The Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law ~ 139-33.A.(8) to alter and extend a said to be pre-existing, nonconfarrnir.g 7.ot. In the alternative, the Applicants are seeking relief by VARIANCE under Nantucket Zoning By-Iaw §139-16.A to complete the project as proposed. The Applicants own Lots 37 through 44 in Block 19 on Land Court Plar. No. 5004-G (the "Pignato Lots") and wish to acquire Lots 35 and 36 in Block 19 on nand Court Plan Na. 5004-G (the "0&B Lots") from Dennis J. Keller, Trustee of Prange and Black Trust, and combine the 0&B Lots with th.e Pignato Lots. The resulting lot, after the merger, would contain about 20,000 square feet of area and conform to current frontage requirements. The Pignato Lots are nonconforming as to lot size, having total lat area of about 16,000 square feet ir. a district that requires a minimum lot size of 120,000 square feet; and as to frontage, having a frontage of about 160 feet on Ipswich Street, witl^. 200 feet being the minimum required. The property is zoned Limited Use General - 3. 3. our decision is based upon the application and accompanying materials and representations and testimony xeceived at our public hearing. The Planning Board made a positive .recommendation on This application, because the Planning Board supports efforts to reduce nonconforming situations. The Applicants own the Pignato Lots. The Pignato Lots are vacant and merged for zoning purposes and together Constitute a pre-existing nonconforming Iot of record, k~aving been held in owners5ip separate from that of all adjacent lard since a time prior to July, 1972, the effective date of the Nantucket Zoning Hy-law. The Pignato Lots are nonconforming as to current lot area requirements, having total lot area cf about 6,000 square feet, with 120,000 square feet now being the minimum "mot area required. in this LUG~3 zcnir_c district] the Pignato Lots are also nonconforming as to frontage, having frontage of about 160 feet on Ipswich Street, with 200 feet now being the minimum frontage required in this LUG-3 zoning district, 5. The Applicants propose to acquire the 0&3 Lots from Dennis J. Keller, Trustee of Orange and Black Trust and to u^ombine the 0&B Lots with the Pignato Lots. The 0&S Lots are vacant and contain about 4,o0G square feet of land area and have 40 feet of frontage on Ipswich Street. T':e resulting lot, after the merger of the Pignato Lots with the O£~B Lots., wi.1 contain about 20,000 square feet of lot area and will, as a result, be less nonconforming {but will not become canfoxmir:g with current Zoning requixernents} as to lot area. Such rc~sult.ing lot will have frontage of 200 feet on Ipswich Street and will, as a result, be conforming as to the current frontage requirements. 6. The elimination of zoning noz~,conforrnities should be encouraged. In this Case, a nonconforming lot will be made less nonconforming, and two nonconforming lots will become one. The Applicants are eliminating as mar,}~ nonconformities as they possibly can, and they will riot create any new nonconformities or increase any existing ones. Upon these facts, the Board of Appeals finds that the grant of the requested Special Permit rel ieF is ir. harmony with the general purpose and intent of the By-law. The Board further finds that the alteration will not be substantially more detrimental to the neighborhood than the existing nonconformities. 7. In this case, the Beard is dealing with the continuing status of a lot as a pre-existing, nor~conformirg lot and the alteration of such a lot. As a result, the appropriate relief in this matter is a Special Permit pursuant to Hy-law §139-33.A(B}, and this Board need take no action on the Applicants' request for Variance relief.. 8.
