At a regularly scheduled meeting of the Nantucket Zoning Board of Appeals held on Friday, June 14, 2002, the Board considered your request to clarify its Decision in BOA File No. 07- -00, relative to certain conditions contained in said Decision. Specifically, the Board clarified the following language contained specifically in Exhibit A, the "Sample Management Plan for Dormitories attached to Businesses": I . After review, the Board acknowledges that due to the configuration of the structure and the size of the Lot, there is little room on the Applicant's property to plant the trees required. Therefore, the Board clarifies this condition and allows the placement of said trees upon Town property as determined by the appropriate Town entity. 2. The Board hereby clarifies said Decision by a vote of four in favor (O'Mara, Waine, Sanford, Murphy) and one opposed (Toole), and states that the Boazd acknowledges that there is conflict in some of the language contained in the draft dormitory conditions and language contained in the text of the actual Decision. In addition, the Boazd acknowledges that certain conditions contained in that draft addendum do not apply to the Applicant's property and should be eliminated or clarified. At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, January 12, 2001, at 1:00 P.M., originally scheduled for September 8, 2000, continued to October 13, 2000, continued further to November 17, 2000, continued further to December 8, 2000, and continued further to January 12, 2001, in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of EDWARD NOTIS-McCONARTY, Trustee of 4 & 10 BROAD STREET REALTY TRUST, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 071-00: 2. The applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-33.A (alteration or expansion of a pre-existing nonconforming structure or use). The subject property (the "Locus") contains an existing nonconforming two- story structure which contains two take-out food establishments on the first floor, a retail bicycle shop on the first floor with storage on the second floor, and a separate, smaller, nonconforming one-story structure containing a third take-out food establishment. The applicant proposes to relocate, upwardly expand and reconfigure the smaller structure and incorporate it into the existing two=story structure, and place an employer dormitory for up to eight employees on the second floor in part of the area now used for storage. The addition would not come any closer to the lot lines than the existing structures. In the alternative, the applicant seeks relief by VARIANCE from By-law §139-16.A to allow the demolition and reconstruction of the separate structure as proposed. The applicant further seeks relief by SPECIAL PERMIT under By-law §139-7.D(4) for the proposed employer dormitory, and under By-law §139-18.B(2) waiving provision of any parking spaces which would be required as a result of the alteration, expansion and change of use of the structures upon the Locus. The Locus is nonconforming as to lot area, containing about 2,188 square feet in a district in which minimum lot size is 5,000 square feet. The buildings upon the Locus are nonconforming as to ground cover ratio, with total ground cover of about 85.60, with the maximum permitted in this district being 30o for an undersized lot of record; and as to side and rear yard setback, with westerly side yard setback of zero feet from South Beach Street, southerly rear yard setback of 0.03 foot at the closest point, and easterly side yard setback of zero f eet ; a minimum of f ive f eet is required in each instance . The applicant's proposed work will result in ground cover and 1 setbacks remaining unchanged, with elimination of the present encroachment of the one-story structure upon South Beach Street. The proposed upward expansion would partially occur within five feet of South Beach Street. See also Board of Appeals Files, Nos. 100-92 and 076-93. The Locus is situated at 10 BROAD STREET, Assessor's Map 42.4.2, Parcel 62, being the land shown upon Land Court Plan 8269-A, and is zoned as Residential- Commercial. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was favorable, subject to conditions including removal of the roadway encroachment, screening and maintenance of outdoor storage on the southern portion of the Locus, limitation of the employer dormitory for use by persons employed on the premises, and inclusion of the Management Plan for Dormitories Attached to Businesses in the decision.. One neighbor was represented by counsel and correspondence presented at the public hearing, in opposition to the applicant's proposal, expressing concern as to the provision of adequate waste removal, noise and smell of food preparation, regulation of hours of operation, and overall intensity of proposed uses upon the Locus. 4. As presented by the applicant's representative, the Locus contains two pre-existi-ng nonconforming structures, one of which encroaches upon the layout of South Beach Street, which are used for a variety of commercial uses. The larger of these structures was altered and expanded pursuant to relief granted by the Board of Appeals in Case No. 076-93; it now contains two take-out food establishments and a bicycle shop, with the second story available for storage. The applicant proposes to place an employer dormitory in a portion of the second story. Meanwhile, the applicant proposes to demolish and reconstruct the smaller structure, containing another take-out food establishment, as an addition connected to the principal structure, entirely within the Locus and thus eliminating the encroachment upon South Beach Street (but still to be located within the side yard setback measured from South Beach Street), while also expanding it upward within the side yard setback from South Beach Street. As presented by the applicant, the employer dormitory will enable him to house employees on his premises who are now being housed elsewhere on the Island and must commute to work. In response to concern by Board members as to the number of employees to be housed, the applicant voluntarily reduced the proposed capacity of the dormitory to six workers. The demolition and reconstruction of the small separate structure, with the same footprint area and incorporated into the main structure, will result in elimination of the encroachment upon the public way and will result in there being no additional nonconformities. Further, as explained by the applicant, the proposed reconstruction of this space, attached to the main building, will enable the space, not now handicapped-accessible, to become compliant with architectural accessibility standards. 