DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on
Friday, January 12, 2001, at 1:00 P.M., in the Conference Room in the Town
Annex Building, 37 Washington Street, Nantucket, Massachusetts ,the Board
made the following decision on the application (090-00) of JOHN BUTLER
DAVIS, ANNE S. DAVIS, LAURA BUTLER DAVIS AND EMILIE LENORE
DAVIS of 553 Bridgeview Drive, Lemoyne, PA 17043, in connection with
property known as 19 Massachusetts Avenue, Nantucket, Massachusetts.
2. Applicants are seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-33A (alteration/expansion of a pre-
existing nonconforming structure/use). applicants propose to expand asingle-
family dwelling by constructing asingle-story addition and deck onto the
northeasterly side of the structure. A portion of the garage space closest to
Massachusetts Avenue would. be converted to living space without any change
in the footprint or elevation. The proposed addition on the northeasterly end of
the structure would add about 250 square feet of ground cover, increasing the
ratio from about 16.2% to about 18.6% (from about 1756 square feet to about 2006
square feet). The proposed deck would surround the new sunroom addition and
be built within the required ten-foot side yard setback area, but would be no
closer to the southeasterly lot line than the adjacent portion of the existing house,
which is sited about 3.5 feet from the lot line. In the alternative, or to the extent
necessary, Applicants are also seeking relief by VARIANCE under Nantucket
By-law Section 139-16A to complete the project as proposed. The Locus is
nonconforming as to lot size with the combined Lot containing about 10,840
square feet; as to ground cover ratio with the Lot containing about 16.2% of
ground cover ratio (or about 1756 square feet) in a district that allows a
maximum ,ground cover ratio of 12.5% or 1500 square feet; as to frontage with
the Lot having a bout 50 feet along Massachusetts Avenue in a district that
requires a minimum frontage of 75 feet; as to front yard setback with the
structure being sited closer than 30 feet which is the minimum required in this
district; and as to side yard setback with the structure being sited closer than the
required minimum of ten (10) feet. The Premises is located at 19
MASSACHUSETTS AVENUE, Assessor's Map 60.3.1, Parce1313 and Map 60,
Parcel 4, Land Court Plan 2408-7, Lots 4 and 5, and land described in Deed Book
368, Page 37. The property is zoned Residential-2.
3. Our decision is based upon the application and accompanying
materials, and representations and testimony received at our public hearings on
November 17, 2000, December 8, 2000 and January 12, 2001. The Planning Board
made no recommendation finding that the application did not present issues of
planning concern. One letter from a neighbor in support of the application and
one letter in opposition were received at the hearing.
4. The as-built plot plan prepared by Nantucket Surveyors, Inc. dated
November 10, 2000, a copy of which is attached as Exhibit A, shows the existing
structure containing approximately 1715 square feet with a resulting existing
ground cover ratio for the merged parcels of 16.5 %±. The three lots which
comprise this parcel (Lots 4 and 5 in Block 29 on Land Court Plan 2408Y and the
unregistered land shown in the Assessor's records on Map 60 as parcel 4) have
been permanently merged into a single parcel currently containing
approximately 10,381 square feet of area (according to Exhibit A) for zoning
purposes by a Covenant registered with the Nantucket Registry as Document
No. 31260. The existing building has a Certificate of Occupancy from the
Building Department. The Building Department records reveal that a prior
owner of the property added a 222 square foot addition containing a
handicapped accessible bathroom to the structure in 1985 without zoning relief.
The current structure exceeds permitted ground cover in this zoning district
(which on this lot would be 1,500 square feet of structure), but is protected
against forced removal by state law under M.G.L. Chapter 40A, Section 7,
because more than 6 years have elapsed since the issuance of the Certificate of
Occupancy for the expanded footprint. Additional parking for this property is
situated on an adjacent property as shown on Exhibit A.
5. The Board finds that the additional ground cover was constructed
in reliance on Building Permit No. 3833-85, and that the structure received a
Certificate of Occupancy (No.130-91 and 3833-91) for that work prior to its
purchase by the Applicants. Given this history, the Board finds that any increase
in the ground cover on the property must be by variance and not by special
permit. To refuse to recognize the existing structure's zoning integrity at this
point in time would create a substantial hardship for the Applicant, who
acquired the property ten years ago in its current configuration and acted in
good faith throughout. The situation and facts presented do not generally affect
the zoning district but rather are uniquely related to the undersized nature of the
merged parcels, its eroding shoreline, and the history of construction on this lot.
The Board also finds, based on the information presented at the hearing, that the

