MARTIN BOARD OF APPEALS FILE N0. 010-99 Applicant is seeking a MODIFICATION of a Decision issued in Board of Appeals File No. 012-74 in which the Board granted relief to convert a single-family dwelling into a seven (7) room guest house. Applicant proposes to alter the guest house use, known as LaPretite Maison, by segregating the existing dwelling unit on the second floor currently used as the owner's quarters. A kitchen and dormers will be added outside of the required setback areas, with no increase in the footprint, and the existing seven (7) guest rooms will be maintained. Applicant is also seeking relief by SPECIAL PERMIT waiving up to 30% of the five (5) required spaces (in 1974), and a VARIANCE under Nantucket Zoning By-Law §139-18 to waive the rest, to validate, to the extent necessary, the existing parking situation, as none were provided in 1974 on the subject Lot and none are planned. Mooney. ;, ,, Mr. Mooney stated the parcel was situated in an area zoned Resi- dential use (R-I) and that- t-_~,e Nantucket i3y-Law allows the Br3ard :; of Appeals to granta special permit for such a use as requested. ;~ tThe criteria is that the +zse may be allowed if there is no evident ,. . ~. c ~deter~.oration of the surrounding area and the use is generally `, in harmony with the, neighborhood. Mr. Mooney stated the house was purchased in March 1973. ; i The zoning is R-OI•I. Mrs. Martin was -led to believe by meetings. . She made substantial improvements in the property and can now meet all the requirements of the various publics'agencies involved with approving lodging houses. • ~Mr. Mooney staled the petitioner nFeded to operate this business far an income and that the business would he conducted + ~~in a manner that will not disturb the neighborhood. He stated he owns property at 124 Main Street and is familiar with the petitioner's conduct of a rooming; house. He operates a rooming house at 121 Main Street and stated there are other such operation: in that neighborhood. Mr. Russell Heston spoke for the petition stating he is confident that Mrs'. Martin will operate in a manner compatible Ilwith the area. Rev. William $abbitt and Attorney Michael Driscoll also ~+spoke in favor of the petition. ~~ In response to questions from the $oard, Mrs- Martin stated ~~ 1, she intended to rent seven rooms. ~! In opposition appeared: li Mr. Bertram Johnston, stating he appeared for himself and (Mrs. Cady, also present. He stated the Nantucket zoning by-law I~requires guest ho~ises to bP in a residential-commercial zone. ,Mrs. Martin's proposed use is not a non-conforming use. He instated he knows the house has always been a single family residencE i •iand the intended use was clearly an expansion into a lodging i house. ~~ Mr. Alexander Craig stating he supported the statement of ~~ I~Mr. Johnston and that he has no recollection that the petitioner's ~~premises were ever used as a lodging house. He stated if this !exception is made, other owners will pressure for similar uses. In rebuttal,: MT•. Mooney stated the intended use was still ~, subject to other regulations and licenses. T.n response to a I question from the Board, hc9 stated there was adequate on-street i; i! I~ ~' -7- it ,i Ijparking in the area and that persons utilizing this lodging ho se ;i ,;would probably not have automobiles. j~ The opposition waived rebuttal. :j The Chairman read a letter from the Nantucket Planning ;I I~Board opposing: the petition. 'I After due deliberation, and after viewing the premises II {and the area the Board found: I~ II 1. The area is reQidential in character and there are ;lodging houses in the immediate neighborhood. There are also ii rental cottage's in the 'mmediate area. :~ 2.
