Applicants are seeking .relief by Special Permit under Nantucket Zoning By-law, Section 139-33A (alteration/expansion of a pre-existing nonconforming structure/use) and/or a Modification of Special Permits issued and modifi®d in Board of .Appeals Case Nos. 053-83, 006-86, 051-E3>~ end 014-89 and see companion BdA Case No. 084-98. The Applicants propose to alter the bar establishment known as the '.'Muse" by allowing the elimination of the on-site manager's apartment to the rear of the structure, by installing new handicapped bathroom facilities within the-same footprint, In addition, Applicants are seeking relief by Special Permit under Nantucket Zoning by-law Section 139-33A and/or a Modification of the foregoing listed Decisidns to extend -the existing structure by constructing a new deck along the entire, front; .incorporating the existing deck, along Surfside Road, and by adding 43 additional- seasonal exterior seats with waitstaff service.. In addition, Applicants are seeking relief by Special Permit and to .the extent necessary, by Variance. under Nantucket Zoning By-Law Section 139-1 S to waive the additional eleven (11) required parking spaces. The premises are located at 40 and 44 Surfside Road, and 18 Pilot Whale Drive, Assessor's :Map 67, Parcels 15, 119, 399, Land Court Plan 38132-D, Lot 11, Land Court Plan 26439-E, Lot 20, Land Court Plan 26439-0, Lot 68. The pecision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board did make a recommendation in favor of the handicapped bathroom facilities and opposed the other request for relief by the Applicants. There were no letters received regarding this matter. There were area residents who spoke in :opposition to the proposed deck and outside seating only. 3. Applicants, through counsel, have moved to withdraw that part of their Application requesting an extension or alteration of "the premises by the addition of a d®ck along the front of the building on Surfside Road with seasonal seating capacity of 43 with wait staff service," The Board by unanimous vote grants the request to withdraw said pvrfion of the Application without prejudice. 4. The Applicants provided a detailed MCD analysis and Parking Data. The prior BOA decisions noted above were for minor modifications of the building, to wit:.entry vestibule, storage decks and ramps and did not require relief from parking requirements. After careful analysis the Board deltermined that the prior relief and fhe current proposal do not exceed the MCD threshold. The Applicants are before the Board fqr a Special Permit because the property is in a residential-.zone and the commercial use is pre-existing nonconforming and any modification of the. use/structure requires Special Permit relief:. The property has been used as a nightclub or entertainment facility since prior to the adoption of the zoning in the Town of Nantucket. The installation of handicapped bathrooms i$ within the existing foot print of the building and does not increase the groundcover or change the existing set backs of the building. The bathrooms do nat.impact the parking. The construction only involves the change of interior walls of the structure and is not an expansion of the.. pre- existing nonconforming use or structure. 5. Therefore- the Board finds that Special Permit relief may be granted to allow the elimination of the on-site first floor manager's apartment and allow the installation of new handicapped bathroom facilities with attendant hallway/open space access from the rest of the facility; that it would be in harmony with. the general purpose and intent of the By-Law and that it would not be substantially more detrimental to the neightwrhaod than the existing nonconformities. The construction of handicapped bathrooms is required to meet ADA standards and is a benefit to the public by providing handicapped bathroom facilities in a place of public assembly. No relief from the parking requirement would be required for the Special Permit since there is no net increase in the parking spaces needed for the change of use of the floor area consisting of the manager's apartment, which required one (1) space,, to the handicapped bathroom facilities and attendant hallway/open space access. , 6. The Applicants, W.B.B.O., Inc., and Island Management, Inc., further seek a SPECIAL PERMIT under §139-33.A to alter and extend the existing uses upon Parcel 109A for use as a parking area ancillary to the Muse. The three subject parcels are contiguous to one another. The subject properties are situated at 44 SURFSIDE ROAD (Lot 20, being shown upon Assessor's Map 67 as Parcel 119), 40 SURFSIDE ROAD (Lot 11, being shown upon Assessor's Map 67 as Parcel. 