At a Public Hearing of the Nantucket Zoning Board of Appeals
held at 1:00 P.M., Friday, March 12, 1999, in the Conference Room, Town
and County Building, 37 Washington Street, Nantucket, Massachusetts,
on the Application of MARLIN CAPITAL CORPORATION, TRUSTEE OF INVESTMENT
MANAGEMENT REALTY TRUST FOR ITSELF AND FOR THE MAURY PEOPLE, INC., of
37 Main Street, Nantucket, MA 02554, Board of Appeals File No. 013-99,
the Board made the following Decision:
1. Applicant (Maury People, Inc.) is seeking relief by SPECIAL
PERMIT under Nantucket Zoning By-Law §139-33A to convert 1,229+ square
feet of second-floor space of a said to be pre-existing structure, from
use as a dwelling unit to office space. The first floor of the
structure is currently being used as retail space which would remain
after conversion of the second floor use. Applicant is also seeking
relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-18B(2)(b)
and (3) to waive five (5) of the six (6) required parking spaces, with
one (1) being grandfathered, that are related to the second floor
proposed use, and under §139-20 (loading zone requirements) to the
extent necessary. The Locus is nonconforming as to lot size, having a
lot area of 1,455+ square feet in a district that requires a minimum
lot size of 5,000 square feet; as to frontage having 20.09+ feet of
frontage on Main Street in a district that requires a minimum frontage
of 40 feet; as to setbacks with the structure being sited zero feet
from both the westerly and easterly side yard and northerly rear yard
lot lines in a district that requires a minimum side and rear yard
setback of five (5) feet; as to ground cover, with the Lot containing
94.4+% of ground cover in a district that allows a maximum ground cover
of 50%; and as to parking with the Lot containing no on-site parking
spaces with none planned.
The Premises is located at 37 MAIN STREET, Assessor's Map
42.3.1, Parcel 209, Plan File B-3, Lots 111 - 124. The property is
zoned Residential-Commercial.
2. The Decision is based upon the Application and materials
submitted with it and the testimony and evidence presented at the
hearing. The Planning Board made no recommendation as the matter was
not of planning concern. There were no letterSin the file.
The owner of the abutting property to the east, and Applicant's current
landlord, was represented by counsel at the hearing who expressed
concerns about the impact upon his property. He requested that there be
a 2-hour fire rated door put in the new opening and that if and when
the lease is terminated, the door would be removed and the wall
replaced.
3. Applicant is currently the tenant of the property immediately
abutting the subject Lot to the east. Applicant recently purchased the
Locus and now wishes to construct a common second floor doorway that
would connect the second floors of these adjoining commercial
structures to expand the existing real estate office across the common
lot line. There is currently a retail use on the first floor and a
dwelling unit on the second floor. Applicant proposes to remove the
dwelling unit and create new office space. Applicant's Lot is part of a
series of buildings along the north side of Main Street that share
common walls that have ground cover ratios that well exceed the 50%
allowed under the By-Law and that do not provide parking or loading
zones. No parking or loading zone is provided on site and none can be
created to meet the increased parking requirement with the conversion.
The Lot and structure pre-date the 1972 enactment of the Zoning By-Law,
thus giving it the benefit of grandfathering. With the conversion
there would be no increase in the footprint of the structure. There is
currently only one (1) means of egress to the second floor, an outside
staircase, and the new door would provide a second means of access and
improve the situation relative to safety concerns.
4. Therefore, based upon the foregoing, the Board finds that a
grant of .relief by Special Permit to allow the conversion of the second
floor dwelling unit to office space would not be substantially more
detrimental to the neighborhood than the existing nonconformities. The
Board further finds that the waiver of the additional parking spaces
and loading zone engendered by the conversion would be in harmony with
the general purpose .and intent of the Zoning By-Law and would in fact
be physically impossible to provide and relief would not be contrary to
sound traffic and safety considerations. The Board notes that there has
been substantial precedent set for the granting of relief in the
Downtown area as the provision of parking in this area is extremely
difficult.

5. Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A,
allowing the alteration as proposed, under Nantucket Zoning By-Law
§139-18B(2)(b) and (3), waiving the additional five (5) parking spaces
and under Nantucket Zoning By-Law §139-20, to the extent necessary,
waiving the loading zone requirement, upon the following conditions:
a. A two (2) hour fire rated door shall be installed between
the Locus and the neighboring property to the east at 35 Main Street;
and
b. At such time as Applicant's right to access to the
neighboring property to the east at 35 Main Street shall cease or
otherwise terminate, alternative secondary access must be provided to
the second floor office use upon the Locus, either from an interior
stairway to be constructed upon the Locus or such other on-site means
of access allowable by law/code.
