At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00
P.M., Friday, August 11, 2000, in the Conference Room, Town Annex Building,
37 Washington Street, Nantucket, Massachusetts, on the Application of
ROBERT H. MICHETTI of 287 Ocean Street, B2, Hyamis, MA 02601. CHAD
MICHETTI and TESSA D. MICHETTt, of PQ Bvx 2322, Nantucket, MA 02584,
Board of Appeals File No. 058-00, the Board made the following ~easion:
1. Applicants are seeking relief by VARIANCE under Nantucket Zoning
Bylaw Chapter139 §8A(1)(b) and (c). Applicant Robert Michetti owns an
undivided 50% interest in one (1) of two (2) units ~ a duplex structure. His son
and daughter-in-law own the other 50% interest. Oue a change in personal
circumstances, Robert Michetti would like to condominiumize the ownership d
this property in order to be able to obtain fair market value for his unit and which
enables Chad and Tessa Michetti to remain in their unit. Relief is required from
the provisions of the Bylaw that require that one (1) of the units be a secondary
dwelling unit in order to be condominiumized and that two (2) dwelling unite shall
be in the same ownership in this particular zoning district. See also BOA File No.
081.86.
The Premises is located at 6 ALLEN'S LANE, Aaaeasora Map 55, Paroal
234.9, Plan Book 21, Page 108, Lot 53. The property is zoned Residential-10.
2. The Decision is based upon the Application and materials submitted with
it, and the testimony end evidence present®d et the Hearing. A local attorney
present on another case said it was strictly a question of ownership, and it is
arguable whether a Zoning Bylaw could regulate that. The Planning Board made
no recommendation. There was one letter on file in support and one abutter
spoke in favor of a grant of relief.

3. As presented by the Applicant, Robert H. Michetti, he owns the duplex
dwelling unit at 6 Allen's Lane as a tenant in common with his son, Chad
Michetti, and daughter-in"iaw. Tessa D. Michetti- Mr. Michetti works for the U.S.
Postal Service and has been transferred off Nantucket and needs to find a home
on the Cape. Ne needs to transform his equity in the 6 Allen's Lane property into
cash in order to be able to purchase a home off-Island without jeopardizing his
son's family home. Even though the duplex contains two separate dweNing units,
the zoning Bylaw, specifically Chapter 139, Section t3A (1) (b) and (C), prohibits
the sale of the individual unit: via the establishment of a condominium or
cooperative form of ownership. Separate ownership is allowed in the R-1 and
RC-2 zoning districts. As a result, Mr. Michetti is "hamstrung" as it is virtually
impo9sible to sell his half-interest because a new owner would become
essentially a partner with Chad and Tessa, the other tenants in common, not can
Mr. Micttetti take a ban out on his half without Chad and Tease's credit being
affected as well. The only way to obtain the fair market value for the property is
to sell the entire duplex stnuture to a third party and, while this would solve
Robert's problem, it would leave Nantucket residents, Chad end Tessa, without a
home. The Michettis contemplate a condominium arrangement where the entire
structure, specifically the foundation, exterior walls end roof, i.e. the "shalt is
owned by the condominium association, end the actual dwelling units are owned
individually. This would enable an individual owner to mortgage or sell their unit
without involving ar impeding the owner of the other unit. The number of
dwellings would not change, the residential use would not change and the impact
on the neighbofiood would be inconsequential as nothing is really changing
except the form of ownership at the Registry of Deeds.
4. Therefore, the Board finds that this proposed change in the form of
ownership may be granted without significant detriment to the public good and
without nullifying or substantially derogating from the intent and purpose of the
Zoning 13ytaw, Further, the Board members support a grant of relief as (here are
compelling persona) and financial issues involved. To lose one's home is
potentially a great financial hardship. The Board further finds that, given the
duplex form or shape of their dwelling structure and the evident financial hardship
arising therefrom, as noted above, a literal enforcement of the provisions of
Chapter §139-t3A(1 xb) end (c) would involve substantial financial and other
hardships upon Applicants, not apparently so affecting others in the R-10 District.
Finally, the Board finds that a grant of relief would provide a benefit to Nantucket
by marketing an affordable housing unit for a your~q year-round family. The
realty is that many such families ere being forced off-Island due to the high cost
of housing.

5. Accordingly, by UNANIMOUS vote, the BOARO GRANTS THE
VARIANCE RELIEF, under Nantucket Zoning Bylaw Chapter 139, § 8A
exempting this property from the provisions of Chapter 139, § 8A(1)(b) and (c).

Applicant, Robert Michetti, owns an undivided 50°~ interest in this property as a
tenant in common with his son and daughter-in-law, who own the other 50°r6
interest. The property contains a duplex, one unit occupied by Chad and Tessa
Michetti, .and the other rented to third party tenants by Robert Michetti. Robert
Michetti did live in one unit, but he was transferred off-Island (he is a postal
worker), and that is why it is not owner occupied. Robert needs to purchase
property off-Island for housing, and he needs to sell his share of this duplex to
have enough money to purchase housing. It is almost impossible to sell a 50°~
interest because third parties are reluctant to become tenants-in-common with
people they do not know. Michetti would like to condominiumize the ownership
of this property which would result in the 100°~ fee ownership of one unit by
Robert and 100°~ fee ownership of one unit by Chad and Tessa. This would
enable Robert to obtain fair market value for his unit and would enable Chad and
Tessa the flexibility to mortgage their unit if that is their desire. Applicants
request variance relief from Chapter 134, Section 8 A (1) (b) and (c) which
provides that one of the duplex units shall be a secondary dwelling unit and that
the two dwelling units shall be in the same ownership.

Rental housing, particulacly year-cound, has gnerally been perceived as

4. In the present case, Applicants Kelly and Could sre police
officers employed by the Tovn. 'T'heir Chief testified to their valut to the
force and the loss that would bs felt if, for lark of affordable housin;

mortgages with the attendant finanelel advan~ege. They contemplate •
condominf~~m arrangement where the dwelling, specifically, the foundation
and exterior vsil~ and roof, i.e.. the "shell" is owned in common, and the
dwelling ~,~nit spaces era owned separately. kith this credil,lt testimony
and no opposition heard, va find that the relief sought msy be wanted
wlchout sub9tant1al detriment to the public good and without nullifying
or substont1911y derogating from the Intent or purpose of Cho zoning
chapter. upon the following eottdition:
Occupancy of each dwelling unit shell be year-round
upon the conditions which Section 139-7C(2)(g) applies
to an "accessory apartment", here applied [0 each
respective dwelling unit.
