At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, January 8, 1999, at 1:00 P.M., in the Conference Room, iri the Town Building Annex, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of ROBERT TALLMAN, JR., as Trustee of THE ROBERT TALLMAN, JR. REVOCABLE LIVING TRUST AGREEMENT, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 008-99: 2. The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-24.A(3)(c), for relief from the year-round occupancy covenant for reasons of personal hardship. A Certificate of Occupancy for the existing dwelling issued on August 18, 1997. The subject property is situated at 4 MAXEY POND ROAD, Assessor's Map 40, Parcel 97, is shown on Land Court Plan 8852-V as Lot 53, and is situated in a Limited Use General-3 zoning district. 3. Our decision is based accompanying materials, and re received at our public hearing. recommendation, on the basis that matter of planning concern. The Applicant and his wife presented information that, after they constructed the subject dwelling as their personal residence, a medical condition of a family member residing on the mainland has progressed in a manner which necessitates their residence in a location from which access to the affected family member is less difficult than from Nantucket. Accordingly, they now intend to sell the subject property and move to the mainland. The Applicant had signed the residency covenant under ~139- 24.A(3) when securing a building permit, and a Certificate of Occupancy was issued on August 18, 1997. Under the by-law provision, the covenant runs for a period of five years following the issuance of a Certificate of Occupancy. 5. X139-24.A(3)(c) provides that the Board of Appeals may grant relief from the terms of such a covenant by Special Permit, after making a finding that strict conformance with the covenant would impose an unreasonable and serious personal or financial hardship upon the owner of the dwelling. 6. Upon the facts presented in this case, the Board of Appeals, by UNANIMOUS vote, made the finding that strict conformance with the covenant would impose an unreasonable and serious personal hardship upon the Applicant, and GRANTED the requested SPECIAL PERMIT.
