Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A (alteration/expansion of a pre-existing nonconforming structure/use). Applicants propose to convert an existing garage structure to use as a studio without increasing the ground cover ratio, as part of an overall renovation of the structure. The height of the structure would be increased within the side and rear yard setback areas from about 12 feet to a maximum of about 16 feet without coming any closer to those lot lines than the existing structure. The Lot also contains a single-family dwelling. The Locus is nonconforming as to lot size with the Lot containing about 2,738 square feet of area in a district that requires a minimum lot size of 5,000 square feet; as to frontage with the Lot having about 45 feet of frontage along Spring Street in a district that requires a minimum distance of 50 feet; as to ground cover, with the Lot containing about 39.1/ ground cover ratio in a district that allows a maximum of 30/ for undersized lots; and as to side and rear yard setbacks with the dwelling being sited at about 1.9 feet at its closest point from the westerly side yard lot line, and with the garage being sited at about 0.8 feet at its closest point from the northerly rear yard lot line,in a district that requires a minimum side and rear yard setback of five (5) feet. The Premises is located at 7 SPRING STREET, Assessor's Map 55.1.4, Parcels 45, 46 and 103, Plan Book 13, Page 20. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There was a letter, signed by six (6) nearby abutters, on file that stated that the undersigned had no objection to the proposed plan. There was no opposition expressed at the hearing. 3. Applicants represented that the garage pre-dated the 1972 enactment of the Zoning Bylaw and was validly grandfathered as to location. Applicants wished to renovate the existing garage and convert its use to a studio use, installing bathroom facilities. There would be no increase in the footprint of the structure and the roof ridge height would be raised from about 12 feet to a maximum of 16 feet within the side and rear yard setback areas without coming any closer to those lot lines than the existing structure. The one (1) required parking space would continue to be provided on site. 4. Therefore, the Board finds that the conversion of the structure from use as a garage to use as a studio, normally allowed as a matter of right without relief from this Board if it was sited outside of the setback area, would not be substantially more detrimental to the neighborhood than the existing nonconformities as there would be no change in the footprint and the increase in height would be minimal. There would be little impact upon the neighborhood as a result. 5. Accordingly, by a UNANIMOUS VOTE, the Board GRANTS the requested SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A to alter and extend the pre-existing nonconforming garage structure by converting the use to that as a studio with bathroom, without any increase in footprint upon the following conditions: a. The maximum height~of the roof ridge shall be 16 feet; and b.
