1. Applicant is .seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw

Applicant proposes to alter and extend a .single-family slkvslling b3~ cQnstnu~ing a secun-d

interior living .space. The addition would come no .closer to the northeasterly .side yard lot
line than the existing structure and would raise the roof ridge height fromabout 12 feat to
a maximum of about 24 feet. There would also be no increase in ground cover ratio and
parking would continue to be provided on site. The Locus is nonconforming as to lot size
with the Lot containing about 3,987 square feet of area in a district that requires a
minimum lot size of 5,000 square feet; as to side yard setback with the structure being
sited at less than the required five-feet for structures in the ROH zoning district; and as to
ground cover ratio with the Lot containing in excess of the maximum ground cover ratio
allowed for subminimum lots of 30%.
The Premises is located at 1 COO?tiT STF-EET, Assessor's Map 55.1.4, Parcel 100,
Plan Book 18, Page 21, Lot 1. The property is zoned Residential-Old-Historic.
2. The Decision is based upon the Application and materials submitted with it and
the testimony and evidence presented at the hearing. The Planning Board made no
recommendation as the matter was not of planning concern- There were no letters in
opposition on file and no opposition expressed at the hearing.
3. Applicant represented that he wished to expand the rear one-story portion of the
single-family dwelling in order to provide more living space. The second floor addition
would not come any closer to the northeasterly side yard lot line than the existing
structure which is sited closer than three (3) feet to that lot line, as it would consist of a
dormer addition sited at its closest point at three (3) feet, extending into the interior of the
Lot away from that lot line. There would be no increase in ground cover ratio. The
structure had been built prior to the 1972 enactment ofthe Zoning Bylaw. The subject
Lot had been part of a larger lot which had been subdivided in an ANR plan on June 7,
972 just prior to the August ratification of the Nantucket Zoning Bylaw, at a time when
there were no setback requirements, thus making the Lot and structure grandfathered.
The required parking space is currently provided on site and would continue to be
provided.
4. Therefore, the Board finds that the construction of the second-story addition as
proposed would not be substantially more detrimental to the neighborhood than the
existing nonconforming situation. The Board also finds that there would be little impact
upon the neighborhood as the dormer would be sited to the rear of the structure and sited
so as to be further away from the northeasterly side yard lot line than the existing
structure.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief
by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-33A to allow the
addition to be constructed as proposed, raising the roof ridge height to no more than 24
feet and no closer than three (3) feet to the northeasterly side yard lot line.
