At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, March 12, 1999, at 1:00 P.M., in the Conference Room, in the Town Building Annex, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of YOUSSEF RIZKALLAH, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 019-99: 2. The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law X139-33.A (alteration/expansion of a pre- existing nonconforming use). The Applicant proposes to enclose an area in the top floor apartment owned by the Applicant, a portion of which is more than the maximum permitted height of 30 feet above mean grade, within the existing footprint and without increasing the nonconforming height of the structure. The structure is nonconforming as to elevation as noted; as to use, containing five dwelling units in one building on a single lot, in a district where no more than two dwelling units are permitted on a lot, and no more than one dwelling unit (with an exception not material hereto) is permitted in a single structure; and as to frontage and side yard setback, having total frontage of 40.84 feet on Gardner Court, with 50 feet being the minimum required in this zoning district, and side yard setback, having setback of 4.10 feet from the southerly side yard lot line, with five feet being the minimum required in this zoning district. The subject property (the "Locus") is situated at 1C GARDNER COURT, Gardner Court Condominium, Unit 3, Assessor's Map 42.3.1, Parcel 188.2, the Condominium being situated upon the land shown on Land Court Plan 13467-D, as Lot 4, and with the condominium plans being recorded with Nantucket Deeds in Plan File 25-H. The Locus is zoned as Residential-Old Historic. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that there were no matters of planning concern. Consents to the application from the owners of all units in the condominium were presented. Otherwise, there was no support nor opposition presented at the public hearing. 4. The Applicant proposes to alter his condominium unit and, with the consent of all of the other unit owners, the building in which it is situated, by enclosing an area within the footprint of the pre-existing structure, nonconforming as to setback in an area which will not be affected by the proposed alteration and as to use as a five-unit apartment building. A portion of the area to be altered is more than thirty feet in elevation above mean grade, but the area being altered will not exceed the nonconforming elevation of 39.7 feet of the building at its highest point as set forth in a letter by Jeffrey L. Blackwell, P.L.S., which was submitted to the Board of Appeals. 5. Based upon the presentation by the Applicant, the Board of Appeals found that the structure upon the Locus is nonconforming dimensionally as to side yard setback and height and as to use as containing five dwelling units, that the Locus is also nonconforming as to frontage, and these nonconformities pre-exist the Zoning By-law. The proposed changes do not affect the footprint, but do affect the portion of the structure which is nonconforming as to height, without increasing the overall height of the structure. The Board also noted that the Locus is situated in a secluded area, albeit near the commercial center of Town, and that the other condominium owners will be affected by any changes far more than any abutters or neighbors. In any event, as noted above, no objections were received. 6. Accordingly, by UNANIMOUS vote, the Board of Appeals first found that the proposed alteration will intensify the nonconformity of the existing structure, in that the portion of the structure which exceeds the maximum height requirement of thirty feet above grade will be increased. I issue studied and support conservation and moved to the island no small part because of that interest I have studied preservation and land use law, rend carefully considered the fine line that preservationists must face in trying to preserve natunsl and wltural heritase. I do not say these things from a lack of knowledge of this process or its complexities. Bict, this process has gone weIl beyond any sense of reasonablcaess and appears to lack any direction or leadership. Ir bas most oertaialy lost sight of any of the goals under which the building cap was originally created. It has only gotten more complex, restrictive and imreasonabk. I implore you to address these issues, and carefully reconsider the intent of your process. I would be happy to lead my commessc or educational understanding to any of these issues, and would welcome your response to discuss these items in move detail. With the Building Cap I have aUratdy a net loss of Slz,t>DO between rear, property taxes and extended iatet+est payments. Faced with a doubling of that time delay and resultant loss, l wouk[ have tssuch rather expended the same amount vohsateering my professional expertise in preservation.
