Alger, P.C., Two Union Street, Nantucket, Massachusetts 02559, File No. 075-00: 1. Applicants are seeking relief by VARIANCE under Nantucket Zoning By-law (the "Ry-law") Section 139-16A (Intensity Regulations - ground cover ratio) to validate a r_otal ground cover of about 2,151 square feet, corleisting of about 1,.525 square feet for the principal dwelling unit and about 626 square feet for the garage, including a secondary dwelling, which total ground cover is about 32 square feet more than the approximate 2,139 square feet allowed under current zoning. The Locus is nonconforming as to lot area, containing about 71,301 square feet of land ar.Pa where a minimum lot size of 120,000 square feet is required; as to frontage, having about 20.39 feet of frontage along Wauwinet Road where minimum frontage of 200 feet is required; as to ground cover ratio, having a ground cover ratio of about 3.0168$ where a maximum ground cover ratio of 3$ is permitted; and as to the regularity factor. The Premises are located at 17 WAUWINET ROAD, Assessor's Map 20, Parcels 37, 38 and 39, Land Court Plan 6283-N, Lot 23, Land Court. Plan 62B3-R, Lots 28 and 29. The property ie Zoned Limited-Use-General-3. 2. Our decision is based upon the application and accompanyirry materials, and representations and testimony received at our public hearing. The Planning Board indicated that this matter was not of planning concern. There was rio opposition presented at the public hearing, personally, by representatives, or in writing. 3. The Locus is located in a Limited-iJse-General-3 zoning district and is a preexisting, nonconforming lot. It is pre- existing, nonconforming ae to lot area, containing about 71,301 square feet of land area where a minimum lot size of 120,000 square felt is reyuiLetl; ae to frontage, having about 20.39 feet of frontage along Wauwinet Road wtiez~e minimum frontage of 200 feet is required; and as to regularity factor. The Locus is also nonconforming ae to ground cover, but this nonconform~.r.y is not pre-existing, hence this request for relief. The maximum permitted ground cover ratio in this zoning district is 3~ or SENT BY: SARAH F ALGER PC; 508 228 8UO4; NUV-y-uu ~i::~d; rN~t ~i4 about 2,139 square feet, and the Locus has total ground cover of about 2,151 square feet or a total ground cover ratio of about 3.0168. 4. The Locus was improved by a single-family dwelling and a garage in or about 1975 pursuant to Permits Nas. 139-75 and 140- 75, In or about 1992 and 1993, the Applicant re-shingled and replaced a deck and converted a portion of the existing garage to a secondary dwelling and constructed a deck and stairway pursuant to Permits Nos. 9078-92 and 10492-93• Ae so improved, under the 1992 By-law, which included bulkheads in the ground cover calculation, the Locus had total ground cover of about 1,819 square feet measured to the cornerboards, consisting of abolrr_ 1,193 square feet for the dwelling, and about 626 square feet for the garage. Undex an interpretation of the By-law that was commonly used at that time, ground covet- was often measured to the foundation wall (and not to the cornerboards). Under t}iis interpretation, the Locus had total ground cover of about 1,789 square feet, consisting of about 1,174 square feet for the dwelling, and about 615 square feet for the garage. Using either measurement, the Locus, as so improved, was in conformity with the ground cover requirements of the By-law. 5. Iri 1998, the Applicants applied fox a building permit to construct an addition to their existir-y siiiyle-family dwelling, and Permit No. 119-98 was issued. It appears Ghat the lot area of the Locus was miscalculated and overestimated when the addition was designed, perhaps because the Locus is registered land, and as a result, the lot area is not shown on the record plan. It also appears from the permit application that the ground cover of the existing structures and the proposed addition was calculated measuring to the foundation walla and not to the cornerboards as now required. The permit application shows total proposed ground cover of about 2,120 square feet and total allowable ground cover of about 2,139 square feet. Due to triis series of inadvertent errors, the total ground cover ratio of the Locus as so improved, using the 2000 By-law, which excluded bulkheads from the ground cover calculation, and measuring to the cornerboards, the Locus had total ground cover of about 2,151.2 square feet, consisting of about 1,524.9 square feet for the dwelling (about 1,135.5 square feet for the dwelling ag it existed prior to the 1998 addition and about 389.4 square feet for the 1998 addition), and about 626.3 square feet for t}~e garage. This total ground cover of about 2,151.2 square feet exceeded the maximum permitted ground cover of about 2,139.03 square feet by about 12 square feet. 6. Unlike many other situations, the Applicants in this case unintentionally exceeded the maximum total ground cover allowed under the Hy-law. In good faith, they built in accordaru:e with the permit issued to them and did not build more than that for which they had applied. The Applicants have tried to find a cure for this ground cover issue by looking for a pozCion of the structures on the Locus to modify or eliminate and by investigating whether using different, thinner trim would eliminate the nonconformity. The only break in the exterior walls is for the two garage doors. ThPSe two recessed areas contain about 16 square feet, and if they were not counted toward ground cover (which arguably they must be because they fall inside of the extension of the exterior walls), the Locus would corifoz-m to the requirement of the By-law. The Applicants also argue that relief is not necessary because the violation of about 12 square feet is de minimus, resulting in a ground cover ratio of about 3.0158, which, if rounded to the nearest tenth, would result in a ground cover ratio of 3.0~. WP did not reach the merits of thP4e arguments, finding instead that variance relief is appropriate in this instance. 7. Upon the particular facts of this case, the Board ~f Appeals finds that owing to circumstances relating to the shape of the Applicant's land and buildings but not affecting generally the zoning district in which the Locus is situated (consisting of the undersized nature of the Locus, the size and shape of the structures with no warts or jogs, and the de minimus nature of. the violation), a literal enforcement of the provisions of the By-law would involve substantial financial hardship (consisting of the lack of marketability and the possible need to demolish a substantial portion of ot~e of t?ie structures) to the Applicants, and that the desired relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-law (since the intent of the By-law is not to create a hardship in such ca4P4, and this Board has generally granted similar relief to other applicants in like circumstances). The Applicants acted in good faith and built pursuant to a duly issued building permit, which was issued on the basis of acl llladVeL~teilt erroz~ in ground cover calculation. The excess ground cover could not readily be eliminated. 8. The ground cover violation was created through inadvertent error in connection with an addition to the main dwelling constructed in 1998. In the alternative, Applicant seeks a finding that no relief is necessary due to the de minimus nature of the violation. The premises are located in an LUG-3 zoning district and consist of three lots, being Lot 23 on Land Court Plan No. 6283-N and Lots 28 and 29 on Land Court Plan No. 6283-R. These three lots are merged for building and zoning purposes by operation of law. The premises do not conform to the current ground cover, frontage, and area requirements of the By-law, having total ground cover of about 2,151 square feet or about 3.0168%, where maximum ground cover of 2,139 square feet or 3o is allowed; frontage of only about 20.39 feet on Wauwinet Road, where 200 feet are required; and lot area of about 71,301 square feet, where 120,000 square feet are required.
