filing an complaint in court within TWENTY (20) days after
this day's date. Notice of the action with a copy of the
complaint and certified copy of the Decision must be given
to the Town Clerk so as to be received within such TWENTY
(20) days.

as Exhibit "B".
At a Public Hearing of the ZONING BOARD OF APPEALS held at 1:00 P.M.,
Friday, March 8, 1999, in the Conference Room at the Town Building Annex, 37
Washington Street, Nantucket, Massachusetts, on the Application of JOHN F.
MEZZANOTTE, ANNE J. CAWLEY (O'ROURKE) and BARBARA YANKE, 256 North
Main Street, Wallingford, CT 06492, for themselves and for SAMUEL J. ALOISI and
LYNNE H. ALOISI, 62 Bartlett Road, Nantucket, MA 02554, Board of Appeals File No.
015-99, contract purchasers, the Board made the following Decision:
1. Applicants (Aloisi) are seeking relief by SPECIAL PERMIT under Nantucket
Zoning By-Law §139-96(2), (a), (b) and (c) (light manufacturing; storage and
warehousing; and fabrication and assembly of component parts, respectively).
Applicants propose to conduct a landscaping business from the Locus, a vacant lot,
with properly screened outside storage areas and will construct two (2) structures that
would be used for storage purposes related to the business. All dimensional, parking,
loading zone and green space requirements would be met.
The Premises is located at 8 MARBLE WAY (formerly, now known as Bartlett
Road), Assessor's Map 66, Parcels 68.2 and 103, a portion of which shows as Lot 169,
on Exhibit "B". The property is zoned Residential-Commercial-2.
2. The Planning Board recommended approval on the condition that Locus and the
adjacent Lot (Lot 168) share a common driveway. There was one letter in support from
an abutter, Neil Patterson, and one letter in opposition from an abutter, Tommaso
Gioioso.
3. Applicants, through their attorney, represented that Applicant, SAMUEL J.
ALOISI, the Contract Purchaser, wished to operate a landscaping business on this lot.
Applicant stated that his agreement with the Seller requires him to share a common
driveway twenty-five (25) feet in width with Lot 168 (said driveway to be 12.5 feet on
each Lot). Therefore, he shall comply with the Planning Board's recommendation. The
Application and site plan indicate compliance with parking, green space and screening
requirements, and there is no residential use proposed at this time. Applicant also
indicated that there would be no retail sales on said property.
4. THEREFORE, the Board finds that the site plan endorsed by the Board
and appended hereto as Exhibit "A" meets the parking, green space and screening
requirements of the By-law and finds further that:
(a) The property is in a zone where this type of use is contemplated subject
to imposition of reasonable restrictions in the Board's Special Permit
(b) The proposed use will be in harmony with the general purpose and intent
of the Zoning By-Laws.
5. Accordingly, by UNANIMOUS vote, the BOARD GRANTS THE SPECIAL
PERMIT under the Nantucket Zoning By-Law, § 139-9B(2), (a), (b) and (c), allowing
said landscaping business conditioned upon the following:
(a) Any hazardous materials stored on site shall be handled in accordance
with all applicable Federal, State, and local regulations; and
(b) Hours of operation of commercial activity on the premises shall be
between 7:30 A.M. and 6:00 P.M. for work performed outside of buildings;
and
(c) The owner shall plant and maintain a dense vegetative screen around the
perimeter of the commercial use on the premises, substantially as shown
on Exhibit A (appended hereto); and
(d) There shall be no major equipment maintenance on the premises:
(e) The commercial use on the premises shall be limited to a landscape
business, and the use shall not change without further relief from this
Board.