15), and 18 PILOT WHALE DRIVE (Lot 68, being shown upon Assessor's Map 67 as Parcel 399), and are situated in a Residential-10 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was favorable, subject to (a) submission of plans to the Planning Board for the adjustment of lot lines, (b) there being one curb-cut on Surfside Road and one curb-cut on the "Lot Road", and (c) provision of adequate screening. The Traffic Safety Committee made a recommendation in favor of the redesign of the Muse parking lot as proposed. The attorney for Nantucket Ice spoke in favor of the proposed relief, stating that it would be a benefit to the community, A letter from Nantucket Ice and petitions signed by 57 area residents and others were presented at the public hearing. A neighboring property owner holding an easement across the subject property expressed concern that his easement not be extinguished, and he was assured that no action of the Board of Appeals nor of the Applicants could affect his easement without his consent. One abutter spoke in opposition to the propose change, and several other persons spoke in opposition regarding concerns as to use of the remaining land of Pilot Whale Nominee Trust and other matters not in point on this application. 4. The zoning status of the Muse, and of the parking area serving it, has been the subject of several cases decided by the Nantucket Board of Appeals. In each of these cases, it has been assumed and determined that the commercial use of the building known as the Muse, as a restaurant, bar and nightclub, pre-exists the 1972 effective date of the Nantucket Zoning By-law, and is therefore a pre-existing nonconforming use in the Residential-10 zoning district in which all of the subject parcels are situated. In Cases Nos. 053-83 and 006-86, the Board of Appeals granted Special Permit relief to allow expansion of the structure. In Case No. 051-88, the Special Permit in Case No. 006-86 was modified by the removal of a condition of relief. In Case No. 014-89, the Special Permit was modified to allow construction of an addition, a deck and a storage facility, and parking requirements for the Muse and its dormitory were established at 48 spaces, with the decision establishing certain conditions as to their placement and use. Meanwhile, the decision in Case No. 040-86, as modified in Case No. 042-98, encumbered the Muse parking area with the requirement that five parking spaces be provided for Buskin, Inc., as the owner of certain land near the parking area, pursuant to an agreement between the Applicants and Buskin, Inc. As presented to the Board of Appeals, the entities owning the Muse and its parking lot propose to exchange certain parcels of land with an abutter, which will result in the reconfiguration of the Muse parking lot upon Lots Al and 109A as shown upon Exhibit B, with 43 parking spaces to be provided within it, while Lot A upon Exhibit B, containing the Muse dormitory, will now have a separate parking lot providing the seven parking spaces required for the dormitory. Incidentally thereto, and not relevant to the decision in this case, the abutter will receive a parcel of land (the "Lot Road") which will potentially enable the abutter to reconfigure access to its subdivision subject to Planning Board approval under the Subdivision Control Law. Matters relating to this subdivision and its reconfiguration, and possible uses of the lots therein, are not relevant to the present application and have not been considered in connection with this Decision. 5. As presented to the Board of Appeals, the present Muse parking lot is poorly screened, dirt-surfaced and ill-defined. Vehicles are parked virtually at random, with little regard to boundary line between the Muse and adjacent property now owned by the Trustee of Pilot Whale Nominee Trust. The Applicants now propose to reconfigure the parking lot. Their engineering firm, Hayes Engineering, Inc., has investigated the layout of the parking lot, and has designed the proposed parking lot as shown upon Exhibit A as being in its view the best practical approach to improving the situation. The lot Iine reconfiguration will result in the parking lot being more regular in shape and closer to the Muse building. It will be redesigned in a safer and better-lighted manner, with appropriate screening to be installed. The parking lot will be resurfaced, with a 3" layer of %" native stone and on-ground definition of the parking spaces. There will be one entrance, from Surf side Road, and one exit, into the "Lot Road" with each being designated as one-way. The seasonal Nantucket Regional Transportation Authority ("NRTA") shuttle bus line passes in front of the Muse on Surfside Road, and the Applicants propose to place a shuttle bus stop within the `parking lot, subject to ongoing arrangements being worked out with NRTA. The total number of parking spaces provided and available for use by the Muse and its dormitory will exceed the number now provided. 