FOX, of P.O. Box 234, Siasconset, MA 02564, Board of Appeals File No. 079-00, the Board made the following Decision: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-16C(1) to reduce the side yard setback distance from ten (10) feet to five (5 ) feet to validate a northerly side yard setback intrusion of an entryway stoop, on a secondary dwelling, that is sited at about 7.5 feet at its closest point from that lot line in a district that requires a minimum side yard setback of distance often (10) feet. Said dwelling meets all other dimensional zoning requirements. The Locus is nonconforming as to lot size with the Lot containing about 11,896 square feet of area in a district that requires a minimum lot size of 20,000 square feet; and as to front yard setback with the principal single-family dwelling being sited at about 27.4 feet at its closest point from `Sconset Avenue in a district that requires a minimum setback of 30 feet. See also BOA File No. 037-91. The Premises is located at 14 SCONSET AVENUE, SIASCONSET, Assessor's Map 49.3.2, Parcel 24, Land Court Plan 41016-A, Lot 1. The property is zoned Residential-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters in opposition on file and no opposition expressed at the hearing. 3. Applicant represented that when he constructed his secondary dwelling, he took particular care to site the structure outside ofthe ten-foot required side yard setback area from Sconset Avenue, while maintaining the 12-foot scalar separation from the principal dwelling as required under the Zoning Bylaw. He had received Special Permit relief in the Decision issued in BOA 1~ile No. 037-91 to validate the sitting of the principal dwelling within the front yard setback area under Zoning Bylaw Section 139-16C(2). The finished wall of the secondary dwelling meets the ten-foot setback requirement but the front entryway stoop is sited at about 7.5 feet from the northerly lot line. Applicant further represented that he had planned to keep the building foundation lower to the ground, not requiring this type of stoop, but was forced to raise the structure to 15" in order to eliminate a possible drainage problem, which in turn would not allow for a landscape element to provide adequate access. The entryway was shielded from the street by a large mature hedge. The structure meets all other dimensional zoning requirements and the required two (2) parking spaces are provided on site. 4. Therefore, the Board finds that the encroachment into the ten-foot required side yard setback area was unintentional and relief could be granted to reduce the side yard setback area to validate the stoop, without derogating from the general purpose and intent of the Zoning Bylaw. Relief maybe granted by Special Permit in the Residential 2 and Residentia110 zoning district to reduce the setback requirement from ten (10) feet to five (5) feet. This Board has seen several cases over the years involving similar errors in which the finished wall of a structure meets the setback requirements but the entryway stoops were not allowed for in the initial sitting to be able to meet the requirements upon completion of the project. Applicant stated that he had even hired a surveyor to site the subject structure and still a mistake was made. The Board further finds that there would be no public benefit in requiring the Applicant to remove the offending stairs and in fact would deprive the Applicant of primary access to the structure. 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-16C(1) to validate the current sitting of the structure, with the entryway stoop being located within the northerly side yard setback area, by reducing the side yard setback requirement from ten (10) feet to about 7.5 feet upon the following conditions: a. There shall be no fiuther construction within the required 10-foot northerly side yard setback area without further relief from this Board; and b. The sitting of the structure shall be in substantial conformance with the plan submitted, noted as "Mortgage Inspection Plan", dated December 8, 1997, done by Richard K Earle of Nantucket Surveyors, Inc., marked as ExhibiC A and attached hereto. Y. 10025, Board of Appeals File No. 037-91, the Board made the following DECISION: 1. Applicant is seeking a Special Permit under Section 139- 16C(2) of the Zoning Bylaw to validate an unintentional front yard setback intrusion of less than five (5) feet into the required thirty (30) foot setback from Sconset Avenue resulting from the construction of a four (4) foot wide deck on that side of the structure. The building was constructed in 1989 and received a Certificate of Occupancy. The premises are located at 14 SCONSET AVENUE, Assessor's Map 49.3.2, parcel 24, as shown on Land Court Plan 41,016A, Lot 1. The property is zoned R-2. 2. Our decision is based upon the application and documents filed therewith, the testimony and evidence presented at the hearing, letters in support of the application from abutters, no letters or testimony in opposition, and a favorable recommendation from the Planning Board. 3. The Applicant presented evidence that the plot plan submitted to the Building Department, upon which issuance of the Certificate of Occupancy was based, was, in turn, based upon a mortgage plot plan done before the deck was constructed and showed no zoning violation, and the applicant was assured by his builder that the building would comply fully with all applicable zoning requirements when constructed according to the plans originally submitted to obtain the Building Permit, which showed the deck. 4. At the time the Certificate of Occupancy was issued, structures were required to meet the front yard setback requirement from one street only, and the building does meet that --=- distance on one side. 5. The building was sited by the contractor in the present location in order to align with other structures on the same street. 6. The Board finds that the intrusion in to the setback was unintentional, is not greater than five (5) feet nor closer than four (4) feet from a lot line, and that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion. 7. The Board, by unanimous vote, GRANTS the Special Permit requested under §139-16C(2) of the Zoning Bylaw to validate the setback intrusion up to three (3) feet into the required setback from Sconset Avenue with the following condition: A. no further building shall be permitt within the setback without modifica 'o o th' pecial Permit.
