TOWN OF NANTUCKET ZONING BOARD OF APPEALS 37 WASHINGTON STREET NANTUCKET, MASSACHUSETTS 02554 PHONE 508-228-7215 FAX 508-228-7205 Assessor's Map 68 Parcel 78 R-C 23 Old South Road Plan Book 129, Page 516 Lot 5, Deed Ref. 656/25 At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00 P.M., Friday, June 9, 2000, in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the Application of JOSEPH AND CELESTE RANNEY, of 1 West Creek Road, Nantucket, MA 02554, Board of Appeals File No. 046-00, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-16B(1) to convert an existing single-family dwelling to use as a doctor's office. The Locus arguably has 30 feet of frontage on Tom's Way and has been traditionally accessed from Old South Road by a 12-foot easement, in a district that requires a minimum frontage of 40 feet for a commercial lot. The Lot and structure contained thereon meet all dimensional zoning requirements (other than frontage), and would meet all parking requirements with the conversion to office use. In the alternative, to the extent necessary, Applicant is seeking relief by VARIANCE under Nantucket Zoning Bylaw Section 139-16A to allow the proposed conversion on a Lot without adequate frontage. The Premises is located at 23 OLD SOUTH ROAD, Assessor's Map 68, Parcel 78, Plan Book 129, Page 516, Lot 5. The property is zoned Residential- Commercial. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made a favorable recommendation provided that the Applicants provide evidence that the Locus has at least 20 feet of frontage on Tom's Way. Three (3) abutters, who are owners of property that was part of the same subdivision the subject lot was originally part of, spoke about their concerns at the hearing. They were not supportive of opening up Tom's Way for primary access but not necessarily opposed to the conversion of use from residential to office use provided that the office use be particular to Applicants, and any change would have to come back to the Board of Appeals. They farther pointed out that the easement from Old South Road was actually 12 feet and not 30 feet as originally noticed, with the Applicants' Locus arguably not benefited by said easement. 3. Applicant represented that he is currently leasing commercial space for his chiropractic practice at a separate location. He would like to move the office to the recently purchased subject property. The Lot has about 14,559 square feet of area in a district that requires a minimum lot size of 5,000 square feet and the single-family dwelling is conforming in all respects and would continue to do so after the conversion. The existing one-story structure would be converted from residential use, as asingle-family dwelling, to use as his office. Although office use is generally a permitted use in this Residential-Commercial zoning district as a matter of right without relief from this Board, relief is necessary to convert the use to a commercial office as the Lot has only 30 feet of frontage along Tom's Way, in a district that requires a minimum of 40 feet. Commercial uses are not necessarily grandfathered as to frontage. Had the residential use remained and no commercial use proposed, the Lot would have remained grandfathered as to frontage and all conforming alterations to the residential structure would not have required relief from this Board. In other words, by converting the use to commercial office use, grandfathering as to frontage would be forfeited as long as commercial use remained on the property.. Six (6) parking spaces are required under the Bylaw for about 1,045 square feet of office space and eight (8) conforming spaces and one (1) handicap space will be provided on site, with screening provided around the parking areas. Green space requirements will also be met as shown on the "Site Improvements" plan, done by Hidell-Eyster & Associates, Inc., dated May 25, 2000, labeled "Professional Office for Joseph M. Ranney" 4. Applicant addressed concerns about having legal frontage on Tom's Way, a lack of which would require Variance relief from this Board for the proposed change in use. Applicant presented several documents supporting his claim to said legal frontage. Assessor's Map 68 indicates that the Locus directly abuts Tom's Way for a length of about 30 feet. The "Approval Not Required" subdivision plan, as signed by the Planning Board on May 11, 1965, filed with the Nantucket Registry of Deeds in Book 17, Page 18, also indicated that the Lot directly abuts a "Way", with no frontage along Old South Road. Applicant stated that it could be reasonably concluded that the Planning Board would not have created a buildable land-locked parcel as part of a larger subdivision, and that it was probable that it considered that Tom's Way provided the needed frontage for the Lot, shown as "Lot 5' on said plan. Applicant also provided a "Mortgage Inspection Plan", done by Decelle Engineering and Survey, Inc., dated March 22, 2000, which showed a " 30' Way" abutting the property, and showing two (2) bound markers where the Way intersects with the subject property. Finally, Applicant produced a "Quitclaim Deed" which conveyed the property to the Applicants, which states that "Appurtenant to said lot a right ofway for all purposes for which a way may be used over athirty--foot way shown on said Plan to a way known as Lover's Lane, so-called [a.k.a. Tom's Way]." Applicant represented that this last document, filed on March 31, 2000 in the Nantucket Registry of Deeds in Book 656, Page 25, supplies adequate confirmation that they have deeded rights to use Tom's Way for his primary access. Validating access from Tom's Way should eliminate the necessity of clarifying whether or not the Applicants have the use of the 12-foot easement from Old South Road for their primary access. The abutters contested that Applicants did not have formalized rights to use said easement from Old South Road. 5. Therefore, based upon Applicant's representations and the documents submitted, the Board finds that the grant of Special Permit relief; to reduce the required frontage for a commercial lot in the Residential-Commercial zoning district from 40 feet to 30 feet to allow for the conversion of asingle-family dwelling to commercial office use, would be in harmony with the purpose and intent of the Zoning Bylaw, and said reduction would not be substantially more detrimental to the neighborhood. The Board considers that the proposed office use would have minimal impact upon the surrounding area and office use would be in keeping with the neighborhood as the Locus is situated within a heavily developed commercial area, with several commercial businesses located in close proximity. Had the Applicants had ten (10) additional feet of frontage on Tom's Way, they would not have had to seek relief from this Board to convert the use. 6. Accordingly, upon a unanimous vote, the Board GRAN'T'S the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-16B(1), to allow reduction of the required 40-foot frontage along Tom's Way to 30 feet, to enable Applicants to convert asingle-family dwelling to a commercial structure to be used entirely as one (1) office space upon the following conditions: Relief hereby granted shall be particular to these Applicants without further relief from this Board; b. Any change in type of use or intensity of use shall require further relief from this Board; and c. Parking, screening and greenspace shall be done in substantial conformance with the "Site Improvements" plan done as "Residence & Professional Office for Joseph and Celeste Ranney", by Hidell-Eyster & Associates, Inc., dated May 25, 2000, a reduced copy of which is attached hereto and marked as Exhibit A. 7. The above referenced "Site Improvements" plan was approved, by a unanimous vote, and signed by this Board as required under Nantucket Zoning Bylaw Section 139-23.