6. Accordingly, the Board of Appeals, by UNANIMOUS vote, found that the proposed reconfiguration of the parking area and lot lines as shown upon Exhibits A and B and described herein will be in harmony with the general purpose and intent of the Zoning By-law, in that the proposed modification will be a benefit to the community, improving traffic flow and safety and making the parking area more functional and aesthetically appropriate, and GRANTED the proposed relief by MODIFICATION of the various Special Permits affecting the subject property, as listed above, subject to the following conditions: (a) The general configuration of the parking lot, including the points of access and egress, shall be in substantial conformity with the layout as shown upon the plan drawn by Wayne Tavares, Landscape Architect, dated September 9, 1998, a reduced copy of which is attached to this Decision as Exhibit A. (However, the exact layout of parking spaces can vary therefrom so long as the minimum number of parking spaces required by this decision is maintained.) (b) The reconfiguration of lot lines affecting the subject properties shall be in substantial conformity with the layout as shown upon the sketch plan by Hayes Engineering, Inc., 3 dated August 25, 1998, revised January 13, 1999, a reduced copy of which is attached hereto as Exhibit B. (c) No expansion or other changes to the Muse building or its uses are permitted hereby. (d) The reconfigured Muse parking lot shall contain at least 43 parking spaces. The reconfigured lot containing the existing Muse dormitory shall contain at least seven parking spaces, with a separate entrance from the "Lot Road"). (e) The Muse parking lot shall be resurfaced, with a 3" layer of %" native stone and on-ground definition of the parking spaces. Landscaping and other appropriate screening shall be provided, similar to that ;shown upon Exhibit A. Lighting shall be directed toward the ground. (f) Adequate trash receptacles shall be provided around the perimeter of the Muse parking lot. (g) A NRTA bus stop with a waiting bench is to be placed within the Muse parking lot for use during daylight hours and maintained by the owner of the property, and may be in an area that will otherwise be used for parking of vehicles. The Board acknowledges that this use is subject to periodic negotiations between the property owner and NRTA. Our findings are based upon the record in this and ~, prior applications 006-86 (Special Permit) and 051-88 s (modification), including 11/4/87 mortgage plot plans for ~ Lots 20 and 11 (our Exhibits A-1 and A-2), 2/3/89 drawings ~ of proposed Phase I and Phase II additions to the Muse +' (our Exhibits B-1 and B-2, HDC Certificate of Appropriateness 19,381 of 2/7/89), viewings and ~ correspondence and photoprints, testimony .and ~ representations received at our hearings of March 31 and d April • 2~8,. 1989. ,4. Applicant's Lot 20 has 88' of frontage on Surfside Road * with the northerly 20' or so of that frontage providing entry to a 12'-wide private way extending to the northeast across the northwest corner of the Lot. On the Lot is a one-story "entertainment club building" set back from the street line about 1' more than the required 20' front-yard setback and about 10' from the private way, The 6.4' setback from the southerly lot line is less than the .required 10', and ground coverage ratio is 30$, about 50: over the allowable 20$ GCR. However, Lot 11 was represented to be available under lease for commercial use by the Muse. The effective GCR is made conforming by the. merger of Lots 20 and 11 for zoning purposes. See 006-86. 5. In addition to the dimensional nonconformity, the commercial uses are nonconforming. Applicant's representation that the present commercial uses pre-date 48207 File No. 014-89 1972 zoning was not challenged here. Accordingly, the additions which Applicant here proposes can qualify for Special Permit relief under Section 139-33A provided we find that they are not snbstantially more detrimental to the neighborhood but in harmony with the Code. We make that finding subject to the conditions stated below. 