At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, January 8, 1999, at 1:00 P.M., in the Conference Room, in the Town Building Annex, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of PAUL JUDY, Trustee of S.D. NOMINEE TRUST, Applicant, and PAUL JUDY, Trustee of.,S.D. NOMINEE TRUST, and H. DEBRA LEVIN, Trustee of S.J. NOMINEE TRUST, Owners, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 005-99: 2. The Applicant, as owner of the land shown on Assessor's Map 48 as Parcel 47.1, and being the remainder of Lot 1 on Land Court Plan 36116-A (the "S.D. Lot"), an undersized parcel containing an existing single-family dwelling, with lot area of 55,954± square feet and frontage of 170.13 feet, in a zoning district requiring a minimum lot area of 120,000 square feet and minimum frontage of 200 feet, requests SPECIAL PERMIT relief under Nantucket Zoning By-law §139-33.A(8), for the alteration of a lot said to pre-exist the Nantucket Zoning By-law as a separate nonconforming lot, by acquiring a portion of the abutting land shown on Assessor's Plan 48 as Parcel 48, owned by H. Debra Levin, Trustee of S.J. Nominee Trust, being shown as Lot C on a plan endorsed by the Nantucket Planning Board in File No. 6291, now recorded with Nantucket Deeds in Plan File 54-E ("Lot C"), and merging it with the S.D. Lot. The combined area of the merged parcels would be 66,058± square feet, and frontage would remain unchanged. Accordingly, the existing nonconformities would be reduced and no new nonconformities created. The subject property is situated at 111 SANKATY AVENUE, SIASCONSET, and is zoned as LIMITED USE GENERAL-3. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. There was no support nor opposition presented at the public hearing. 4. As presented to us, the S.D. Lot is a separate improved lot which pre-exists the applicable intensity regulations of the Nantucket Zoning By-law. It abuts a tract of land now owned by the Trustee of S.J. Nominee Trust, which contains excess land over the amount required to maintain its own zoning compliance. The Applicant informs us that S.D. Nominee Trust and S.J. Nominee Trust, and the underlying trusts in which these parcels were formerly held and which are now the respective beneficiaries of these nominee trusts, are separate entities created by different members of the same family and with separate discretionary control, which acquired their respective parcels at different times from different owners, and that these parcels have never been in common control or ownership at any time since the effective date of the Nantucket Zoning By-law in 1972. The Trustee of S.J. Nominee Trust, as owner of the abutting land, is willing to convey to the Applicant a parcel of~land which will increase the size of the Applicant' s lot as set forth above and thus reduce the nonconformities of the present S.D. Lot, and create no new nonconformities, but without achieving compliance for the combined lot with the minimum area and .frontage requirements of the By-law. 5. As authorized by Nantucket Zoning By-law X139-33.A(8), the Board of Appeals made the finding that the proposed change in the size, shape and boundaries of the pre-existing, nonconforming S.D. Lot, by merging Lot C with it, will not be substantially more detrimental than the existing nonconformity to the neighborhood, and that the proposed Special Permit would not create any new nonconformity nor increase any existing nonconformity. Accordingly, by UNANIMOUS vote, the Board of Appeals GRANTED the requested Special Permit to change the boundaries of the S.D. Lot by merging Lot C into it, thus preserving the pre-existing, nonconforming status of the merged lot. A plot plan showing the parcels as so merged is attached hereto as Exhibit A.
