At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1:00 P.M., Friday, November 20, 1998, in the Conference Room, Town
Annex, 37 Washington Street, Nantucket, Massachusetts, on the Application
of RICHARD J. GLIDDEN, TRUSTEE OF 8 QUINCE STREET REALTY TRUST, c/o
Glidden & Glidden, P.C., P.O. Box 1079, Nantucket, MA 02554, Board of
Appeals File No. 111-98, the Board made the following Decision:
1. Applicant is seeking relief by VARIANCE from the Intensity
Regulations of Nantucket Zoning By-Law §139-16A (minimum lot size/ground
cover ration/setbacks). Applicant is asking this Board to validate the
Locus, and structure with decks contained therein, as separately
marketable from adjacent lands. The subject Lot was created by a 1974
Approval-Not-Required plan which divided the tract of land into two (2)
lots, one (1) of which (the Locus) was undersized, containing 2464+
square-feet of lot area in a district that requires a minimum lot size of
5,000 square feet. The Locus is also nonconforming as to ground cover,
with the Lot containing a ground cover ratio of about 39.5/ in a district
that allows a maximum ground cover ratio of 30/ for undersized lots; and
as to side yard setback with two (2) sets of steps on the easterly side of
the single-family dwelling being sited about 4.0 feet at their closest
points from the easterly side yard lot line, one (1) set also being sited
less than five (5) feet at its closest point from the rear yard lot line
(with two (2) gas tanks also being sited at zero feet from the rear yard
lot line), in a district that requires a minimum side and rear yard
setback of five (5) feet. See also BOA File No. 003-85.
The Premises is located at 8 QUINCE STREET, Assessor's Map 42.3.4,
Parcel 63, Plan Book 18, Page 144, Lot 1. The property is zoned
Residential-Old-Historic.
2. The Decision is based upon the Application and materials submitted
with it and the testimony and evidence presented at the Hearing. The
Planning Board made no recommendation as the matter was not of planning
concern. There were no letters on file and one (1) abutter was present at
the Hearing to speak in favor of the Application.
3. As presented by the Applicant, the single-family dwelling upon the
Locus was one (1) of two (2) buildings pre-existing the 1955 applicable
date of the Subdivision Control Law in Nantucket and the 1972 applicable
date of the Nantucket Zoning By-Law, situate upon a single tract of land.
In 1974, the then-owner of the tract and buildings thereon caused a plan
to be prepared, endorsed by the Nantucket Planning Board as not requiring
approval under the Subdivision Control Law and filed with the Nantucket
Registry of Deeds in Plan Book 18, Page 144. While this Lot had adequate
frontage to comply with the Zoning By-Law, it was nonconforming as to lot
area, having only about 2,464 square feet in a zone requiring a minimum of
5,000 square feet. Applicant represented that the plan was endorsed by the
Planning Board on the basis that all of the lots contained pre-1955
structures and thus the plan was exempted from the definition of
"subdivision" under the Subdivision Control Law. Tom and Anne Sollas, the
beneficial owners of 8 Quince Street Realty Trust, purchased the property
in 1984 and in 1992 transferred the property into a realty trust which is
where the title stands today. Meanwhile, subsequent case law and Nantucket
practise has made it clear that the exemption of lots so created from the
definition of "subdivision' does not exempt such lots from the provisions
of the Zoning By-Law including area, ground cover, and setback
requirements. Accordingly, the Applicant requests relief by Variance in
order to confirm the validity of the Locus as a separately marketable lot
from all adjacent parcels of land for zoning purposes and validate the
existing footprint and siting of the single-family dwelling with decks and
steps. The Sollas' applied to this Board, BOA Application File No. 003-85,
for an addition onto the structure and was denied such relief. Unlike in
that Application, there are no alterations or extensions of the structure
on the subject Lot contemplated here.
4. Therefore, based upon the status of the Locus as containing a
pre-zoning structure, the Board of Appeals finds that the grant of the
requested Variance would not constitute a substantial detriment to the
public good and would not nullify or substantially derogate from the
intent or purpose of the Zoning By-Law. The Board further finds that
owing to circumstances relating to the shape and topography of the Locus
and structure contained thereon, and especially affecting the Locus but
not affecting generally the zoning district in which it is situated, a
literal enforcement of the provisions of the Zoning By-Law would involve
substantial hardship to the Applicant, there being no immediate remedy
available to the Applicant to cure the lot size, ground cover or setback
issues.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
VARIANCE under Nantucket Zoning By-Law §19-16A to validate the Lot, as
presently configured, as separately marketable from all adjacent property
and further validates the siting and footprint of the existing
single-family dwelling with decks and steps, upon the following condition:
a. Any change in the use of the structure or expansion of the
structure shall not be undertaken without first receiving approval from
the Board of Appeals.

The applicant requests a variance from the minimum lot area and
ground cover ratio requirements set forth in the Intensity
Regulations of the Nantucket Zoning By-law, X139-16.A, to cure a
marketability issue created by the 1974 approval-not--required
plan which divided the tract of land which then included the
locus into two lots, one of which (the locus) was undersized,
containing 2464 square feet in a zoning district which then (as
now) required minimum lot area of 5,000 square feet, and the
subsequent conveyance of the locus ~.nto separate ownership, in
which it remains today. The building upon the locus, which pre-
exists the 1972 adoption of the Nantucket Zoning B ylaw, has
ground cover of about 982 square feet, for a ground cover ratio
of about 39.5; maximum ground cover for an undersized lot is
30~. The applicant requests that the present. status of the locus
and the structure thereon be validated by variance relief to
enable the locus to be conveyed as a separate lot and the present
structure thereon to remain.