6. The proposed Phase Z addition is the new front vestibule. Zts purpose is to provide an enclosed space accessible to patrons of the•take-out pizza business without their going into the bar and entertainment areas. This addition is understood to be responsive to the suggestion of the Chief of Police that such a separate area be provided so that minors need not enter where liquor is served in order to get a pizza. It is commended by the Town Health Officer to provide a screened and protected area between the kitchen and outdoors. The new vestibule will accommodate a one-station take-out service and is represented as not entruding into the required setback, treating the lot line bounding the 12' way as not a front lot line. 7. Phase I also includes a new deck between the front vestibules plus a handicapped access tramp leading up to the deck. Zn Exhibit A-1, the ramp is located across the new front vestibule and, in Exhibit B-1, across the existing vestibule. Whichever is built should not intrude into a setback (unless exempted under State law, and then be the least intrusive). The existing vestibule is to be modified to provide a ticket window and storage area with elimination of one door (unobjectionable unless a risk to safety to patrons leaving in an emergency).. 8. Phase IZ concerns the rear storage structure for used bottles to be recycled. This addition is regarded as a benefit to the neighborhood and community. ., ~. Applicant proposes to locate 10 off-street parking spaces behind the building on Lot 20 per Exhibit A-1 and the remaining 38 spaces (the two nearest being marked for handicapped) on the adjacent triangular portion of Lot 11. These spaces are represented as meeting the requirements of Section 139-18 corresponding to the uses of the premises. (Off-street parking for the employer dormitory on the remote triangular portion of Lot 11 is understood to be on that portion of the Lot.) Since sole access to the rear 10 spaces is via a l0'-wide driveway along the northerly wall of the building, its use~is more appropriate to employees than to transient patrons. The required loading area is also in the rear. l0. Section 139-18F requires that the parking areas be screened by a "densely planted compact hedge" (or fence) but the height across the frontage of Lot 11 should not - 2 - . 48207 File No. 014-89 impair visibility onto Surfside Road at the exit. The area is now screened by pine trees. ' 11. Our principal concern is for safety as to vehicles leaving and entering Surfside Road. Neither Applicrnt nor its predecessor has installed the "elongated traffic barrier" required by Special Permit 006-86 along the front of Lot 20 (nor the parking control lines of modified permit 051-88, now lapsed). Applicant marked our Exhibit A-1 to show an elongated traffic control 'island' defined by parking control lines to define an entry for vehicles at the south end of the frontage. The 12' way defines the exit at the north end of the frontage. No vehicle would be allowed to park anywhere across the front of Lot 20 but simply to drive through to drop off or pick-up passengers. Applicant's proposal is accepted as a condition of this further Special Permit as a.substantial improvement upon the present, inherently unsafe parking at random across the front of the building and onto Surfside Road. The traffic control island, being entirely on Applicant's Lot 20 and not on the public way, should with appropriate landscaping, signage and policing make clear that parking is allowed only in the rear and preferably on Lot 11. I 12. We, therefore, condition grant of the requested Special Permit upon Applicant providing the parking areas and the elongated traffic island in substantial conformity wih Exhibits A-1 and A-2 as described above. Relief is further conditioned on the additions being constructed in substantial conformity with Exhibits B-1 and B-2 plans. 13. Validity of this Special Permit is also subject to Applicant's commercial uses not reaching the threshholds for a Major Commercial Use, as set in Section 139-9B(4)(a)[1], by changes since April 1984. The remaining portion of Lot 11 would constitute two separate lots. One, shown as Lot A upon Exhibit B, with access from the "Lot Road", would contain the existing employer dormitory; the other, shown as Lot Al on Exhibit B, will continue to be part of the Muse parking lot. The Applicants, W.B.B.O., Inc., and Island Management, Inc., further seek a SPECIAL PERMIT under §139-33.A to alter and extend the existing uses upon Parcel 109A for use as a parking area ancillary to the Muse. The three subject parcels are contiguous to one another. The subject properties are situated at 44 SURFSIDE ROAD (Lot 20, being shown upon Assessor's Map 67 as Parcel 119), 40 SURFSIDE ROAD (Lot 11, being shown upon Assessor's Map 67 as Parcel. 