1. At a public hearing of the Nantucket Zoning Board of Appeals, on
Friday, March 12,1999, at 1:00 P.M., in the Conference Room in the Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts ,the Board made the
following decision on the application (017-99) of PACIFIC CLUB OF
NANTUCKET, INC. of 15 Main Street, Nantucket, Massachusetts, in connection
with property known as 15 Main Street, Nantucket, Massachusetts.
2. Applicant is seeking a MODIFICATION of a SPECIAL PERMIT
granted in Board of Appeals File No. 021-96, in which first floor space was
allowed to be converted from use as a private club to seasonal retail use. To the
extent necessary, relief is sought by SPECIAL PERMIT under Nantucket Zoning
By-Law Section 139-33A (alteration/ expansion of apre-existing nonconforming
structure/use) and Section 139-18 waiving any additional parking requirements.
Applicant proposes to install an Automated Teller Machine ("ATM") on the first
floor of the pre-existing nonconforming structure. Specifically, the Applicant is
seeking to amend the condition stated in Paragraph 6 of the Decision in BOA
021-96 (recorded in Book 503, page 76 at the Nantucket Registry of Deeds), which
limited the first floor to one (1) retail space by a single tenant. The Premises is
located at 15 MAIN STREET, Assessor's Map 42.3.1, Parcel 133, as described in a
Deed at Book 56, Page 116, with no recorded plan. The property is zoned
Residential-Commercial.
3. Our decision is based upon the application and accompanying
materials, and representations and testimony received at our public hearing. The
Planning Board's staff made no recommendation, finding that the application
did not present issues of planning concern. One member of the public spoke in
support of the application at the hearing, and there was no opposition presented
at the public hearing.
4. In the Board's 1996 decision (021-96), the use of the first floor of the
building, either alternatively or simultaneously, as a club and/or retail space was
approved with the condition that "the Applicant's additional use of the first floor
of the structure shall be limited to one retail use by a single tenant." The
Applicant is proposing to lease the small space in the northwesterly corner of the
building at the corner of Main Street and Dock Street for the installation of an
Automated Teller Machine ("ATM"). The floor plan for this portion of the first
floor space is attached hereto as Exhibit A. While the ATM is not necessarily a
"retail" use, the bank that leases the space and operates the ATM will be a
separate tenant on the first floor. Accordingly, the Applicant seeks a
modification of the condition in the 1996 decision to permit the leasing of the
space by a bank for the sole purpose of installation and operation of an ATM as
shown on the attached plan.
5. At the request of the Board, the Applicant presented an analysis of
the parking requirements for the existing uses in the building, based on the
assumption from the floor plans in the file that the building has approximately a
1,225 footprint (no survey was available to verify the exact square footage), and
that therefore 6 spaces are required for each floor. The second and third floors of
the building each contain two office or retail tenants. When the first floor of the
building is being used entirely for retail purposes, the parking requirement is 23
spaces (18 spaces based on the assumed square footage of the three floors, and 5
spaces for the five separate office or retail tenants given that none of the tenants
have more than four employees). When the first floor of the building is used as a
club, there are approximately 32 seats in the club rooms, for an 8 parking space
requirement, but there is no employee parking space requirement with club
usage. Accordingly, with a club use on the premises, the building's parking
requirement is 24 spaces.
6. This parking analysis is based the footprint of the building, which
building is not being enlarged or expanded under the Applicant's proposal.
There is therefore no increase in that part of the parking analysis which is based
on square footage. While a Bank employee will need to service the ATM
occasionally, an ATM requires no employees on the premises. The Board
therefore finds that the installation and operation of an ATM will not increase the
parking requirements for the premises. The Applicant further represented at the
hearing that, given the location of the premises on Main Street and the other
ATMs that are more conveniently accessible by automobile elsewhere in the area,
the patrons of an ATM in this location would be predominantly on foot.
7. The exterior changes to the building are limited to those required to
make the ATM handicapped accessible (a new door with a lowered threshold)
and limited signage, all of which had previously been approved by the Historic
Districts Commission. Concerns were expressed that this relief may be the first
step toward two retail tenants with employees on the first floor of the building.
The Applicant reaffirmed that the intention was only to provide an ATM facility
at the corner of the building, not to split the first floor space into separate stores.

A majority of the Board found that the addition of an ATM use would not be
substantially more detrimental than the already permitted uses.
8. Accordingly, the Board of Appeals voted, by a vote of four (4) in
favor (Williams, O'Mara, Sevrens, Murphy) and one (1) against (Toole), to grant
the requested MODIFICATION of SPECIAL PERMIT N0.021-96 to modify the
condition in that permit so as to allow a segregated, separately rented space on
the first floor of the building for use as an ATM facility, in addition to the use of
the remaining space as club meeting rooms and/ or as retail space on the
following further conditions:
a) The floor plan for the ATM area shall be substantially in accordance
with the plan attached as Exhibit A entitled "Floor Plan" and no other use of this
portion of the first floor of the building shall be permitted without further relief
from this Board except a return to those uses permitted in the decision issued in
ZBA File No. 021-96;
b) The exterior changes to the building shall be substantially in
accordance with Historic Districts Commission Certificate of Appropriateness
Nos. 33720 and 33721;
c) The only employees working in the ATM area shall be those
providing service to the ATM and no employees shall be stationed in the ATM
area to provide other services to the public; and
d) The portions of the first floor not included in the ATM area shall
continue to be used as permitted in the decision issue in ZBA File No. 021-96.

