KNOX-JOHNSTON, Trustee of Huntington Realty Trust, of P.O. Box 1828, Nantucket, MA 02554, Board of Appeals File No. 024-99, the Board made the following Decision: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A(8). Applicant is requesting the Board to validate a 1986 merger of two (2) nonconforming lots. A 2,023+ square-foot lot, with frontage on Step Lane, improved with a single-family dwelling and shown as Lot 1, on Plan File 23-D, was combined with a 1,659+ square-foot vacant lot with frontage on Ash Street, and shown as Lot 5 on Plan File 23-D, to create the 3,682+ square-foot Locus in a district that requires a minimum lot size of 5,000 square feet. Arguably, the reconfigured Lot lost its grandfathered status as a result of said merger. In addition to lot size, the Locus is nonconforming as to setback with the structure being sited 3.3+ feet at its closest point from the westerly side yard lot line in a district that requires a minimum side yard lot line of five (5) feet; and as to frontage with the Lot having a frontage of 40.70+ feet along Step Lane in a district that requires a minimum frontage of 50 feet. In the alternative, the Applicant is seeking relief by VARIANCE from the Intensity Regulations of Nantucket Zoning Bylaw §139-16A to validate the Lot as currently configured. The Premises is located at 6 STEP LANE, Assessor's Map 42.4.2, parcel 42, Plan File 23-D, Lots 1 and 5. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing. There were no letters on file. Two (2) members of the public spoke in favor of the grant of relief. The Planning Board recommendation was favorable provided Applicant combine the Lots by filing an ANR plan with that Board. 3. Applicant, through counsel, represented that she is the owner of the property (the "Property") located at 6 Step Lane. Applicant purchased the property in 1986. The original configuration of the land is shown on a plan dated October 19, 1949, which is recorded in the Nantucket Registry of Deeds in Plan Book No. 13, Page 51 (the "1949 Plan"). When zoning was enacted on Nantucket in 1972, the property became nonconforming with respect to area, frontage and side yard setback. In 1986, the land shown on the 1949 Plan was reconfigured as shown on a plan dated July 14, 1986, which is recorded with the Nantucket Registry of Deeds in Plan File 23-D ("the 1986 Plan"). Applicant purchased Lot 1, a 2,023+ square-foot lot improved with a single-family dwelling, and Lot 5, a 1,659+ square-foot vacant lot, as shown on the 1986 Plan. Prior to the filing of the 1986 Plan, which combined said Lots, the Property was protected as pre-existing and nonconforming land with respect to frontage, lot area and side yard setback. Arguably, the Property lost its protected status when the Applicant purchased the reconfigured merged Lot 1 and Lot 5 as shown on the 1986 Plan. Though the nonconforming lot area was made less nonconforming with the merger, the 3,682+ square feet of aggregate lot area continued to remain less than the allowable minimum lot size of 5,000 square feet. The nonconforming frontage issue and side yard setback intrusion was not impacted by the reconfiguration of the subject Lots. No other changes to the property are requested by the Applicant. The required parking space will continue to be provided. 4. Therefore, the Board finds that the change in lot area with the merger of Lot 1 and Lot 5 as shown on the 1986 Plan, is in harmony with the general purpose and intent of the Zoning Bylaw, modest in nature and would not be substantially more detrimental to the surrounding neighborhood than the existing nonconformities. Furthermore, the grant of relief will not create any new nonconformity nor increase any existing nonconformity and the merger in fact decreases the nonconforming nature of the lot area. It will simply permit the status quo to continue. The Board further finds that a grant of relief under Nantucket Zoning Bylaw §139-33A(8) to validate a merger that took place in 1986, is within the scope of this section. 5. As to the alternative VARIANCE relief requested, upon a motion by the Applicant to WITHDRAW WITHOUT PREJUDICE said Variance request, the Board so voted unanimously. 6. Accordingly, the Board, by a unanimous vote, GRANTS the requested SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A(8) to validate and ratify the 1986 reconfiguration of the Property with an area of 3,682+ square feet as shown on a plan done by Leo C. Asadoorian, Dated August 21, 1998, for "Huntington Realty Trust, Tracy H. Leddy, Trustee", marked as Exhibit A and attached hereto. Knox-Johnston, Trustee of Huntington Realty Trust, seeks a Special Permit pursuant to Section 139-33A(8) of the Nantucket Zoning By-Law (the "By-Law") ratifying the change in lot configuration which was approved by the Planning Board in 1986. The Applicant is the owner of the property (the "Property") located at 6 Step Lane, shown on the plot plan attached as Exhibit "A" (the "Plan"). The Applicant purchased the property in 1986. The original configuration of the land is shown on a plan dated October 19, 1949 entitled "Lane in Nantucket surveyed for Theodore E. and Randolph G. Sharp," which is recorded in the Nantucket Registry of Deeds in Plan Book No. 13, Page 51 (the "1949 Plan"). The 1949 Plan is attached as Exhibit "B" . When zoning was enacted on Nantucket in 1972, the property became non-conforming with respect to area, frontage and side yard setback. In 1986, the land shown on the 1949 Plan was reconfigured as shown on the plan entitled "Survey Plan of Land in Nantucket, Massachusetts prepared for William A. Soady, Catherine E. Cronin and Andrew J. Leddy, Trustee, dated July 14, 1986," which plan is recorded with the Nantucket Registry of Deeds in Plan File 23-D (the "1986 Plan"). The 1986 Plan is attached as Exhibit "C". The Applicant purchased Lot 1 and Lot 5 as shown on the 1986 Plan. Prior to the filing of the 1986 Plan, the Property was protected as pre-existing and non-conforming land with respect to frontage, lot area and side yard setback. Arguably, the Property lost its protected status when the Applicant purchased the reconfigured Lots on the 1986 Plan. The Applicant requests that a Special Permit be issued permitting the non-compliance of the Property with respect to frontage, lot area and side yard setback. The requested relief is in harmony with the purpose of the By-Law and is modest in nature. Allowing the requested relief would cause no detriment to the surrounding neighbors. Furthermore, the grant of a Special Permit will not create any new non-conformity nor increase any existing non-conformity; it will simply permit the status quo to continue. The Applicant asks the Board to vote in favor of the requested Special Permit. In the alternative, the Applicant requests a Variance pursuant to Section 139-32 of the By-Law validating the size, frontage and side yard setbacks of the Property. As a result of the shape of the land especially affecting the Property but not affecting generally the zoning district in which the Property is located, a literal enforcement of the provisions of the By-Law would involve substantial hardship to the Applicant who purchased the Property in 1986 to reduce and minimize these zoning non-conformities. The Applicant's purchase of the Property in 1986, in fact, reduced and minimized the zoning non- conformities and the Trust should be able to use the Property. Furthermore, the relief may be granted without nullifying or substantially derogating from the intent or purpose of the By-Law since the effect of conforming the lot size is actually a benefit to the public good, because zoning non-conformities are thereby reduced.