15) and 18 PILOT WHALE DRIVE (Lot 68, being shown upon Assessor's Map 67 as Parcel 399), and are situated in a Residential-10 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was favorable, subject to (a) submission of plans to the Planning Board for the adjustment of lot lines, (b) there being one curb-cut on Surfside Road and one curb-cut on the "Lot Road", and (c) provision of adequate screening. The Traffic Safety Committee made a recommendation in favor of the redesign of the Muse parking lot as proposed. The attorney for Nantucket Ice spoke in favor of the proposed relief, stating that it would be a benefit to the community, A letter from Nantucket Ice and petitions signed by 57 area residents and others were presented at the public hearing. A neighboring property owner holding an easement across the subject property expressed concern that his easement not be extinguished, and he was assured that no action of the Board of Appeals nor of the Applicants could affect his easement without his consent. One abutter spoke in opposition to the propose change, and several other persons spoke in opposition regarding concerns as to use of the remaining land of Pilot Whale Nominee Trust and other matters not in point on this application. 4. The zoning status of the Muse, and of the parking area serving it, has been the subject of several cases decided by the Nantucket Board of Appeals. In each of these cases, it has been assumed and determined that the commercial use of the building known as the Muse, as a restaurant, bar and nightclub, pre-exists the 1972 effective date of the Nantucket Zoning By-law, and is therefore a pre-existing nonconforming use in the Residential-10 zoning district in which all of the subject parcels are situated. In Cases Nos. 053-83 and 006-86, the Board of Appeals granted Special Permit relief to allow expansion of the structure. In Case No. 051-88, the Special Permit in Case No. 006-86 was modified by the removal of a condition of relief. In Case No. 014-89, the Special Permit was modified to allow construction of an addition, a deck and a storage facility, and parking requirements for the Muse and its dormitory were established at 48 spaces, with the decision establishing certain conditions as to their placement and use. Meanwhile, the decision in Case No. 040-86, as modified in Case No. 042-98, encumbered the Muse parking area with the requirement that five parking spaces be provided for Buskin, Inc., as the owner of certain land near the parking area, pursuant to an agreement between the Applicants and Buskin, Inc. As presented to the Board of Appeals, the entities owning the Muse and its parking lot propose to exchange certain parcels of land with an abutter, which will result in the reconfiguration of the Muse parking lot upon Lots Al and 109A as shown upon Exhibit B, with 43 parking spaces to be provided within it, while Lot A upon Exhibit B, containing the Muse dormitory, will now have a separate parking lot providing the seven parking spaces required for the dormitory. Incidentally thereto,' and not relevant to the decision in this case, the abutter will receive a parcel of land (the "Lot Road") which will potentially enable the abutter to reconfigure access to its subdivision subject to Planning Board approval under the Subdivision Control Law. Matters relating to this subdivision and its reconfiguration, and possible uses of the lots therein, are not relevant to the present application and have not been considered in connection with this Decision. S. As presented to the Board of Appeals, the present Muse parking lot is poorly screened, dirt-surfaced and ill-defined. Vehicles are parked virtually at random, with little regard to boundary line between the Muse and adjacent property now owned by the Trustee of Pilot Whale Nominee Trust. The Applicants now propose to reconfigure the parking lot. Their engineering firm, Hayes Engineering, Inc., has investigated the layout of the parking lot, and has designed the proposed parking lot as shown upon Exhibit A as being in its view the best practical approach to improving the situation. The lot Line reconfiguration will result in the parking lot being more regular in shape and closer to the Muse building. It will be redesigned in a safer and better-lighted manner, with appropriate screening to be installed. The parking lot will be resurfaced, with a 3" layer of %" native stone and on-ground definition of the parking spaces. There will be one entrance, from Surf side Road, and one exit, into the "Lot Road" with each being designated as one-way. The seasonal Nantucket Regional Transportation Authority ("NRTA") shuttle bus line passes in front of the Muse on Surfside Road, and the Applicants propose to place a shuttle bus stop within the `parking lot, subject to ongoing arrangements being worked out with NRTA. The total number of parking spaces provided and available for use by the Muse and its dormitory will exceed the number now provided. 