ADDENDUM TO APPLICATION
PACIFIC CLUB OF NANTUCKET, INC.
15 MAIN STREET
The Applicant is the owner of property located at 15 Main Street, shown on
Tax Assessor's Map 42.3.1, Parcel 133. The property is located in the Residential
Commercial zoning district. The structure on the property is used as a meeting space
for Pacific Club members on the first floor and office space on the second and third
floors (two tenants per floor), which uses pre-exist the Nantucket Zoning-By-law.
The meeting space is also used by a single tenant retail use on the first floor, allowed
by Special Permit in BOA File No. 021-96. The locus is non-conforming as to lot size,
having a lot area of 1,650± square feet in a district that requires a minimum lot size of
5,000 square feet; as to side and rear yard setbacks, being sited zero feet at its closest
points from all lot lines; as to ground cover ratio, having in excess of the 30%
maximum ground cover ratio allowable for undersized lots in this district; and as to
parking with no spaces having been provided in the past.
The Applicant seeks relief under Nantucket Zoning By-law section 139-33
(alteration of apre-existing non-conforming structure/use) to modify an existing
Special Permit granted in BOA File No. 021-96 to permit the installation of an
Automated Teller Machine ("ATM") as an accessory use on the first floor of the
structure on the premises. Specifically, the Applicant seeks to amend the condition
stated in Paragraph 6 of the Special Permit limiting the use of the first floor of the
structure to one retail space by a single tenant, so as to permit the installation of an
ATM on the first floor of the structure, in addition to the club meeting space and the
one retail use by a single tenant allowed in the Special Permit.
The installation of an ATM will not increase the nonconformity of the lot or
the structure and will not require on-site employees. While the zoning code does not
address what parking should be required for an ATM use, the closest analogy is to
"retail stores and services." The ATM space will consist of less than 100 square feet
of the building. The ATM, therefore, triggers no parking space requirements. In this
location, the Applicant anticipates that all of the ATM users will be on foot. In the
event that the Board feels that there is an additional parking space requirement as a
result of the additional use, the Applicant requests a waiver pursuant to Nantucket
Zoning By-law Section 139-18(B) and 139-18(C) of all parking and/or loading
requirements for the uses on the lot in excess of the grandfathered spaces and relief
granted in BOA File No. 021-96.
The Applicant will provide an accessible ATM to summer visitors and year-
round residents. The proposed accessory use will benefit the downtown area
generally and is consistent with the intent and purpose of the Nantucket Zoning By-
law.

ADDENDUM TO APPLICATION
PACIFIC CLUB OF NANTUCKET, INC.
15 MAIN STREET
The Applicant is the owner of property located at 15 Main Street, shown on
Tax Assessor's Map 42.3.1, Parcel 133. The property is located in the Residential
Commercial zoning district. The structure on the property is used as a meeting space
for Pacific Club members on the first floor and office space on the second and third
floors (two tenants per floor), which uses pre-exist the Nantucket Zoning-By-law.
The meeting space is also used by a single tenant retail use on the first floor, allowed
by Special Permit in BOA File No. 021-96. The locus is non-conforming as to lot size,
having a lot area of 1,650± square feet in a district that requires a minimum lot size of
5,000 square feet; as to side and rear yard setbacks, being sited zero feet at its closest
points from all lot lines; as to ground cover ratio, having in excess of the 30%
maximum ground cover ratio allowable for undersized lots in this district; and as to
parking with no spaces having been provided in the past.
The Applicant seeks relief under Nantucket Zoning By-law section 139-33
(alteration of apre-existing non-conforming structure/use) to modify an existing
Special Permit granted in BOA File No. 021-96 to permit the installation of an
Automated Teller Machine ("ATM") as an accessory use on the first floor of the
structure on the premises. Specifically, the Applicant seeks to amend the condition
stated in Paragraph 6 of the Special Permit limiting the use of the first floor of the
structure to one retail space by a single tenant, so as to permit the installation of an
ATM on the first floor of the structure, in addition to the club meeting space and the
one retail use by a single tenant allowed in the Special Permit.
The installation of an ATM will not increase the nonconformity of the lot or
the structure and will not require on-site employees. While the zoning code does not
address what parking should be required for an ATM use, the closest analogy is to
"retail stores and services." The ATM space will consist of less than 100 square feet
of the building. The ATM, therefore, triggers no parking space requirements. In this
location, the Applicant anticipates that all of the ATM users will be on foot. In the
event that the Board feels that there is an additional parking space requirement as a
result of the additional use, the Applicant requests a waiver pursuant to Nantucket
Zoning By-law Section 139-18(B) and 139-18(C) of all parking and/or loading
requirements for the uses on the lot in excess of the grandfathered spaces and relief
granted in BOA File No. 021-96.
The Applicant will provide an accessible ATM to summer visitors and year-
round residents. The proposed accessory use will benefit the downtown area
generally and is consistent with the intent and purpose of the Nantucket Zoning By-
law.
