At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00 p.m.,
Friday, February 5, 1999, in the Conference Room, Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, on the application of LOW TIDE NOMINEE TRUST, of
36'h Cliff Road, Nantucket, Massachusetts 02554, Board of Appeals File No. 012-99, the
Board made the following Decision:
1. The Applicant is seeking a MODIFICATION of a Decision issued in Board of
Appeals File No. 081-94. Applicant proposes to expand the permitted commercial
storage/fabrication building, with the addition of a new office building that would be used in
conjunction with Applicants construction business. Relief would allow the existing storage
building to be increased from 1,143 ± square feet to 3 , 343 ± square feet; construction of the
new 520± square foot office building; and eliminate the previously permitted duplex
dwelling and garage. Ground cover would be increased from 9.2±% to 26.9±% in Zoning
District that allows a maximum ground cover ratio of 50%. All parking, loading zone, and
screening requirements would be met.
The Premises is located at 46 NOBADEER FARM ROAD, Assessor's Map 69,
Parcel 35, Land Court Plan 14342-F, Lot 1. The Property is zoned Residential-Commercial-

2. The Decision is based upon the Application and the material submitted with it
and the testimony and evidence presented at the Hearing. The Planning Board made a
positive recommendation for approval of the Special Permit modification subject to the
incorporation of certain recommended changes to the plans submitted for Site Plan review.
Applicant complied with the Planning Board recommendations and submitted a revised Site
Plan reflecting a loading zone located at the rear of the proposed storage building, the
elimination of two (2) parking spaces from the Nobadeer Farm Road side of the Property and
the addition of screening in the form of chain-link fence and planted privet hedge.
3. The Board made note of the fact that other properties on Nantucket owned by
the Applicant often times were used for storage of materials and on-site trailers. Certain
Board Members stated their disapproval of this storage technique and requested that all
material stored on the Premises either by stored inside or in a registered trailer for a short
term only. Applicant, through Counsel, testified that they did not intend on storing materials
outside. That, in fact, the purpose of the expansion was to provide inside storage of all
materials. However, Applicant, through Counsel, stated that there may be need for outside
storage of materials on a short term basis. In that event, Applicant stated that these materials
would be stored in a Department of Motor Vehicles registered trailer and for a short period
of time only.
4. The Board questioned the Applicant as to the proposed hours of fabrication on-
site. Applicant, through Counsel, testified that the facility would not be used for fabrication
at all on Sundays. Additionally, fabrication on-site on Monday through Saturday would
commence no sooner than 7:00 A.M. and stop no later than 7:00 P.M.

5. Therefore, the Board finds that the MODIFICATION of the existing Special
Permit to allow the expansion of the permitted commercial storage/fabrication building, with
the addition of a new office building that would be used in conjunction with the Applicant's
construction business is not substantially more detrimental to the neighborhood than the
existing specially permitted use and structure and will be in harmony with the general
purpose and intent of the Zoning By-Law.
6. Accordingly, by unanimous vote, the Board GRANTS the requested
MODIFICATION of a Special Permit under Nantucket Zoning By-Law 139-9B(2)(b) and (c)
to expand their permitted commercial storage/fabrication building with the addition of a new
office building that would be used in conjunction with the Applicant's construction business
upon the following conditions:
a) Hours of operation for fabrication will be limited to the hours of 7:00
a.m. to 7:00 p.m. Monday through Saturday with no fabrication on Sunday;
b) There shall be no outside storage of goods and materials;
c) There shall be no long term trailer storage on the Premises. Short term
trailer storage shall be allowed only in trailers duly registered with the
Commonwealth of Massachusetts; and
d) The Project shall be constructed as substantially shown on the Site
Plan, drawn by Nantucket Architecture Group, revised October 19, 1998;
January 28, 1999; and February 2, 1999, and attached hereto as Exhibit "A" .

ADDENDUM "A"
The Applicant, Pamela Duff Killen, Executrix of the Estate of P. Bruce Killen, seeks
a MODIFICATION to Special Permit No. 81-94 to allow for the expansion of an existing
commercial storage/fabrication building, and the construction of a new office building on the
Property. The buildings will be used in connection with the Applicant's carpentry business:
Bruce Killen and Sons, Inc. The Property is located at 46 Nobadeer Farm Road and is zoned
RC-2.
On December 19, 1994, this Board unanimously granted Special Permit No. 81-94 to
the Property under Section 139-9(b)(2)(b) and Section 139-9(b)(2)(c) of the By-law which
allowed the proposed uses and also included a proposed duplex dwelling and garage. The
requested Modification of the Special Permit will allow for the increase in size of the existing
storage building from 1,143 square feet to 3,343 square feet; permit the construction of a
new, 520± square feet office building; and eliminate the formerly proposed duplex dwelling
and garage on the Property.
The Property has an area of approximately 12,405± square feet. The allowable
ground cover is 50 %; the existing ground cover is 9.2 %; and the proposed ground cover is
26.9%. The Property conforms to all Zoning intensity requirements. The Applicant proposes
to provide nine (9) off-street parking spaces and a loading zone in accordance with Section
139-18-20 of the By-law; with appropriate screening and landscaping.
The requested Modification of Special Permit will not be substantially more
detrimental to the neighborhood than the existing use of the Property. In fact, the new
construction will be in harmony with the provisions of Special Permit No. 81-94 and the o

Dear Dirk:
Enclosed for filing on behalf of my client, Pamela Duff Killen,
Executrix of the Estate of P. Bruce Killen and the owner of the property at 46
Nobadeer Farm Road, Nantucket, Massachusetts 02554 is an application to
modify Special Permit No. 81-94 to allow the expansion of the existing
storage/fabrication building on the property and the construction of a free-
standing office. I also enclose copies of the application, addendum, site plan,
locus plan, two (2) sets of mailing labels, certified list of abutters, and a filing
fee check in the sum of $200.00 made payable to the Town of Nantucket.
