At a Public Hearing of the Nantucket Zoning Board of Appeals held at
1:00 p.m., Friday, February 5, 1999, in the Conference Room, Town Annex
Building, 37 Broad Street, Nantucket, Massachusetts, on the Application of
GREGORY AND KATHLEEN CASSIDY, of 139 Hummock Pond Road,
Nantucket, Massachusetts 02554, Board of Appeals File No. 011-99, the Board
made the following Decision:
1. Applicants are seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-Law, Section 139-7D(2). Applicants propose to operate a
public stables on the subject lot for the purposes of giving horseback riding
lessons and boarding of horses. The property is improved with asingle-family
dwelling with a horse barn with an apartment above it.
The Premises is located at 139 HUMMOCK POND ROAD, Assessor's
Map 57, Parcel 14.2, Land Court Plan 33861-0, Lot 37. The property is zoned
Limited-Use-General-2.
2. The Decision is based upon the Application and the material
submitted with it and the testimony and evidence presented at the Hearing. The
Planning Board made a positive recommendation for approval of the SPECIAL
PERMIT subject to submission of site plan and incorporation of a total of six
parking spaces on the Premises. There was one letter in the file expressing
concerns about the number of horses boarded; disposal of waste; rodent and pest
control; hours of operation; noise control; and whether off-site riding lessons
would be allowed. The Board requested and the Applicants submitted a Minor
Site Plan for review.
3. Applicants, through counsel, testified that their intent was to
operate a public stable for the purpose of giving horseback riding lessons and
boarding horses. Applicants testified that the horse barn would have no more than
a total of four stalls. Two of the four stalls would be dedicated to the boarding
of Applicants' horses with the remaining two stalls dedicated to the boarding of
horses for clients. Applicant stated that her riding lessons were given to one or
two children at a time.
4. The Board questioned the Applicant as to her plans for keeping the
stables clean and the disposal of horse manure from the stables. Applicant stated
that she cleaned the stables out on a daily basis. She further stated that the horse
manure was stored on premises and picked up on a weekly basis by a service
dedicated to this sort of waste disposal.
5. The Board questioned the Applicant as to proposed hours of
operations for horseback riding instruction. Applicant stated that she would limit
the hours of operation on Saturday and Sunday to the hours of 10:00 A.M.
through 2:00 P.M. with hours of operation for Monday through Friday from
10:00 A.M. to 5:00 P.M.
6. The Board noted that the Applicants showed a total of six (6)
parking spaces on their submitted Minor Site Plan. The Board found that six (6)
parking spaces were sufficient for the proposed Special Permit use and allowed
dwelling uses.
7. Therefore, the Board fmds that the granting of the SPECIAL
PERMIT request is appropriate because the use of the Premises as a public stable
for the purpose of giving horseback riding instruction and the boarding of horses
is not substantially more detrimental to the neighborhood nod nvironmen~~a~~~ Ct:~

8. Accordingly, by a unanimous vote, ~M~ Board NTS the
requested SPECIAL PERMIT under Nantucket Zoning By-Law 139-7D(2) to
operate a public stables as proposed, upon the following conditions:
(a.) Applicant will arrange for a weekly pick-up and disposal of
horse manure from the public stables; and
(b.) Hours of operation for horseback riding lessons will be
limited to the hours of 10:00 A.M. to 2:00 P.M. Saturday and Sunday and
10:00 A.M. to 5:00 P.M. Monday through Friday.

ADDENDUM
The Applicants, GREGORY CASSIDY and KATHLEEN CASSIDY, seek
a SPECIAL PERMIT pursuant to Section 139-7D(2) of the Nantucket Zoning By-
Law (the "By-Law"). The Applicants are requesting the SPECIAL PERMIT to
own and operate a public stable on their property known and numbered as 139
Hummock Pond Road. The land is improved with asingle-family dwelling and
horse barn with apartment above (the "Premises"). The Premises is located in the
Limited Use General 2 Zoning District.
The Premises consists of a lot of land approximately 80,022 square feet
in size as improved by the two story single-family dwelling and two story horse
barn with apartment above. The lot of land is conforming as to lot size situated
in a zoning district with a minimum lot size of 80,000 square feet. The Premises
is also conforming with respect to minimum frontage, front yard setback, rear and
sideline setbacks and ground cover ratio.
The Applicants propose to operate a public stable for the purpose of giving
horseback riding lessons and the boarding of horses.
The Zoning Board of Appeals may grant this Special Permit request
because the use of the Premises as a private stable for the purpose of giving
horseback riding instruction and the boarding of horses is not substantially more
detrimental to the neighborhood nor the environment, than existing or permitted
alternative uses of the Premises.
The Applicant respectfully requests that the Board vote in favor of the
requested SPECIAL PERMIT.
