At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, February 10, 2006, at 12:00 P.M. in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following Decision on the application of EDMUND J. RAMOS, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 039-00: 2. The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-33.A (alteration/expansion of a pre- existing, nonconforming structure or use). The Applicant proposes to demolish an existing "Quonset Hut" and metal gas storage shed, having a combined ground cover of about 1,323 square feet, and used in conjunction with the plumbing and heating business upon the lot. Applicant proposes to then construct a new wooden storage structure having a total ground cover of about 1,360 square feet of ground cover, conforming to all applicable dimensional zoning and parking requirements. The subject property (the "Locus") also contains a previously- permitted storage/shop building, to which an about 180 square- foot conforming addition was constructed in 2003, for which no permits were sought from this Board. Applicant is seeking validation by Special Permit under the same section stated above for this addition. No other changes are proposed to the shop/office under this application. The Locus is nonconforming as to use with the lot containing a commercial use in a residential zoning district; as to side and rear yard setbacks, with the Quonset Hut and metal storage shed being sited closer than ten feet from the rear yard lot line (to be removed from the site) and a lawnmower shed sited less than ten feet from the side yard lot line (to be moved to a conforming location on the lot). The Locus is conforming in all other respects. The premises is located at 5 RAMOS COURT, Assessor's Map 55, Parcel 213.1, Lot 4 on Plan File 56-C, and is zoned Residential-10, and is located in the Public Wellhead Recharge District. 3. Our Decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was one letter in opposition received prior to the public hearing. 4. Applicant, through counsel, stated that a plumbing and heating business has been conducted upon the Locus since prior to the 1972 adoption of the Nantucket Zoning By-law, which grandfathering was established in the previous Decisions. For 1 several years, the business was conducted by the Applicant, and now is owned and operated by his son. Previous relief contained in the Decision in BOA File No. 044-88 authorized the construction of the present storage/shop building on the northerly portion at the front of the property. The office addition constructed on the southerly side of the building in 2003 was made pursuant to a validly issued building permit by the Building Department. At the time, no relief was required by the then Building Commissioner from this Board prior to issuance of the building permit, and a Certificate of Occupancy has issued for such construction. The Applicant now proposes to remove the Quonset Hut and metal storage structures upon the Locus, both of which violate rear yard setback requirements, and will replace them with a single new wooden storage building, meeting all setback requirements. Similar relief authorizing the construction of a new storage building was granted in the Decision in BOA File No. 039-00, but was not exercised by the Applicant in a timely manner and has thus expired. To the extent necessary, Applicant wishes to validate the 2003 construction. As shown upon the site plan, all requirements as to ground cover, setbacks, parking, loading zone and the open space would be met by the Applicant, and existing side and rear yard setback nonconformities would be eliminated as a result of the proposed work. The gross floor area of the interior commercial space upon the Locus would be about 3,940 square feet and outdoor storage would not exceed 780 square feet; accordingly, the work proposed does not constitute a Major Commercial Development. The noncomplying lawnmower shed would be relocated to a conforming site. The site is already screened in part by a six-foot solid board fence and gate. 5. Issues were raised during the public hearing as to outdoor storage, water quality, and Planning Board permitting requirements of the Public Wellhead Recharge District. Applicant explained to the Board that to the extent any commercial storage of containers and such had migrated onto the adjacent lots in the Ramos Court subdivision, they would be removed. Future outdoor storage would be only within the fenced areas upon Locus, and not within the zoning setback areas. A certificate of water quality compliance for the proposed work has been issued by the Wannacomet Water Company, setting forth that the proposed work would not change the current use of the property and that it would not have any adverse impact on the groundwater quality. As to whether or not the application should be before the Planning Board pursuant to §139-12.B.3 (c), this is not an expansion or change of the existing use upon the Locus, and therefore no Planning Board review is required. 6. Therefore, based upon the foregoing, the Board of Appeals finds that the proposed alteration of the pre-existing, nonconforming uses and structures upon the Locus by removal of the existing "Quonset Hut", and metal storage building, and construction of the new conforming storage building as proposed, and the validation of the 2003 construction, would not be substantially more detrimental to the neighborhood than the pre- existing conditions upon the Locus and would in fact be an 2 improvement with the removal of the Quonset Hut and metal storage building, and relocation of the shed to a conforming location. 7. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-33.A to complete the project as proposed above, upon the following conditions: (a) The proposed construction shall be performed in substantial conformity with the site plan presented to the Board of Appeals done by Nantucket Surveyors, Inc., dated January 5, 2006, and revised February 2, 2006, a reduced copy of which is attached hereto as Exhibit A; (b) There shall be no commercial storage for the plumbing and heating business conducted upon the Locus on any other lots in the Ramos Court subdivision; (c) There shall be no outdoor storage within required side yard setbacks areas, and all materials stored outdoors shall be properly screened; (d) There shall be only one commercial tenant on site and any change in use would require further relief from this Board; (e) Building permits for the removal of the Quonset Hut and the metal gas storage shed shall be secured prior to, or concomitantly with, the issuance of the building permit for the new storage building. The Quonset Hut and metal gas storage shed shall be removed from the Locus prior to the issuance of a Certificate of Occupancy for the new storage building. (f) The lawnmower shed shall be moved so as to comply with setback requirements, or at the option of the Applicant, removed from the property. 