At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, October 13, 2000, at 1:00 P.M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of MARLIN MILLER, JR., c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 082-00: 2. The applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law X139-33.A (5) (alteration and expansion of a pre-existing, nonconforming structure or use by extension within a required setback area without increasing the nonconforming setback distance). The applicant proposes to alter and extend an accessory garage structure, constructed in 1975, that is sited at about 2.7 feet from the front lot line along the easterly side line of Highland Road, by constructing an addition to the northerly side of the structure, to be sited no closer than 14 feet from the same front lot line at its closest point. Front yard setback of 30 feet is required in this zoning district. The subject property (the "Locus") is conforming with all other applicable zoning requirements. The Locus is situated at 68 QUIDNET ROAD, Assessor's Map 21, Parcels 62, 97 and 113, consists of three parcels, one shown on Land Court Plan 8606-F as Lot 20B and two shown on Land Court Plan 8606-E as Lots 22A and 24A, and is situated in a Residential-2 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board determined that this application presented no matters of planning concern and made no recommendation. There was no support (except for the presentation by the applicant's representative) nor opposition presented at the public hearing. 4. The applicant proposes to alter and extend a garage structure, constructed in 1975 pursuant to Building Permit No. 242-75. At the time of construction, the Locus was situated in a Residential-1 zoning district, in which there was at that time no minimum front yard setback requirement; accordingly, the garage, situated about 2.7 feet from the front lot line along Highland Avenue, was conforming with applicable zoning requirements at the time of its construction. When the Locus was rezoned in 1978 and placed in a Residential-2 zoning district, where minimum front yard setback of 30 feet is now required, the garage became a pre- existing, nonconforming structure, as to the front yard setback requirement. The proposed addition will have a setback of about 14 feet from the front lot line along Highland Avenue, and accordingly the garage is being .extended within the required setback area without increasing the nonconforming setback distance. Under Nantucket Zoning By-law X139-33.A(5), relief may be granted by Special Permit in this situation, provided that the proposed extension will not be substantially more detrimental to the neighborhood than the existing nonconformity. 5. The proposed expansion of the applicant's garage will not extend further into the front yard setback area than the existing grandfathered structure, and no opposition from the neighborhood was received.
