Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-33A (alteration/expansion of apre-existing nonconforming structure/use). Applicant proposes to construct asecond-story addition over a portion of an existing single-family dwelling by raising the roof ridge height from about 18'4" to about 25'6" without coming any closer to the front yard lot line than the existing structure which is sited at about 13 feet at its closest point from the lot line along Washington Avenue in a district that requires a minirrn~m front yard setback of 30 feet. There will also be an expansion of the first floor on the northeasterly side of the structure that will come no closer to the front yard lot line and construction of a conforming addition to the rear deck on the southerly side of the structure. Total ground cover will not exceed the maximum allowed of 12.5%. The Locus is also nonconforming as to lot size with the Lot containing about 16,000 square feet of area in a district that requires a minimum lot size of 20,000 square feet. The Premises is located at 19 WASHINGTON AVENUE, MADAKET, Assessor's Map 60.2.1, Parce148, Land Court Plan 3092-R, Lots 131 and 134. The property is zoned Residential-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters in opposition on file and no opposition expressed at the hearing. 3. Applicants represented that they wished to expand the small single-story single- family dwelling to provide more interior living space. The second floor addition and first floor expansion on the northeasterly side would not come any closer to the northwesterly front yard lot line than the existing structure and there would be no new nonconformities created. Ground cover, side and rear yard setback and parking requirements are and would continued to be met. The structure was built after the 1972 enactment of the Zoning Bylaw in 1973. However, in the time period between August of 1972 and March 26, 1974, there were no setback requirements in Madaket, except as they related to "accessory buildmgs", thus making the Lot and structure grandfathered. Applicants have obtained a Certificate of Appropriateness No.3Ca `f7/ ,issued by the Nantucket I-listoric District Commission for the proposed work. 4. Therefore, the Board finds that the construction of the second-story addition and first floor expansion as proposed would be an intensification of the nonconformity. However, said increase of the massing in the front yard setback area would not be substantially more detrimental to the neighborhood than the existing nonconforming situation. The Board notes that the other conforming additions are allowed as a matter of right without relief from this Board. 5. Accordmgly, by a UNANIlVIOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-33A to allow the additions to be constructed as proposed, raising the roof ridge height from about 18'4" to no more than 25'6" and expanding the first floor, which will be no closer to the front yard lot line than the existing dwelling, upon the following conditions: a. The additions shall be constructed in substantial conformance with the Certificate of Appropriateness No. 3 (o ~/7 f ,issued by the Nantucket I•Tistoric District Commission, as may be amended; and b. The addition shall be constructed in substantial conformance with the "Site Plan" dated 6/00, done by Aileen L.
