Parcel 53 Land Court Plan 40314-B Zoning District LUG-2 Lot 1 Certificate of Title 9616 DECISION At a public hearing of the Nantucket Zoning Board of Appeals held at 1:00 p.m., Friday, November 20, 1998, continued to December 11, 1998, January 8, 1999, and then to February 5, 1999, in the Conference Room at the Town Building Annex, 37 Washington St., Nantucket, Massachusetts, the Board made the following decision on the application for relief filed by JOHN B. MCELDERRY, JR., and MARY E. MCELDERRY, c/o Theodore L. Tillotson, P.C. P.O. Box 1530, Nantucket, MA 02554, ZBA File No. 104-98: 1. The Applicants seek a SPECIAL PERMIT under Nantucket Zoning Bylaw § 139- 33A(8) in order to change asaid-to-be-preexisting lot containing 8.64f acres, improved with asingle-family dwelling, which lot is said to have access to Cliff Road over Capaum Pond Road, which bisects the premises. The applicants propose dividing the lot into two lots containing 5.02 acres (Lot 1) and 3.62 acres (Lot 2) with the division line running along Capaum Pond Road. Applicant propose merging the newly created Lot 2 with what is labeled Lot 3 in the draft ANR plan prepared by Nantucket Surveyors, Inc. for John B. McElderry, Jr., attached as part of the application and appended to this decision as Exhibit A, a 3.20 acre lot to the east of Lot 2, fronting on Cliff Road. In the alternative, the applicants seek a variance from the intensity regulations of Nantucket zoning bylaw X139-16A. 2. The Board's decision is based upon the application and accompanying materials, and representations and testimony received at the above referenced public hearings. The Planning Board recommended that the Zoning Board of Appeals deny the requested variance. The Planning Board further recommended that any decision on the special permit be held in abeyance pending submission of the subdivision plan to the Planning Board, noting that it reserves the right to label Lot 1 as not buildable under zoning because it contains no legal frontage. The Planning Board advised that it has "consistently found that 9-foot wide Capaum Pond Road does not have `sufficient width, suitable grades and adequate construction to provide for the needs of vehicular traffic .. . in regard to the creation of new lots along this pre-1955 way ...." The file contains one letter to the Board from an abutter opposing the grant of any relief. 3. Through counsel, the applicants represent that the 8.64 acre lot has been held as a single parcel of land since 1839, well before the 1972 introduction of zoning to Nantucket. The parcel was conveyed to R. Draper Richards in 1913; Richards thereafter registered the land. Applicants further maintain that in 1979, Mr. Richards recorded a copy of registration plan no. 40314A which failed to show the 100 ft. by 100 ft. parcel representing Tristram Coffin's homestead, located in the middle of the property alongside the way known as Capaum Pond Road. Consequently, according to the applicants, Mr. Richards caused plan 40314B to be prepared and recorded, formally recording that small parcel. Applicant represents that the 100 ft. by 100 ft. parcel is the property of the Nantucket Historical Association. The Planning Board endorsed ANR plan 40314B with the notation that neither the large parcel (the undivided 8.42 acre parcel at issue in the instant case) nor the small 100 ft. by 100 ft. lot containing Tristram Coffin's homestead had sufficient frontage to comply with present (1981) zoning requirements. The applicants also represented that the 8.42 acre lot they seek to subdivide, although nonconforming to the extent it has no legal frontage, has not merged with the 3.20 acre lot fronting on Cliff Road (identified as Lot 3 in the draft ANR plan appended as Exhibit A_) because the two lots are and have~been in separate ownership and control. The former is owned by John B. McElderry and his wife Mary E. McElderry in common; the latter is held solely by Mary E. McElderry individually. 4. Through single counsel, several abutters spoke in opposition to the special permit, arguing that a variance would be required based on merger of the two parcels, due to joint ownership and control. The opponents argued, further, that a variance is inappropriate given the circumstance underlying the application, where subdivision of the now- conforming merged property would result in the creation of a newly nonconforming lot. j. The Board finds that the two properties have not merged because, although Mary McElderry holds an interest in both, her ownership in the subject property is only partial and does not establish the joint ownership or control required to merge the two properties by law. The Board finds, additionally, that the 1979 recording of Tristram Coffin's homestead did not subdivide the subject property in a manner that would lead it to lose its "grandfathered" status. The Board further finds that subdividing the subject property and merging the newly created Lot 2 with Lot 3 to the east, as proposed in the draft subdivision plan making up part of this application, will not be substantially more detrimental than the existing nonconformity to the neighborhood and that no new nonconformity will be created nor any existing nonconformity be increased. Two lots (a lot with conforming frontage and a lot without) presently exist absent the proposed subdivision; two lots (a lot with conforming frontage and a lot without) would exist after the proposed subdivision. 6. Accordingly, the Board unanimously votes to GRANT a SPECIAL PERMIT allowing the subdivision of the subject property on the condition that, as represented in the draft ANR plan submitted as part of this application and appended hereon as Exhibit A, the newly created Lot 2 merges with Lot 3.