6. Accordingly, the Board of Appeals, by UNANIMOUS vote, found that the proposed reconfiguration of the parking area and lot lines as shown upon Exhibits A and B and described herein will be in harmony with the general purpose and intent of the Zoning By-law, in that the proposed modification will be a benefit to the community, improving traffic flow and safety and making the parking area more functional and aesthetically appropriate, and GRANTED the proposed relief by MODIFICATION of the various Special Permits affecting the subject property, as listed above, subject to the following conditions: (a) The general configuration of the parking lot, including the points of access and egress, shall be in substantial conformity with the layout as shown upon the plan drawn by Wayne Tavares, Landscape Architect, dated September 9, 1998, a reduced copy of which is attached to this Decision as Exhibit A. (However, the exact layout of parking spaces can vary therefrom so long as the minimum number of parking spaces required by this decision is maintained.) (b) The reconfiguration of lot lines affecting the subject properties shall be in substantial conformity with the layout as shown upon the sketch plan by Hayes Engineering, Inc., 3 dated August 25, 1998, revised January 13, 1999, a reduced copy of which is attached hereto as Exhibit B. (c) No expansion or other changes to the Muse building or its uses are permitted hereby. (d) The reconfigured Muse parking lot shall contain at least 43 parking spaces. The reconfigured lot containing the existing Muse dormitory shall contain at least seven parking spaces, with a separate entrance from the "Lot Road"). (e) The Muse parking lot shall be resurfaced, with a 3" layer of %" native stone and on-ground definition of the parking spaces. Landscaping and other appropriate screening shall be provided, similar to that ;shown upon Exhibit A. Lighting shall be directed toward the ground. (f) Adequate trash receptacles shall be provided around the perimeter of the Muse parking lot. (g) A NRTA bus stop with a waiting bench is to be placed within the Muse parking lot for use during daylight hours and maintained by the owner of the property, and may be in an area that will otherwise be used for parking of vehicles. The Board acknowledges that this use is subject to periodic negotiations between the property owner and NRTA. (h) All provisions of the Special Permits which are being hereby modified and which are not expressly modified herein shall remain in full force and effect; specifically included as continuing to be maintained shall be the requirement for the provision of parking spaces for a certain neighboring property owner as per the decision in Case No -98. Applicant seeks a Special Permit under zoning Bylaw Section 139-33A to alter and extend its existing nonconforming commercial building by adding a new front-entry vestibule'at the north end, a deck between that and the existing entry vestibule and, in the rear, an attached storage structure. 2. The premises are located at 44 Surfside Road (formerly Atlantic Avenue), Assessor's Parcel 67-119, Lot 20 of Land Court Plan 26439-E (with the leased parking area at 40 Surfside Road, Assessor's Parcel 67-015, Lot 11 of Land Court Plan 38132-D) in the Residential-10 zoning district. 3. Our findings are based upon the record in this and prior applications 006-86 (Special Permit) and 051-88 (modification), including 11/4/87 mortgage plot plans for Lots 20 and 11 (our Exhibits A-1 and A-2), 2/3/89 drawings of proposed Phase I and Phase II additions to the Muse (our Exhibits B-1 and B-2, HDC Certificate of Appropriateness 19,381 of 2/7/89), viewings and correspondence and photoprints, testimony .and representations received at our hearings of March 31 and April • 2.8 ,. 1989. ,4. Applicant's Lot 20 has 88' of frontage on Surfside Road with the northerly 20' or so of that frontage providing entry to a 12'-wide private way extending to the northeast across the northwest corner of the Lot. On the Lot is a one-story "entertainment club building" set back from the street line about 1' more than the required 20' front-yard setback and about l0' from the private way. The 6.4' setback from the southerly lot line is less than the .required 10', and ground coverage ratio is 300, about 50: over the allowable 20$ GCR. However, Lot 11 was represented to be available under lease for commercial use by the Muse. The effective GCR is made conforming by the. merger of Lots 20 and 11 for zoning purposes. See 006-86. 