1. The Applicant is seeking a MODIFICATION of the SPECIAL
PERMIT issued in Board of Appeals File No. 020-00 to allow the
relocation of an existing office in the basement to the second
floor, which would then have two (2) separate offices. The
Decision in File No. 020-00 allowed one (1) separate office
tenant per floor with a total of four (4) offices and ancillary
storage and common space. The total number of offices in the
building would continue to be four (4) To the extent
necessary, Applicant is also seeking relief by SPECIAL PERMIT to
waive any additional parking spaces that the Board may deem
necessary.
The Premises are located at 53 MAIN STREET, Assessor's Map
42.3.1, Parcel 223, Land Court Plan 16137-A. The property is
zoned Residential-Commercial.
2. Our decision is based upon the application and accompanying
materials and representations and testimony received at our
public hearing. The Planning Board made no recommendation on
this application, because the matter is not of planning concern.
There was no support or opposition presented in person or by
correspondence at the public hearing.
3. The Applicant proposes to convert the library and kitchen
space on the second floor of the building to one (1) office
space. The existing office space in the basement would no
longer be a separate office space but, rather, would become
ancillary to the office space on the first floor. The total
number of office tenants in the building would continue to be
limited to four (4).
4. The crucial element of the Board's decision in File No.
020-00 was the limitation of the number of office spaces to four
(4) and not the exact location of such four (4) offices within
the building. Therefore, the Board of Appeals finds that
allowing four (4) separate office spaces in the building, one on
the ground floor, two on the second floor, and one on the third
floor, with ancillary use of the basement space, is in keeping
with the spirit of its decision in File No. 020-00 and would not
be substantially more detrimental to the neighborhood. A waiver
of parking, to the extent necessary, would also be in keeping
with the spirit of the decision in File No. 020-00, in harmony
with the general purpose and intent of the Zoning Bylaw, and not
contrary to sound traffic and safety concerns. As noted in our
prior decision, provision of parking on site would be physically
impossible, as is the case with a majority of businesses located
within the downtown commercial area.
5. Accordingly, by unanimous vote, the Board of Appeals hereby
modifies the Special Permit granted in File No. 020-00 by
modifying Paragraph 5 of that decision to read as follows:
Accordingly, by a unanimous vote, the Board GRANTS the
requested SPECIAL PERMIT relief under Nantucket Zoning
Bylaw §139-33A to allow the alteration and expansion
of the use of the structure to allow Applicant to have
a total of four (4) separate offices and under
Nantucket Zoning Bylaw §139-18 to the extent
necessary, waiving any additional parking spaces
required for the change in use, upon the following
conditions:
a. A maximum of four (4) separate offices shall
be allowed on the Premises, one on the first floor
(and including the basement space) , two on the second
floor, and one on the third floor.
b. There shall be no conversion to retail space
without further relief from this Board.
c. All common areas of the building shall be
ancillary to the offices in the building and not
leased separately.

Appeals File No. 020-00, the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw §139-33A (alteration/expansion of a pre-existing
nonconforming structure/use}. Applicant proposes to increase the number
of of£iee units from three (3) to five (5} with the •abilit;y to lease
them sc3parately. The building currently contains one (1} office: in the
basement; one (1) office on the first floor; ancillary conference,
kitchen and library space on the second floor; and one (].} orfiCe on
the third floor. Applic~-:nt wishES to convert the second floor space
into two (2) offices. No retail UCP is manned or asked for under this
Application and there will be no increase in the footprint of the
structure. To the extent necessary, Applicant ai~o seeks relief by
SPECIAL PERMIT under §139-18, to waive any additional parking spaces
required by the conversion. There are no parking spaces provided on
site and none are planned. Applicant also seeks validation, by issuance
of a new SPECIAL PERMIT under §139-33A and §139-18, of relief grar~Lcd
relative to the use of the third floor offi~c space in Board OF Appeals
File No. 099-85 that has arguably expired, a Certificate of Occupancy
having been issued subject to the previous Special Permit, as the
Decision was not fii_PCi with the Registry of Deeds prior to its
expiration as required under the Zoning BylaK.
The Premises is located dt 53 MAIN STREET, Assessor's Map
42.3.1, Parcel 223, Land Court Plan 16137-A. The property is zoned
ResidCntial-Commercial.
2. ~'he Decision is based upon the Application and materials
submitted with it and the testimony and evidence presented at the
heaxing. Tttc Planning Board made no recommendation as the matter was
not of planning concern. Them were no letters on file.

3• Applicant represented that the structure had existed in its
present configuration since a time prior to the 1972 enactment Of the
zoning Bylaw and was validly grandfathered as to dimensional and
parking nonconformities, with the structure covering almost 10096 of
the Lot and with no parking provided on site. Appiicant;~' family
purchased the property in 19b2 and have run their insurance business
in the structure since that time. In the previous Derision in HOA File
No. 099-85, a Special Pnr.mit was granted to allow conversion of L2ie
third floor space from ancillary storage space to use as the
architectural office "of a principal of the Applicant Tru:,t" with no
more than one {1} employee. Thn work was performed under validly
issued Building Permit No. 4394-85 and Certificate of Occupancy Ho.
X1394-99 was issued. However, the Decision was never filed with the
Nantucket Registry of DHCds within tho two (7) year time period
required under thc~ Bylaw and thus said relief may have expired.
Therefore, Applicant now asks this Rn~rr.I to grant similar relief but
allow morn than Orie (1) employee in the third floor office space and
be able to lease the space separately from Applicant's business on the ~
first floor. Applicant also seeks Special Permit relief to be able to ~
lease the one (1) existing office space in the baycment and two (2)
proposed new offices spar_ns on the second floor, created out of a
library and ConferpnCe area, separately from Applicant's business,
with a resulting total of offi_rns being five (5}. Applicant
represented that thFre would actually be a decrease in the intensity
of use of the building with the removal of the conference room area
and Conversion to office space.
4• Therefore, the Board finds that allowing four (4) separate
office spaces, one (1) per floor, would not be substantially more
detrimental to ttie neighborhood than the existing use of the building,
with the Board also determining that allowing five (S) offices would
Constitute a too intensive use of the property. A grant of relief
would be consistent with similar relief previously granted in the
downtown area. A waiver of parking, to the extent necessary, would
also be in harmony with the general p~2rpose and intent of the Zoning
Bylaw and not contrary to sound traffic- anc3 safety concerns. Provision
of parking on siL•e would be physically imp~ssihle as is the case with
a majority of businesses located within the downtown commercial area.
5. Accordingly, by a unanimous vote, the Board GRANTS the
requested SPECIAL PERMIT relief under Nantucket Zoning Bylaw §139-33A
to allow the alteration and expansion of the usa of the structure to
allow Applicant to separately lease four (4) office spaces, one (1) on
each floor, and under Nantucket 7.oning Bylaw §139-18 to the extent
necessary, waiving any additional parking spaces required for the
Change in use, upon the following conditions:
a. A maximum of four (4} separate office spaces shall be
allowed on the Premises, with a maximum of one (1) tenant office space
per floor;
b. There shall be no conversion to retail space without
further relief from this Board;
c. The storage space in the basement, apart from the
one (1) existing office space, shall be ancillary to the offices in
the building and not leased separately; and
