TOWN OF NAN'T'UCKET ZONING BOARD OF APPEALS 37 Washington Street Nantucket, Massachusetts 02554 Assessor's Map 42.3.1 Address: 34 Centre Street Parcel 120 Deed Book 298, Page 272 Zoning District RC Lot 1 Plan Book 16, Page 34 DECISION At a public hearing of the Nantucket Zoning Board of Appeals held at 1:00 p.m., Friday, December 11, 1998, in the Conference Room at the Town Building Annex, 37 Washington St., Nantucket, Massachusetts, the Board made the following decision on the application for relief filed by ROSALIE T. MALONEY, c/o Reade, Gullickson, Hanley & Gifford, LLP, P.O. Box 2669, Nantucket, MA 02584, ZBA File No. 122-98: 1. The Applicant requests a MODIFICATION of the SPECIAL PERMIT issued by the Zoning Board of Appeals in Case No. 067-96, which granted relief from parking and loading space requirements for the conversion of the second level of an existing structure from guest rooms to a retail space, by removing the condition that the retail use on that level be limited to one unit. The applicant proposes dividing the retail space on the second level into two separate retail spaces within the same area now used. The proposal contemplates no changes to the structure's existing dimensional nonconformities. 2. The Board's decision is based upon the application and accompanying materials, and representations and testimony received at the above referenced public hearings. The Planning Board viewed the application as not of Planning Board concern. The file contains no letters either supporting or opposing the application. 3. The building upon the locus, which has been the subject of prior relief granted by the Zoning Board of Appeals in Case Nos. 067-96, 080-95, 042-85, and 030-83, has three levels: the lower floor or basement, the first or main floor, and the second or top floor. To avoid confusion, this decision shall refer to these floors as the first level, the second level, and the third level, respectively. In Case No. 080-95, the Board permitted the applicant to convert the first level to retail space, conditioning the permit on the applicant maintaining the space as a single retail space. In Case No. 067-96, we permitted the conversion of the second level from use as a rooming house to retail space, but again conditioning the permit on "there not being more than one retail establishment upon the second level of the building." By these two decisions, the Board permitted two retail establishments in the building. Applicant now seeks to amend Case No. 067-96, to delete the restriction, permitting a second retail establishment on the second level, thereby increasing the retail establishments on the premises to three. In Case No. 067-96, the applicant represented that the change in use on the second level would increase parking requirements from 13 (all of which had been waived previously) to 15. In granting the .~ proposed relief in Case No. 067-96, the Board waived all parking and loading requirements connected with the change in use. 4. Through counsel, the applicant represents that the change in use from one retail space to two retail spaces would not change the parking calculations and therefore required no further parking waivers. 5. After due consideration of the application and accompanying materials, and representations and testimony received at the public hearing, athree-person majority of the Board finds that the change in use from one to two retail spaces on the second level would not adversely increase the intensity of use of the subject structure or be substantially more detrimental to the already highly trafficked commercial neighborhood. Atwo-person minority of the Board finds the opposite: that said conversion would - adversely increase the intensity of use and be substantially more detrimental to the - ~ neighborhood. 6. Upon a motion made by William Hourihan and seconded by Linda Williams to grant the relief as requested, the motion failed (William P. Hourihan, Jr., Michael J. O'Mara, and Linda F.
