A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, MARCH 12, 1999, in the CONFERENCE ROOM,
TOWN AND COUNTY BUILDING, 37 WASHINGTON STREET, Nantucket, Massachusetts,
on-the Application of the following:

BOARD OF APPEALS FILE N0. 018-99
Applicant is seeking an APPEAL from the Decision of the
Building Commissioner under Nantucket. Zoning By-Law §139-31, in which
he denied, by a letter dated January 13, 1999, the issuance of a
Building Permit for a single-family dwelling upon the basis that
issuance of the Building Permit would violate the Interim Growth Rate
provisions set forth in Nantucket Zoning By-Law §139-24C. Applicant
takes the position that the subject Premises is exempt from the
current provisions of §139-24C due to an alleged extension of a freeze
period affecting the subdivision in which the Locus is situated.
The Premises is located at 5 DEACON'S WAY, Assessor's Map 40,
Parcel 87, Lot 34, Land Court Plan 9070-D. The propery is zoned
Limited-Use-General-2.

Dear Ms. Hanley,
Your application for a permit to build a dwelling located at 5 Deacon's Way (40-
87) has been reviewed pursuant to §139 of the Code of Nantucket and is for the
following reason denied.
Your lot is subject to §139-24C of the Code of Nantucket, the Interim Growth
Rate provision of the zoning by-law also known as the "building cap". Pursuant to
the Building Commissioner's policy permits are being issued "at a rate of 1 /12 of
the annual amount of building permits allowed by the Nantucket Code per
month... ". Your application and accompanying documentation is being placed in
the "Ready but Denied" category pursuant to the Building Commissioner's policy.
You are number 82 in the "cap list".
The assignment of a "cap number" shall not be construed as a guarantee that the
permit will be issued in 1999, see §139-24C(2)(c).
Please be advised that you may appeal this decision of the Building
Commissioner to the Zoning Board of Appeals pursuant to §139-31 of the Code
of Nantucket. If you require any additional information please contact my office.

This is an appeal from the decision of the Building Commissioner

shown upon an Approval Required subdivision plan endorsed by the
Nantucket Planning Board on September 26, 1988. The development
of that land is regulated by the Phased Development provisions of
X139-24A of the By-law, which limits the issuance of building
permits for the land within the subdivision. It is applicant's
position that the provisions of $139-24A acted as a moratorium
upon the issuance of building permits for lots within the
subdivision, and pursuant to the provisions of M.G.L. c 41A §6,
the eight year zoning freeze protection afforded to those lots at
the time of its endorsement has been extended by an additional
ten years, or until September 26, 2006. Accordingly, the
premises are exempt from the provisions of X139-24C, and the
building permit denial was improper and should be overturned.
The premises are located at 5 Deacon's Way, Assessor's Map 40,
Parcel 87, Lot 34, Land Court Plan 9070-D. The property is zoned

ADDENDUM TO APPLICATION
Applicant: Marianne Hanley, Trustee of 5 Deacon's Way Trust
This is an appeal from the decision of the Building Commissioner
to deny the issuance of a building permit for a single-family
dwelling upon the basis that issuance of the permit would violate
the Interim Growth Rate provisions set forth in §139-24C of the
Nantucket Zoning By-law. The premises is a portion of the land
shown upon an Approval Required subdivision plan endorsed by the
Nantucket Planning Board on September 26, 1988. The development
of that land is regulated by the Phased Development provisions of
§139-24A of the By-law, which limits the issuance of building
permits for the land within the subdivision. It is applicant's
position that the provisions of $139-24A acted as a moratorium
upon the issuance of building permits for lots within the
subdivision, and pursuant to the provisions of M.G.L. c 41A §6,
the eight year zoning freeze protection afforded to those lots at
the time of its endorsement has been extended by an additional
ten years, or until September 26, 2006. Accordingly, the
premises are exempt from the provisions of §139-24C, and the
building permit denial was improper and should be overturned.