2 5. The present uses upon the Locus are all permitted as of right in the Residential-Commercial zoning district in which the Locus is situated, and the employer dormitory use is allowed in all districts subject to the issuance of s Special Permit. However, since the structures cover virtually the entire Locus (ground cover ratio exceeds 85%), there is no room for the provision of any on-site parking spaces upon the Locus, before or after the proposed work. Therefore, the Board of Appeals made the finding, subject to the conditions hereinafter set forth, that the proposed alterations to the building upon the Locus would be in harmony with the general purpose and intent of the Zoning By-law, and that the proposed alteration and extension of the main structure and demolition of the separate structure would not be substantially more detrimental to the neighborhood than the existing nonconformities. 7. The Board of Appeals made the further finding that a grant of Variance relief to allow demolition of the separate structure and construction of the addition to the main structure, with zero side yard setback and total ground cover ratio of about 85%, subject to the conditions hereinafter set forth, would actually be a public benefit, as the present encroachment upon South Beach Street, a public way, would be eliminated, and that owing to circumstances relating to the soil conditions, shape and topography of the Locus and structures thereon but not affecting 3 generally the zoning district in which the Locus is situated (consisting of the encroachment of the existing structure upon South Beach Street), a literal enforcement of the provisions of the Zoning By-law would involve substantial hardship upon the applicant, and desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning By-law. 8. As to the requested employer dormitory to be placed on the second floor within the existing main structure, the Board of Appeals, made the finding that, subject to the conditions hereinafter set forth, the issuance of a Special Permit for an employer dormitory with occupancy of not more than six persons would be in harmony with the general purpose and intent of the Zoning By-law and would be consistent with efforts by the Town to encourage provision of employee housing. 9. As to the applicant's request for relief by Special Permit from all requirements for provision of parking upon the Locus, the Board of Appeals made the finding that, subject to the conditions hereinafter set forth, the waiver of all parking spaces would be in harmony with the general purpose and intent of the Zoning By-law, as no parking spaces are now provided and the provision of any on-site parking would be physically impossible. 10. Based upon these findings, the Board of Appeals, by UNANIMOUS vote in each instance, GRANTED relief by VARIANCE and by SPECIAL PERMIT, as follows: (a) VARIANCE relief from the intensity regulations of Zoning By-law §139-16.A, to permit demolition of the separate structure and construction of the addition to the main structure as proposed. (b) SPECIAL PERMIT relief under By-law §139-33.A, for the alteration of the pre-existing nonconforming structure upon the Locus by construction of the proposed nonconforming addition after demolition of the existing separate structure encroaching on South Beach Street, which will not result in there being any new nonconformity of the structures upon the Locus as compared to conditions as they now exist, nor the increase of any existing nonconformity. (c) SPECIAL PERMIT relief under Zoning By-law §139- 7.D(4) to allow the employer dormitory use upon the second story of the existing main structure, for occupancy by not more than six persons. (d) SPECIAL PERMIT relief under By-law §139-18.B(2), waiving provision of all parking requirements in connection with the proposed alterations to the Locus. 11. The relief hereby granted is subject to the following conditions: 4 (a) The employer dormitory upon the Locus shall be managed in accordance with the "Management Plan for Dormitories Attached to Businesses" which is attached hereto as Exhibit A. (b) The employer dormitory shall be air-conditioned. (c) All refuse from dumpsters and trash receptacles serving the Locus shall be picked up at least twice daily during the summer season. (d) No bicycles shall be stored outdoors upon the Locus. (e) No additional exhaust fans shall be placed upon the Locus; any existing exhaust fans shall be vented upward. (f) The outdoor area surrounding the buildings upon the Locus shall be kept neat and clean. (g) The employer dormitory shall be limited in occupancy to employees performing a significant portion of their duties at the businesses upon the Locus or other businesses owned or controlled by the beneficial owner of the Locus, situated in the immediate neighborhood of the Locus. (h) The proposed alterations shall be constructed in substantial conformity with the plans approved by the Nantucket Historic District Commission under Certificate of Appropriateness No. 36,551 (as the same may be amended), the floor plans submitted to the Board of Appeals, a reduced copy of which is attached hereto as Exhibit B, and the site plan submitted to the Board of Appeals and given site plan approval pursuant to By-law §139-23, a reduced copy of which is attached ~eret~o as Exhibit C.