5. In addition to the dimensional nonconformity, the commercial uses .a re nonconforming. Applicant's representation that the present commercial uses pre-date 48207 File No. 014-89 1972 zoning was not challenged here. Accordingly, the additions which Applicant here proposes can qualify for Special Permit relief under Section 139-33A provided we find that they are not snbstantially more detrimental to the neighborhood but in harmony with the Code. We make that finding subject to the conditions stated below. 6. The proposed Phase I addition is the new front vestibule. Its purpose is to provide an enclosed space accessible to patrons of the. take-out pizza business without their going into the bar and entertainment areas. This addition is understood to be responsive to the suggestion of the Chief of Police that such a separate area be provided so that minors need not enter where liquor is served in. order to get a pizza. It is commended by the Town Health Officer to provide a screened and protected area between the kitchen and outdoors. The new vestibule will accommodate a one-station take-out service and is represented as not entruding into the required setback, treating the lot line bounding the 12' way as not a front lot line. 7. Phase Z also includes a new deck between the front vestibules plus a handicapped access rramp leading up to the deck. Zn Exhibit A-1, the ramp is located across the new front vestibule and, in Exhibit B-1, across the existing vestibule. Whichever is built should not intrude into a setback (unless exempted under State law, and then be the least intrusive). The existing vestibule is to be modified to provide a ticket window and storage area with elimination of one door (unobjectionable unless a. risk to safety to patrons leaving in an emergency).. 8. Phase II concerns the rear storage structure for used bottles to be recycled. This addition is regarded as a benefit to the neighborhood and community. . , ~. Applicant proposes to locate 10 off-street parking spaces behind the building on Lot 20 per Exhibit A-1 and the remaining 38 spaces (the two nearest being marked for handicapped) on the adjacent triangular portion of Lot 11. These spaces are represented as meeting the requirements of Section 139-18 corresponding to the uses of the premises. (Off-street parking for the employer dormitory on the remote triangular portion of Lot 11 is understood to be on that portion of the Lot.) Since sole access to the rear 10 spaces is via a 10'-wide driveway along the northerly wall of the building, its use'is more appropriate to employees than to transient patrons. The required loading area is also in the rear. 10. Section 139-18F requires that the parking areas be screened by a "densely planted compact hedge" (or fence) but the height across the frontage of Lot 11 should not - 2 - 48207 File No. 014-89 impair visibility onto Surfside Road at the exit. The area is now screened by pine trees. 11. Our principal concern is for safety as to vehicles leaving and entering Surfside Road. Neither Applicant nor its predecessor has installed the "elongated traffic barrier" required by Special Permit 006-86 along the front of Lot 20 (nor the parking control lines of modified permit 051-88, now lapsed). Applicant marked our Exhibit A-1 to show an elongated traffic control 'island' defined by parking control lines to define an entry for vehicles at the south end of the frontage. The 12' way defines the exit at the north end of the .frontage. No vehicle would be allowed to park anywhere across the front of Lot 20 but simply to drive through to drop off or pick-up passengers. Applicant's proposal is accepted as a condition of this further Special Permit as a.substantial improvement upon the present, inherently unsafe parking at random across the front of the building and onto Surfside Road. The traffic control island, being entirely on Applicant's Lot 20 and not on the public fray, should with appropriate landscaping, signage and policing make clear that parking is allowed only in the rear and preferably on Lot 11. I 12. We, therefore, condition grant of the requested Special Permit upon Applicant providing the parking areas and the elongated traffic island in substantial conformity wih Exhibits A-1 and A-2 as described above. Relief is further conditioned on the additions being constructed in substantial conformity with Exhibits B-1 and B-2 plans. 13. Validity of this Special Permit is also subject to Applicant's commercial uses not reaching the threshholds for a Major Commercial Use, as set in Section 139-9B(4)(a)[1J, by changes since April 1984. Only the Planning Board can grant a Special Permit for an MCD. ,14.
