At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, July 14, 2000, at 1:00 PM, in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of SARAH F. ALGER, as TRUSTEE of SEVEN TEASDALE CIRCLE NOMINEE TRUST, for herself as owner and for Robert E. Tonkin, doing business as Tonkin of Nantucket, c/o Sarah F. Alger, P.C., Two Union Street, Nantucket, Massachusetts 02554, File No. 056-00: 2. Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning By-law (the "By-law") §139-9.B.(2)(b)(storage and warehousing). Applicant proposes to construct a new commercial building, having ground cover of about 3,204 square feet or a ground cover ratio of about 24.4%, that would contain about 2,124 square feet of storage and warehousing space; about 1,080 square feet of retail space; and about 782 square feet of office space, resulting in total commercial space of about 3,986 square feet, with up to four (4) employees on site at peak shift. The retail and office uses are allowed as a matter of right under the By-law on this conforming lot, without relief from this Board. There will be no outside storage of goods or materials. The Premises, as so improved, will meet all dimensional, green space, and off-street loading facility requirements of the By-law. Applicant also seeks relief by SPECIAL PERMIT under By-law X139-18 to waive one (1) of the twelve (12) required parking spaces. The Premises are located at SEVEN TEASDALE CIRCLE, Assessor's Map 69, Parcel 73, Lot 56, Land Court Plan No. 14342-P. The Premises are zoned RESIDENTIAL-COMMERCIAL-2. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board made no recommendation. There was no opposition presented at the public hearing, personally, by representatives, or in writing. At the public hearing, Applicant submitted a site plan drawn by Stover Engineering Associates, Inc., dated June 9, 2000, revised June 23, 2000, a reduced copy of which is attached hereto as Exhibit A (the "Site Plan"), and the Board approved it pursuant to By-law X139-23. As shown on the Site Plan, the Premises are located outside of Zone II Acquifer Protection. 4. Applicant proposes to construct a new commercial building for the storage, warehousing, and retail sale of antiques and other furniture, furnishings, collectibles, gift items, and the like. The structure will also house an office ancillary to the storage, warehousing, and retail operation. The retail and office uses are allowed as a matter of right under the By-law on this conforming lot, without relief from this Board. There will be no outside storage of goods or materials. The Site Plan shows that the Premises, as so improved, will meet all dimensional, green space, and loading facility requirements of the By-law. The Site Plan also shows that a fence or hedge will be provided to screen the parking area from the abutting properties. The Nantucket Historic District Commission has approved the proposed structure under Certificate of Appropriateness No. 36,323. 5. The Board calculates the parking spaces required by the proposed uses on the Premises, under By-law §139-18, to be twelve (12), calculated as follows: 2,124± s uare feet of stora e and warehousin -•. -. 2 1,080± s uare feet of retail use 5 One em to ee s ace for the retail use 1 782± s uare feet of office use 4 Total 12 As shown on the Site Plan, Applicant proposes to provide eleven (11) on-site parking spaces that will conform with the dimensional requirements of the By-law. One of these spaces will be an oversized handicap space. The Board finds that the provision of eleven (11) parking spaces, including the oversized handicap space, is more than adequate to serve the proposed uses on the Premises. 6. The Premises are located on Teasdale Circle, and the Board took note of the precedent of a variety of other similar commercial uses already operating under special permits granted by the Board in the general neighborhood. The conditions to be imposed upon the project in connection with this relief are consistent with such precedent and will address any possible concerns about the project. 7. Upon these facts, the Board of Appeals finds that the requested relief by Special Permit under §139-9.B.(2)(b) to allow use of a portion of the proposed commercial structure upon the Premises for storage and warehousing, as more particularly described .above, conditioned as set forth herein, would be in harmony with the general purpose and intent of the By-law and that such proposed uses would not inherently violate By-law X139-7.E(4), prohibiting uses which are "injurious, obnoxious, offensive, dangerous or a nuisance to the community or to the neighborhood through noise, vibration, concussion, odors, fumes, smoke, gases, dust, harmful fluids or substances, danger of fire or explosion or other objectionable feature detrimental to the community or neighborhood health, safety, convenience, morals or welfare." The Board also finds that the requested relief by Special Permit under X139-18 from one (1) of the required twelve (12) parking spaces for all of the proposed uses would be in harmony with the general 2 purpose and intent of the By-law and would not have a significant and adverse effect on the scenic integrity of the neighborhood and would not be contrary to sound traffic and safety considerations. 8. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law §§139-9.B.(2)(b) and 139-18, to allow use of a portion of the proposed commercial structure upon the Premises, having ground cover of about 3,204 square feet or a ground cover ratio of about 24.4%, for storage and warehousing of about 2,124 square feet. Said structure will also contain uses that are permitted as a matter of right, being retail space of about 1,080 square feet; and office space of about 782 square feet, resulting in total commercial space of about 3,986 square feet, with up to four (4) employees on site at peak shift. Applicant will provide eleven (11) of the required twelve (12) parking spaces. The relief hereby granted is upon the following express conditions: a. The uses hereby permitted, including the siting of the structure and parking and screening, shall be in substantial conformity with the Site Plan drawn by Stover Engineering Associates, Inc., dated June 9, 2000, revised June 23, 2000, a reduced copy of which plan is attached hereto as Exhibit A (the "Site Plan"). b. The structure shall be constructed in substantial conformity with the plans submitted to the Nantucket Historic District Commission and approved by it in Certificate of Appropriateness No. 36,323, as the same may be amended from time to time. c. The parking areas along the easterly and northeasterly boundary lines of the Premises shall be adequately screened and maintained with a hedge or fence in substantial conformity with the Site Plan. d.
