DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, January 8, 1999, at 1:00 P.M., in the
Conference Room, in the Town Building Annex, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of MALCOLM LONDON and MARY KAY
LONDON, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office
Box 2669, Nantucket, Massachusetts 02584, File No. 007-99:
2. The Applicants are seeking a MODIFICATION of the Board
of Appeals Decision issued in File No. 021-93, which granted
relief by Special Permit and Variance in connection with
alteration to a pre-existing, nonconforming structure, a lodging
house known as the "Stumble Inne", upon the subject property (the
"Locus") and parking requirements in connection therewith, by
removing the condition that both dwelling units upon the Locus be
limited to use by owners or managers of the lodging house and not
be used for separate rental purposes. The Applicants now propose
to be able to rent the dwelling unit in the free-standing
cottage, to the rear of the main structure, separately, while
continuing to use the dwelling unit in the lodging house building
as an apartment for a resident manager or owner. See also Board
of Appeals File No. 124-86. The Locus is situated at 109 ORANGE
STREET, Assessor's Map 55, Parcel 361, is shown upon plan
recorded with Nantucket Deeds in Plan Book 13, Page 467, and is
situated in a Residential-2 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was negative, unless measures were taken to
.mitigate parking issues. There was no support nor opposition
presented at the public hearing.
4. By the decision in Case No. 124-86, the Board of Appeals
on December 3, 1986, granted a Variance from the parking
requirements of the Zoning By-law to permit the relocation of an
existing single-family dwelling to their lot containing a six-
unit lodging house with a owner/manager's apartment. The
dwelling was a permitted use, but there was no room on the Locus
to provide the required number of parking spaces for these uses
in their totality. Relief was granted subject to the conditions
that three parking spaces be provided, of which two would comply
with the requirements of the Zoning By-law; that the new dwelling
would be limited to use, as a single-family dwelling, by owners
or managers of the lodging house upon the Locus so long as it
exists; and that no additional rental units be created in the
lodging house.
5. By the decision in Case No. 021-93, the Board of Appeals
on May 6, 1993, granted relief by Special Permit to allow the
alteration of the lodging house, and set forth in its decision
the conditions, inter alia, that the three parking spaces (two
conforming) continue to be provided, and that both dwelling units
upon the Locus be limited to use, as single-family dwellings, by
owners or managers of the lodging house so long as it exists.
6. The Applicants now wish to have the condition that the
separate dwelling house upon the Locus be used only by owners or
managers of the lodging house be removed from the zoning relief
which has been granted for the Locus. They represented that the
dwelling was used for family members, but that their family needs
have changed and that it is no longer practical for the dwelling
to be used for their family. They further represented that they
have dealt effectively with parking issues by discouraging
lodging house guests from bringing vehicles to Nantucket, and
presented materials sent to guests to this effect. As a result,
they represented, there has seldom been a need for all three
parking spaces (two legal) which now exist.
7. Accordingly, by UNANIMOUS vote, the Board of Appeals
voted to remove the condition in Files Nos. 124-86 and 021-93
that the separate dwelling house upon the Locus be used only for
owners or managers of the lodging house, a d made no change to