validation of the existing structure by variance relief is without detriment to the
public good or derogation from the By-law.
6. However, the Board can not find that the relief requested from the
ground cover limitations for the 250 square foot sunroom addition meets the
Zoning By-law's requirement that variance relief be granted only when the
failure to grant relief would create a "substantial hardship, financial or
otherwise" for the Applicants. The Board has no objection, and specifically
hereby permits, the addition of an unenclosed porch in the proposed sunroom
location should the Applicants choose to construct such a porch in the future,
provided such porch is not situated within the setback, is constructed so as not to
be considered toward the ground cover as defined in the Zoning By-law.
7. The Applicants also propose (a) to renovate the existing structure
by converting an existing garage/ storage area into living space without
increasing the existing footprint or ground cover, which portion of the existing
structure lies less than 2 feet from the easterly property line as shown on the plan
entitled "ZBA Site Plan" prepared by Nantucket Surveyors, Inc., dated Nov. 10,
2000 and attached hereto as Exhibit B ,and (b) to construct a deck on the harbor
side of the existing structure as shown on said plan, which deck will be located
no closer than 3.5 feet from the easterly property line. The existing structure is
1.3 feet from the property line on the easterly side at its closest point, and 3.5 feet
from the property line on the northern end of the building. The new deck will
therefore be no closer to the property line than the existing dwelling. The Board
finds that these minor alterations to the existing non-conforming structure will
not be substantially more detrimental to the neighborhood than the existing non-
conformities.
8. Therefore, the Board of Appeals voted UNANIMOUSLY to grant
(a) the requested VARIANCE under Section 139-16Ato confirm and validate the
existing structure on the site notwithstanding its approximately 1715 square feet
of ground cover, finding that owing to circumstances relating to the shape and
topography of the Locus and the structures thereon, and especially affecting the
Locus but not affecting generally the zoning district in which it is situated, a
literal enforcement of the provisions of the Zoning By-law would involve
substantial hardship to the Applicants, and that desirable relief may be granted
without substantial detriment to the public good and without nullifying or
substantially derogating from the intent or purpose of the Zoning By-law, and
(b) the requested SPECIAL PERMIT under Section 139-33A to renovate the
interior of the existing structure so as to convert garage/ storage space to
dwelling use without expanding the existing footprint or the total ground cover,
and to construct a deck, both within the required setbacks as shown on Exhibit B.
In addition, the Board of Appeals voted UNANIMOUSLY to deny the requested

VARIANCE under Section 139-16A to allow the construction of the 250 square
foot sunroom addition shown on Exhibit B.

Davis Application

The Applicant is seeking a Special Permit under Section 139-33A, to
permit the expansion of an existing single-family dwelling located at 19
Massachusetts Avenue by the addition of a one story sunroom addition and a
deck on the northeasterly side of the building as shown on the attached site plan
from MWP Residential Design. The existing structure is shown on the plan
prepared by Nantucket Surveyors, Inc. (a copy of which is also attached). The
existing structure has a ground cover ratio of 16.2% and at its closest point is 1.3
feet from the southeasterly property line. The portion of the structure closest to
Massachusetts Avenue will be converted to living space without any change in
footprint or elevation, as shown on the plan. The proposed sunroom addition on
the northeasterly end of the building will add approximately 250 square feet of
ground cover, bringing the ground cover ratio to approximately 18.5%. The
proposed deck will surround the new sunroom addition and built within the 10
foot side yard setback, but will be no closer to the southeasterly property line
than the adjacent portion of the existing house (approximately 3.5 feet from the
southeasterly property line).
