No. 19309 Residential-1 Zoning District Land Court Plan 40475-A At a public hearing of the NANTUCKET ZONING BOARD OF APPEALS, held at 1:00 p.m., Friday, May 12, 2000 in the conference room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts on the Application of Richard J. Glidden, Trustee of 12 Cod Fish Park Realty Trust, 37 Center Street, P.O. Box 1079, Nantucket, Massachusetts 02554, Board of Appeals File # 038-00, the Board made the following decision: Applicant is seeking relief by Variance under NANTUCKET ZONING BY- LAWS SECTION 139-22A (Island Permit Restrictions). Applicant proposes to demolish an existing dilapidated non-conforming single-family dwelling and construct a new conforming single-family dwelling on the Locus. Applicant is in receipt of a letter dated April 10, 2000, from the Building Commissioner, stating that the existing structure constitutes, "... a severe hazard to the other structures...." Applicant has also been asked to apply for and obtain a permit to demolish the subject structure forthwith. Applicant was subsequently ordered to, "...remove all wood structures on property..." due to its unsafe status in an "order to cease, assist, and abate" dated April 11, 2000. Under Section 139-22A of the Zoning By-law, protection within the area adjacent to, "...Nantucket Sound in the Atlantic Ocean between the water and the primary coastal bank..." is extended only to dwellings, "...which have continued in lawful existence since April 6, 1982...." Applicant contends that if the structure is demolished, any protection it would cease and it would require Variance relief to build a new structure on the Locus. The premises is located at 12 COD FISH PARK ROAD, Assessor's Map 73.2.4, Parcel 9, Land Court Plan 40475-A. The property is zoned Residential-1. 2. The Decision is based upon the Application and the material submitted with it and the testimony and evidence presented at the hearing. The Planning Board recommended that the Building Commissioner interpret the term "primary coastal bank". The Planning Board recommendation went onto state that should the interpretation conclude that the subject property is not located between the water and the primary coastal bank then relief was unnecessary and the Application could either be withdrawn or denied by the Zoning Board of Appeals without prejudice. Furthermore, the Planning Board recommended that should an interpretation of the term "primary coastal bank" conclude that the subject property is located between the water and the "primary coastal bank", the Variance request should be denied because, in the Planning Board's view, it would constitute a use Variance, relief specifically prohibited by the Zoning By- law. There were no letters on file from abutters in favor of, or opposed to, the Application. The Applicant, through his attorney, opened the hearing by asking that the Zoning Board of Appeals find that no relief was necessary because the "primary coastal bank" in Cod Fish Park is seaward of Cod Fish Park Road. As Locus is landward of Cod Fish Park Road, such a finding would abrogate the need for any form of relief from the Zoning Board of Appeals. Applicant's attorney stated further that if the Board did not agree to find that the "primary coastal bank" was seaward of Cod Fish Park Road, he would then argue on behalf of his client for the required Variance. Applicant's attorney testified to the Board that, in fact, a "Bank" does not begin in Siasconset until the high landform is immediately landward of the coastal beach, pursuant to the definition of "Bank" as found in the definition section of The Nantucket Conservation Commission Regulations. Applicant's attorney stated by way of information that "primary coastal bank" is not found in the definitional section of the above-mentioned Regulations. 4. Applicant's attorney stated further that if the Zoning Board of Appeals finds that the "primary coastal bank" is the geographical highpoint of Siasconset upon which Front Street and Post Office Square sit, then the same consequence would hold true for that part of Nantucket located between Orange Street and the Harbor as well as between Cliff Road and the Harbor. In other words, such a finding for Siasconset could lead to the same interpretation for areas of Nantucket seaward of Orange Street and Cliff Road and result in a similar prohibition against new structures. 5. A member of the Nantucket Conservation Commission was in the audience and stated that as he had looked at the landform seaward of Cod Fish Park Road, and found seven (7) to ten (10) inches of loam at its surface. He said this would indicate that the landform seaward of Cod Fish Park Road was a bank and not a dune, as dunes are made up of windblown sand only. Applicant's attorney also stated for the record that he had discussions with the original drafter of the By-law in question (Nantucket Zoning By-law 139-22), and had reached the conclusion that the original intent of the By-law was to bar new construction between the water and the first landform when looking landward from the water. In other words, in Cod Fish Park, the first landform when looking from the water is the scarp of the dune misidentified in the By-law as the "primary coastal bank". The drafter of the By-law in question stated that it was the intent of the By-law to prohibit reconstruction of cottages on beaches eradicated by coastal flow erosion. 6. Applicant's attorney went on to state that Nantucket Zoning By-law 139-22 is patently ambiguous. Legislation that is patently ambiguous, in other words, defective, obscure, or insensible, on its face, cannot lead to an enforcement decision that results in a hardship. 7. Therefore, the Board finds that the "primary coastal bank" is seaward of Cod Fish Park Road and that Locus, being landward of said road, is not subject to the prohibition against new construction found in Section 139-22A of the Nantucket Zoning By-Law. Accordingly, by a UNANIMOUS vote, the Board DENIES the requested VARIANCE under Nantucket Zoning By-law, Section 139-22A as relief is not necessary. Applicant has ' obtained permission from Conservation Commission to install a new septic system to serve the dwelling. Applicant has received a letter from the Building Inspector demanding that the existing dwelling be demolished as it is a safety hazard (copy enclosed).
