, although these
applicants have indicated that they will conduct classes and demonstrations
which suggest a seated audience. Again, five spaces would limit them to a
maximum capacity of twenty. With almost a thousand feet of exhibit space and
an additional museum "shop", the capacity appears to be far higher.
2. The parking lot has not been approved by the Historic District
Commission, as required by Section 139-26(C)(1) of the by-law.
3. There is no standard loading space provided.

ADDENDUM
The Applicants are abutters to property located at 49 Union Street,
Nantucket, (Map 55.1.4, Parcel 31) owned by the Nantucket Lightship Basket
Museum, Inc. The Applicants appeal from the decision of the Nantucket
Building Inspector to grant Building Permit No. 75-99 to the Nantucket Lightship
Basket Museum, Inc., to construct an addition and change the of use of the
dwelling on the property from single family residential to a basket museum,
including a shop for commercial sales, storage, and a parking lot with five
spaces. The property is located in the ROH zoning district.
The proposed museum is not an educational use within the meaning of
G.L. c. 40A, section 3 (the so-called "Dover Amendment") and is not permitted
within the ROH zone.
Even if a museum, generically, were considered an educational use, this
"museum' is not. It is in fact a commercial enterprise, intended for the
promotion of the sale of contemporary baskets currently manufactured on
Nantucket by persons interested in the "museum". A commercial use is not
permitted in the ROH zone.
The application reveals that a portion of the premises are set aside for a
"shop" which is a commercial use not permitted within the ROH zone.
Even if the museum were considered an educational use within the
meaning of the Dover Amendment, it must still comply with reasonable
dimensional and parking requirements. It fails to meet these requirements in the
following respects:
1. Only five spaces are provided. This is patently inadequate in this
congested area. Since the zoning by-law does not contain express parking
provision for educational uses, under Section 139-18(E) the appropriate standard
is "comparably adequate off-street parking...." To determine what is
appropriate, one may examine the parking requirement for other uses most
closely analogous to a museum. Those which suggest themselves are
recreational facilities or places of public assembly.
The standard for recreational facilities is one space for each three persons
of total certified building occupancy. With five spaces, the museum would be
limited to a total occupancy of fifteen persons, including the staff. While the
application does not reveal the proposed occupancy, it is plainly intended to be
far greater than fifteen. In addition, the standard requires an additional space for
each three employees.
The standard for places of public assembly is one space for each four seats.
A museum does not ordinarily have seats like a theater, although these
applicants have indicated that they will conduct classes and demonstrations
which suggest a seated audience. Again, five spaces would limit them to a
maximum capacity of twenty. With almost a thousand feet of exhibit space and
an additional museum "shop", the capacity appears to be far higher.
2. The parking lot has not been approved by the Historic District
Commission, as required by Section 139-26(C)(1) of the by-law.
3. There is no standard loading space provided.
