Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw § 139-9B(2)(a), (b) and (c) (light manufacturing, storage and warehousing, and assembly of component parts) and under Bylaw § 139-7D(4) (employer dormitory). Applicant seeks to use a proposed building containing a 2,560± square foot garage area and a 1,356+ square foot storage area, for a total of 3,916+ square feet of storage and warehousing, and an attached employer dormitory for six (6) employees. Eight (8) parking spaces and one (1) loading zone are required and ten (10) conforming parking spaces and a loading zone are proposed for the site. The Locus does and the proposed structure will conform with all dimensional requirements of the Bylaw. The Premises is located at 6 Teasdale Circle, Assessor's Map 69, Parcel 78, Land Court Plan No. 14342-P, Lot 64. The property is zoned Residential-Commercial-2. 2. The decision is based upon the Application, a proposed site plan and other materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made a favorable recommendation, provided that the front yard setback was maintained from Teasdale Circle and that the Planning Board's Sample Dormitory Management Plan was adopted. An abutter, through his attorney, expressed no objection to the project, if a Dormitory Management Plan was adopted and the project otherwise complied with the Bylaw. 3. The Applicant, through counsel, presented a revised site plan, dated July 10, 2000 and revised September 9, 2000, by D. Neil Parent Associates, elevations and floor plans of the proposed structure and a letter from the Wannacomet Water Company, approving the project under Bylaw § 139-12B(3)(a) (well head protection district). The Applicant seeks to use a proposed building containing up to 3,916 square feet of storage space, divided between a five bay garage of about 2,560 square feet and a second floor storage area of about 1,356 square feet. The Applicant also seeks to use another portion of the proposed building as an employer dormitory for 6 employees. The proposed building and other improvements will comply with all the dimensional requirements of the Bylaw, including the front yard setback, parking, loading and screening. The Applicant further stated that they were only seeking relief to allow the storage and warehousing of vehicles and other materials under Bylaw § 139-9B(2)(b) and withdrew their request for relief under Bylaw § 139-9B(2)(a) and (c) to permit light manufacturing and assembly of component parts. The parking requirements for requested uses are as follows: 3,916 SF of Storage/Warehousing (a 1 space per 900 SF = 4 spaces (2,560 SF garage & 1356 SF 2" fl storage area) Employer Dormitory of 6 employees @ 2 spaces +'/2 space for persons > 2 = 4 spaces Total Required 8 spaces Total Provided 10 spaces 4. Therefore, the Board finds that the requested Special Permit relief for the use of a proposed building containing up to 3,916 ± square feet of storage and warehousing and an employer dormitory for six (6) employees, to be in harmony with the general purpose and intent of the Bylaw, with the implementation of the Planning Board's Dormitory Regulations for Dormitories attached to Businesses. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested SPECIAL PERMIT relief under Bylaw § 139-9B(2)(b)(storage and warehousing) and under Bylaw § 139-7D(4) (employer dormitory) for the use of a proposed building containing up to 3,916 + square feet of storage and warehousing and an employer dormitory for six (6) employees, subject to the following conditions: 6. a) Improvements on the Premises shall be constructed in substantial conformance with the revised Site Plan, dated July 10, 2000 and revised September 9, 2000, by D. Neil Parent Associates, a reduced copy of which is attached hereto as Exhibit "A"; and b) The dormitory shall be operated in conformance with the Planning Board's Sample Dormitory Regulations for Dormitories attached to Businesses, which is attached hereto as Exhibit "B". Furthermore, by unanimous vote, the Board APPROVES the revised Site Plan, dated July 10, 2000 and revised September 9, 2000, by D. Neil Parent Associates, under Bylaw §139-23K9(2)(a). The property owner shall be responsible to plant and permanently maintain at least two shade trees of at least four inches caliper in locations determined by the ZBA to host ttiiniud'~ the visual impact of the building and parking area, as shown on the endorsed site plan. Z. All exterior lighting shall be directed generally downward and placed so as to not be directed at any neighboring parcels. 3. No exterior storage of furniture (with the exception of items typically used as lawn furniture), refuse, mechanical components, debris, unregistered or inoperable vehicles, or other materials constituting a nuisance, shall be permitted on the locus. ~. No loud music or other noise violating the Nantucket noise by-law or any other provision of law from time to time in effect shall be permitted upon. the lot. 5. The dormitory upon the Iacus shall not be used for the housing of any persons except for employees of an owner of the locus, or employees of a tenant of an owner of the locus. All occupants shall be employees of an owner or tenant, who are licensed by their respective employers to occupy a space in the dormitory by virtue of their employment and for only so long as their employment shall continue. No subtenancies of the buildings upon the locus or any portion thereof shall be permitted. 6. Each lease to an employer shall set forth that the employer shall be responsible for compliance with all provisions of these conditions by the employees of such employer and within the area leased to such employer. 7. The premises and grounds of the lot shall be kept neat and clean at all times. 8. The owner of the locus, or the tenant of an owner of the locus shall make available to their employees free Nantucket Regional Transit Authority shuttle passes for the entire period that such employees reside in the dormitory. 9. The property owner shall be required to install and maintain bike racks on the property, in a location convenient for use by the residents of the dormitory. 10.