8. At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, June 9, 2000, at 1:00 P.M. (originally noticed for May 12, 2000, and continued without opening) in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of EDMUND J. RAMOS, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 039-00: 2. The applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-33.A (alteration or expansion of a pre-existing, nonconforming structure or use). To the extent necessary, the applicant also seeks a MODIFICATION of the Special Permit granted in Board of Appeals File No. 044-88. The applicant proposes to demolish an existing "Quonset Hut" with ground cover of about 998 square feet, an existing metal storage shed with ground cover of about 355 square feet, and a lawnmower shed with ground cover of about 82 square feet, and construct a new wooden storage structure with about 1524 square feet of ground cover, conforming to all applicable dimensional zoning requirements. All six of the required on-site parking spaces, and the required loading area, will be provided, albeit in a different configuration from that which was approved in the decision in Case No. 044-88. The subject property (the "Locus") also contains a previously-permitted storage/shop building, which also contains an office. There is about 781 square feet of screened outdoor storage, which will remain. All structures upon the Locus are used in conjunction with the applicant's plumbing and gas business. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was favorable, subject to the provision of adequate screening. There was no support nor opposition presented in person, in writing or through representatives at the public hearing. 4. As set forth in the decision in Case No. 044-88, the applicant has conducted his plumbing and gas business upon a tract of land of which the Locus is a part since a time prior to the 1972 adoption of the Nantucket Zoning By-law. In 1984, the applicant obtained Planning Board approval for a subdivision plan 1 of this tract and an adjacent parcel of land which he had acquired from Nantucket Gas & Electric Company in 1973 and which had also been used for commercial purposes since a time prior to the adoption of the By-law, with the Locus being one of the lots created by this plan. The decision in Case No. 044-88 authorized the construction of the present storage, shop and office building, containing about 2430 square feet in ground cover. The applicant now proposes to demolish the unsightly pre-existing commercial structures upon the Locus, and to replace them with a new wooden storage building, which has been approved by the Nantucket Historic District Commission ("HDC") All required parking will be provided, as will the required loading zone and the required open space. The total ground cover will be about 3,955 square feet, with the maximum ground cover ratio in this Residential-10 zoning district being 200, or about 5,003 square feet of ground cover upon the Locus, which has lot area of about 25,014 square feet. The gross floor area of the interior commercial space upon the Locus will be about 3,955 square feet, and the total area of interior and exterior commercial uses will not exceed 5,000 square feet; accordingly, the threshold criteria for a major commercial development have not been met. 5. An issue was raised during the public hearing as to the status of the applicant's compliance with certain conditions imposed by the Board of Appeals in the decision in Case No. 044- 88, as to the use of other parcels of land. These conditions purported to prohibit commercial uses upon other lots in the 1984 subdivision, and to require abandonment of all nonconforming commercial activities upon the 9 York Street parcel formerly occupied by the applicant. The Board of Appeals was informed by the applicant that the commercial uses upon each of the subdivision lots have continuously been in existence since a time prior to the 1972 effective date of the Nantucket Zoning By-law, and that the 9 York Street parcel was in fact not owned by him until his father's recent death. In any event, the majority of the sitting Board of Appeals determined, based upon the applicant's representations, that it would consider the present application upon its own merits, without regard to the status of extraneous parcels. 6. By a vote of four members (Hourihan, Waine, O'Mara and Parent) ire favor, and one (Toole) against, the Board of Appeals voted to make the finding that the proposed alteration of the pre-existing, nonconforming uses and structures upon the Locus by demolition of the existing "Quonset Hut", metal storage building an lawnmower shed as proposed and construction of a new storage building with about 1,524 square feet in ground cover, resulting in ground cover of about 3,955 square feet will not be substantially more detrimental to the neighborhood than the pre- existing conditions upon the Locus, and accordingly GRANTED the requested relief by SPECIAL PERMIT under X139-33.A, and MODIFICATION of the Special Permit granted by the Board of Appeals in Case No. 044-88 to permit the construction as proposed, subject to the following conditions: 2 (a) The proposed construction shall be performed in substantial conformity with the site plan presented to the Board of Appeals and endorsed under By-law §139-23 on June 9, 2000, being a copy of a plan by Nantucket Surveyors, Inc., dated March 17, 2000, with additional information shown thereon, a reduced copy of which is attached hereto as Exhibit A, which depicts an existing fence thereon to screen activities upon the Locus from the surrounding lands; (b) The proposed construction shall be performed in substantial conformity with Certificate of Appropriateness No. 34114 issued by the Nantucket Historic District Commission, as the same may be amended; and (c) The applicant shall move his business so that it will be conducted solely upon the Locus.
